Sharia Law, Anyone?

Or just Obama’s pick for the legal adviser to the State Department? Harold Koh, former dean of Yale Law School, seems to think that is A-Okay in the US of A. Oh, how I wish I was kidding. This article, “Koh, No” goes into more detail about Obama’s pick. And it ain’t pretty. Well, it isn’t if you care about US law superseding international law in the US. I reckon that’s just kicking it old school, though, and Obama is all about CHANGE!!!

Here are the particulars:

President Obama’s nominee to be the State Department’s legal adviser has ignited a fury among conservative critics who say his views are a threat to American democracy — an accusation the White House on Tuesday called “outrageous” and “completely baseless.”

Former Clinton administration official Harold Koh, who has been dean of the Yale Law School since 2004, once wrote that the U.S. was part of an “axis of disobedience” with North Korea and Saddam Hussein’s Iraq. Koh also has long held that the U.S. should accept international law when deliberating cases at home.

Obama nominated Koh on March 23 to become the State Department’s legal adviser — an appointment that, if confirmed by the Senate, will give Koh far-reaching influence over the extent to which international norms affect U.S. law.

“This is not a desk job. This guy will be the face of American international law around the world,” said Steven Gross, legal expert and fellow at the conservative Heritage Foundation.

“The top legal adviser at State travels extensively and is involved in international legal negotiations, treaties and in major United Nations conferences.

“The president should have the right to choose the most conservative or liberal legal advisers to give them advice, but this is much more than that. The concern is that he cares as much about — if not more about — international law and integrating that into the American judicial system than he does about protecting American prerogatives and American sovereignty,” Gross said.

The White House vehemently defended Koh’s nomination on Tuesday, telling FOXNews.com that he is “one of the most respected members of the legal community.”

Koh “earned wide bipartisan praise as assistant secretary of state and he’s universally respected by legal scholars,” White House spokesman Reid Cherlin told FOXNews.com. “The president looks forward to working with him at the State Department. He’s a strong believer in the Constitution, and the president nominated him because of his firm defense of the Constitution.”

State Department spokesman Gordon Duguid also offered praise for Obama’s nominee.

“Dean Koh is universally respected for his legal scholarship and previously served as an assistant secretary of state — and was praised for his work by Republicans and Democrats alike,” Duguid said. “President Obama and Secretary Clinton strongly believe he’s the right person for the job.”

Know what I find interesting? That Secretary of State Hillary Clinton is not quoted here. I mean, it just seems to me that if Koh is going to be the Legal Adviser to the State Department, maybe someone should have asked her what she thought. Ahem.

There is more:

Koh, like Obama, is a strong opponent of the Iraq war and the use of harsh interrogation techniques that some consider torture. He has fiercely criticized former President George W. Bush for invading Iraq in 2003 and has accused the Bush administration of trying to “block public release of more Abu Ghraib type pictures.”

“We should resist the claim that a War on Terror permits the commander in chief’s power to be expanded into a wanton power to act as torturer in chief,” Koh wrote in an article published in May 2006 in the Indiana Law Journal.

Koh also advocates a “transnational legal process” and has criticized the U.S. for its failure to “obey global norms.”

In an article published in the Berkeley Journal of International Law in 2004, Koh wrote, “What role can transnational legal process play in affecting the behavior of several nations whose disobedience with international law has attracted global attention after September 11th — most prominently, North Korea, Iraq and our own country, the United States of America? For shorthand purposes, I will call these countries ‘the axis of disobedience.’”

And in a Stanford Law Review article published in May 2003, Koh wrote that supporters of the International Criminal Court should bring pressure to bear on U.S. opinion “with an eye toward persuading U.S. officials that the ICC actually serves U.S. interests.”

I believe the US does have to work well with the international community, and that international law is important. But what REALLY concerns me is this:

A March 21, 2007, blog posting on National Review’s Web site shows a letter written by New York attorney Steven J. Stein to Koh, challenging Koh for supposedly saying during a speech to the Yale Club of Greenwich that year that Islamic law could apply to disputes in U.S. courts.

