The RBC = Bush v. Gore

Hillary supporters watched with amazement and horror over the weekend as the RBC arbitrarily stole 4 Michigan delegates from Hillary, gave Obama delegates he didn’t earn, and disenfranchised 50% of Florida Democrats. The theft of delegates was blatant and illegal:

the RBC arbitrarily handed Michigan delegates to the DNC’s preferred candidate to try to prevent him being defeated at the convention. There is no rule or guideline in the DNC that allows that organization to redistribute a state’s delegation to the national convention. They can refuse to seat a delegation, they can refuse to permit the delegation to have full voting authority, but they cannot change the composition of the delegation.

It’s no accident that this feels like a recurring nightmare. We are seeing a recreation of the Florida 2000 coup d’état in mirror image. The Dean/Brazile/neo-liberal wing of the Party learned their lesson in Broward County all too well.

The most obvious clue of this theft, of course, is that Hillary has won more votes than Obama. Usually the popular vote winner wins the contest. Just ask Al Gore.

The insistence on “the rules” as a way of rewarding Obama over Hillary was a transparent power-grab echoing the Republican “Sore Loserman” narrative from 2000. The “rules” were created specifically to deny Hillary the nomination. The rules, as we saw over the weekend, are malleable, only needing to be massaged to assure the desired outcome. Similarly, in 2007, Republican operatives tried to change how California apportioned its electoral votes in an obvious attempt to change the rules for electoral gain.

The RBC’s back room deal regarding Michigan, which only won approval by a single vote, has the familiar ring of Bush v. Gore, where one Supreme Court Justice vote made Bush president. As Jerome Armstrong writes, “One RCB vote changed everything.” The always insightful Anglachel writes:

Reallocating votes based on the outcome you want to have, not what the certified vote count actually was, eviscerates democracy as such.

Think about this. Really think about this. A committee of people, behind closed doors and under pressure from a specific candidate to shore up his crumbling support, has functionally declared Michigan’s votes null and void and has reallocated the delegates to suit themselves.

The notion that a “committee of people” can decide outcomes regardless of voter intent is hauntingly similar to Vicent Bugliosi’s angry and brilliant essay on Bush v. Gore published in The Nation in 2001:

[By] the US Supreme Court handing the election to George Bush, the Court committed the unpardonable sin of being a knowing surrogate for the Republican Party instead of being an impartial arbiter of the law

Bugliosi argues convincingly that it wasn’t just voters of Florida who were robbed of their franchise, it was the 50 million voters across the country who voted for Gore. Similarly, the delegate stealing of Michigan and Florida isn’t only about the intent of 2.5 million voters, it’s the intentional disenfranchisement of nearly 18 million Hillary voters, a majority of the Democratic Party’s 2008 voters. Vicent Bugliosi continues:

this means that these five Justices deliberately and knowingly decided to nullify the votes of the 50 million Americans who voted for Al Gore and to steal the election for Bush…

The RBC acted in the same manner, deliberately and knowingly taking away votes from the candidate who had clearly and convincingly won in both Michigan and Florida. All of this done under the pretense of a scheduling conflict, yet the punishment was not applied equally to the other three states who also violated their “