“In your discussion of ‘global law’ I recall at least one favorable reference to ‘Sharia,’ among other foreign laws that could, in an appropriate instance (according to you) govern a controversy in a federal or state court in the U.S.,” Stein wrote in his letter addressed to Koh.

Cherlin said Stein’s version of events is “not accurate,” and that the host of the event in question disputed the account. Stein could not be reached for comment.

Koh’s critics insist his legal views undermine the U.S. Constitution and American sovereignty.

And that’s just it. Sharia law can be imposed here in the US?? SERIOUSLY?? Holy freakin’ cow. Every woman in this country should be shaking in her boots at that thought. I am not kidding you. Following this article is a video interview of an Arab woman describing in more detail just what Sharia law is. I can sum it up here: it is scary shit.

And then there is this concern, also no small matter:

John Fonte, senior fellow and director of the Center for American Common Culture at the Hudson Institute, told FOXNews.com that Koh’s views have “a very big practical effect on American foreign policy and on American democracy.

“This is international imperialism. Under Koh’s plan, the Constitution would become secondary and international law would take precedence regardless of what Americans said about the matter.”

See, I have just a wee problem with subsuming our Constitution. I realize that Obama has been hell-bent on that from the get-go when he refused to provide his actual birth certificate, or ANY documentation about his background, not to mention when he engaged in bullying, intimidation, and fraud to get his way. Oh – and firing the CEO of a privately held company has to be a problem. Then there is his connection with ACORN and its receipt of US Taxpayer dollars to engage in partisan politics as well as voter fraud (if you didn’t see the Lou Dobbs video I posted recently on this, here is the LINK). So, yeah – I realize he does not seem to hold it in high regard, his minions claims of him being a Constitutional Scholar notwithstanding (just because someone CLAIMS to be an expert doesn’t mean they ARE an expert, after all).

And for the other side:

Supporters tout Koh as a leading expert on public and private international law, national security law and human rights.

He served as assistant secretary of state for democracy, human rights and labor from 1998 to 2001, and previously had served on the secretary of state’s Advisory Committee on Public International Law. He has argued before the U.S. Supreme Court and testified before Congress dozens of times, and he’s received more than 30 awards for his human rights work, according to Yale’s Web site.

Cherlin described Koh as “an American success story.” (His brother, Howard Koh, was tapped by the president two days later for a position in the Health and Human Services Department.)

“He’s the son of immigrants. He’s a dedicated teacher and professor, and does great work. We don’t have any question whatsoever about any of these issues raised by critics who are sworn opponents of the administration,” said Cherlin, who said the conservative critics’ opposition was “ideologically driven.”

So, because he is the son of immigrants, we should just throw the Constitution and our laws aside? Because he’s such a nice guy, it’s okay that he doesn’t mind Sharia Law imposed here? I’m sorry, but that’s just a smokescreen to attack his critics with a broad brush without dealing with the issues raised, and they are serious issues, indeed.

While Harold Koh may be a great teacher and all that, it does not make up for his willingness to supersede US law in a State Department position. Once again, Obama is pushing a candidate who is not the best choice, not for the country, or for the Constitution. And most definitely, not for women.

    Why would the US ever consider Sharia Law or any religiously-based system to stand shoulder-to-shoulder with our own laws or Constitution? It makes no sense. And what “appropriate case” could possibly inspire any consideration for this?

    Oh wait. Maybe the woman who was beheaded by her husband in NY. The poor man was simply following Sharia Law.

    And I find all this “transnational” discussion really troubling anyway. International law supercedes our rule of law on our own soil?

    Koh is going to have lots of ‘splaining to do. It will be interesting to hear him provide the details. But I expect he’s going to get a lot of push back.

      Like Ani’s excellent post yesterday on NARAL, why in the HELL did they back Obama who had a thin, thin record on women’s right to choose as compared to CLINTON’S!! Sharia law will be the applicable law if you are a Muslim living here. It’s already happening in MN. The higher % of Muslims in a country, the more hostile they become.     If this is true, it is terrifying and unacceptable. The UK has instituted Sharia law courts dealing with issues such as divorce and domestic violence. I have provided info for a link below. Since Sharia law is completely religiously based and women have less rights then men in this religion it is disgusting that it has been used in domestic violence cases in the UK. Is this what Koh might mean by an appropriate instance.

    Creating parallel justice systems in this country can’t be allowed. It would undercut everything this country stands for and make the deaths of every soldier and citizen who has ever died defending this country and its freedoms or trying to ensure equal justice for all be for nothing.

    If this is true we should really start being afraid.

      I want to add that all religions may have text that is out of step with modern views of human rights. These religions have through growing pains been allowed for the most part to be open to discussion and reinterpretation. There are moderates who want to have a discussion about the meaning and interpretation of Islam and a hard look at Sharia law but these people haven’t gotten traction – they need our support not our endorsement of the current system.

        Sharia law is one thing, and it would be terrible for this country. But the one thing that would be worse might be the backlash from instituting it and a resultant ban on religions or a list of approved religions. These recent events are beyond ridiculous and one has to ask exactly what the real agenda is here? Do we really think America is going to buy into European socialism, Sharia law, and maybe a world currency? Since I don’t think yes to any of these… the question arises WHY then? Are these politicians really this naive and stupid? The democrat fringe in control maybe, but the republicans? I don’t know to be more afraid of what’s happening now or what will happen in the backlash from it from a republican fringe. We need some common sense people from the center to temper this. In effect, we are over steering this nation into a state where we may not be able to regain control without a crash.

          It is funny (not ha-ha) how the pendulum swings back and forth. The relatively short history of our country is full of over-reactions that then require decades of recovery. Just think about the involvement in WWI followed by isolationism that at least in part then lead to the horror of WWII. Not to mention various periods of religious and / or social conservatism followed by unrestrained excess then followed by a backlash revival.

          I share your concerns. Where is the majority? Silent or complacent it seems. Their silence is deafening.

          I am concerned that in some ways we have met the new boss who is the same as the old boss; we are just seeing the other side of the same coin we lived with for 8 years.

          My hope is that while some republican leaders are conservative, some might be libertarian enough to then not turn around and impose their personal conservative views on everyone else. I’m hoping for some Statesmen and Stateswomen to come forth who will view their job as representing the people, all the people, and not just thinking that they know better than the rest of us.

          Truth be said, I’m pretty worried about a future of a couple decades of blowback right now.

      I am female.
      I was raised in a strictly religious environment, father was a preacher, who secretly and regularly beat his teenage wife (he married her when he was 33). After I left home at 17, I later joined a “cult.” You see, being beaten and told that I must be obedient to men or my soul would go to hell, was all I ever knew.

      My uncles have told me stories about their upbringing in Missouri, NOT religious. My grandmother raised 9 children with a usually-absent, highly abusive man. He kicked her until she miscarried, at least once. When his daughter (my aunt) became pregnant at 16, he tied her to a chair and beat her for 2 days, trying to get the name of her impregnator. When she wouldn’t talk, he put her on a bus, and never saw her again.

      THIS IS IN AMERICA, NOW! And it’s not even Sharia. For Sharia law to be practiced in the US could EASILY happen.

    Go ahead and hate Obama if you want to but let’s stick to the truth. This is a smear job. Koh is not in favor of Sharia in the US.

      To be perfectly honest, I don’t know if it is true. I put that caveat in my comment.

      But… I wonder if they serve booze at some of these academic functions that loosen people’s pie holes.

      Remember Larry Summers and the innate differences between men and women account for the lack of women in math and science crack. It wouldn’t surprise me one bit that an academic in a comfortable setting would spout off without thinking about blowback.

      As we’ve been told – WORDS MATTER. One of the problems with this is that these people have influence. When they say things at conferences and meetings and alumni dinners with people who have real power to act on what they hear it does matter what the speakers say. And apparently there are no negative repercussions for these people.

      If I spouted off in a public or quasi-public venue in a negative way about black people I shutter to think what hell my life would be made. Just look at what happened to President Clinton when he quoted fact about who won various primaries in the past – he was labeled a racist by the very organization of which you now say is being smeared itself – the Obama political organization.

      For all our sakes I hope Koh never said anything resembling an acceptance of current Sharia law – but if anything this latest dust up can at least raise awareness of the insidious and dangerous creep that our justice system could take, like what has happened in the UK.

      And you would know that HOW, exactly, St. Paulie?? I don’t believe everything I read, either, but a number of sites did have this article, and as I said, Koh himself has not denied it, as far as I can determine. If evidence surfaces that he never said it, I would GLADLY post that.

      Until then, I stand by the very real possibility that he DID say it.

    People should read Melanie Phillips’ blog at the Spectator about what is going on with their Muslim population in the UK (she leans right and pro-Israel but we can’t dismiss the truth in many of her posts). Their liberal media has gone to the dogs. If that is a harbinger of things to come in the US, it is scary. We have already given up on the use of the word terror or terrorists here (just like the Brits) — they have become contingency operations and I wonder what the admin calls the people who make those operations necessary.

      This is the Melanie Philips link. Reading it made me cry again. I spent last night on a three way call with my friends and we all just lost it. From stuff we’ve been told, scary stuff, America is done. There’s a meeting at the G20 today to discuss getting ready of the dollar, apparently, and this is going to be really bad if they do it. But other things going on are just so disturbing. Anyone who doesn’t believe Obama is the Manchurian Candidate is dead wrong. This is a mess.

    So, now is there any responsibility on Secretary Clinton’s part to speak up? It is one thing to take the Secretary post because to help the country. Letting your name and credibility be used as a “rubber stamp” is something different. At least to me it is. No matter, we have to quit idolizing the degrees of these “intellectuals”. Does being the former Dean of Yale Law impart any degree of common sense to this man? No. Does it imply any sense of national loyalty? No. Does being the son of immigrants grant him any special leeway in his opinions? No. If the people we trust to speak out won’t… then we can no longer trust them. It is as simple as that.

            As for me, when someone tells me their agenda, I believe them. I have a study I’ll post…have to go out for an errand now. Maybe someone else has it; a list showing % of Muslim population and how their behavior/demands change as numbers in a country increase.

    Just another disturbing decision from the 0-admin. I still disagree with 95% of the things Republicans say and stand for but I am so out of sync with the current ruling party that it’s just depressing.

    And thanks for mentioning that birth certificate –I still don’t understand how you can campaign for POTUS, let alone take the office–without showing your bc! I still have “hope” that it will surface and he will be exposed as a fraud. But I fear he is as nefarious as his cousin Cheney when it comes to secrets.

    Don’t states prohibit bigamy? Don’t states prohibit all forms of abuse of minors? Haven’t states developed legal procedures for divorce and marriage and regulation of banks and finances? Don’t women have rights? From what I’ve heard or read of Islamic law and traditions, all of those aspects of our legal system would be undermined. Our legal system is not perfect, but why destroy it completely for something as obscene as THIS (I don’t have a good inoffensive word for this).

    I think he’s a great choice. most people are intimidated by his intelligence. When bush was president you couldn’t find a person with an IQ above room temperature. Now we actually have intellectuals in the government and people are incredibly intimidated. The Republicans don’t have the votes or the balls to stop anyone. They’re the ones that are dangerous.

    PS Thought you’d like to know. I London last night there was a ball given in Obama’s honor called the “President Rock Star Ball!!” He and Michelle looked fabulous. There were celebrities and dignitaries everywhere. Whether you like Obama or not,He’s adored in other countries. Angela Merkel is giving throwing a dinner in his honor tonight. This a great trip!

      I am a bit confused about who is or is not an intellectual and just exactly what that means. I thought Neocons are intellectuals and that they basically ran the Bush Administration. Is Naomi Klein an intellectual? Did she not warn us in her book “Shock Doctrine” about all those other intellectuals from University of Chicago (Obama’s stomping ground) and other places and their inhumane tampering with the economic order? “Intimidated” might not be the best word to describe the general public’s reaction to Obama’s intellectuals. Maybe “horrified”, “appalled”, or “nauseated” are better descriptions.

      President Rock Star Ball seems like an apt theme for an Obama reception. People around the world, for some strange reason known to only to earthlings, tend to be generally enamored of these make-believe creatures of PR…until they grow, which may take a while for many of us.

    there are 3 hundred million people in america. if the govt sent every person just one million that would only be 300 million , not anywhere close to a trillion. with one million each im sure folks would start spending and buying again thereby stimulating the economy immediately instead of selling america off to the chinese.

        Or a one year income tax holiday to every adult who had filed income tax for the preceding year up to a 5K limit per person, 7.5K head of household or 10K for a family filing jointly with 1K additional per child dependent under 18? It would be giving back a little to those who have pay in, and it would stimulate the economy. It beats giving money to field mice.

    Is Obama an intellectual? There is no actual proof of that. Nor is there any proof that those who are his staffers are all that. That would be just based on oh, Jon Favreau’s antics or the recent gifts given to a head-of-state and a monarch.
    I would take an average intellect worker who is a self-motivator and has common sense over a lofty, arrogant “intellectual” any day.

    Intellectual discussions of the differences between Western thought and the Middle East, Asia and the Orient are excercises in futility. The reality is that these cultures and religions have existed for thousands of years. Despite advances in technology and knowledge which have made the world a smaller place, the tribal traditions are ingrained in these peoples.
    We tend to see the big, westernized, capitalistic cities of the world as representative of the true nature of their society. Big mistake. We take our freedoms for granted and assume that the rest of the world will throw off thousands of years of tradition to live like we do. Wrong.
    I have been to Egypt and Saudi Arabia. The moral police are very much alive and operating in these countries. Women are the targets, men are not. In Saudi, women cannot even drive a car; in China and other places, female babies are left to die because males are considered more valuable to the family; in Pakistan, a 15 yr old girl was gang raped by 3 men, which dishonored the male members of her family. She required to produce 2 male witnesses in her defence for every 1 male accused. Of course, no man was willing to defend her. She was killed.
    I suggest you watch the CNN documentaries “The Kingdom” and “God’s Warriors” hosted by Christiane Amanpour.

    And that’s all this is: a blog posting on the arch-conservative web site National Review. No actual quote, no recorded quote, no nothing. Just the word of the Republican Party’s mouthpiece, National Review. Is that really all it takes to smear a man? Especially one well-regarded enough to be Dean of Yale Law School?

    Except that Obama didn’t “fire” him. GM came back to the taxpayer trough for more taxpayer money. The government said that as a condition, the CEO had to go. They didn’t have to take the money, but GM decided the money was more important than their CEO. Their call, not Obama’s. And what does that have to do with Harold Koh, anyway?

    So, yeah – I realize he does not seem to hold it in high regard, his minions claims of him being a Constitutional Scholar notwithstanding (just because someone CLAIMS to be an expert doesn’t mean they ARE an expert, after all).

    Correct, but if someone if given a teaching position where they teach Constitutional Law at a prestigious university, well, they actually might be an expert.

    The State of Minnesota does sharia loan (sharia compliant finance) for housing.
    Subsidiaries of AIG do sharia lending, and we the taxpayers are paying.

    There are many sharia “courts” in the UK.

    Thanks for the article, Amy. Do you know if the Pakastani man in Buffalo who beheaded his wife is even in jail or has he never been arrested? My daughter lives near there but she knows very little about the case. It has been kept very quiet.

I thought it compelling to listen to Nonie Darwish and we should take to heart her warnings of how this law works against women, and also be concerned regarding her comment that this sends a message which is standing against progress made by Muslim reformers against Sharia law. Religious freedom in America anyone?

      With all that is happening under the rule of Chairman Obama,and considering his close associations with unsavory pro-terrorist islamists,I wouldn’t be surprised if Sharia finds it’s way to our beloved Country.

    PS For those who would defend Koh, why not suggest he deliver a strongly worded speech against Sharia law and how it will never come to our American shores, a speech similar to Obama’s speech regarding Reverend Wright.

    Now a little off topic, but I was just reminded with my last comment…
    Do you remember that shortly after the DNC Rules and Bylaws committee decided to be undemocratic on May 31st, that Obama made an announcement disassociating himself completely from Reverend Wright. The committee gave Obama the decision on the condition that Obama fully disassociate himself with this person once so important to Obama. I was making calls for Hillary in South Dakota and Wyoming and was so broken-hearted. Alright, I better stop, or I’ll turn into the Incredible Green Hulk.
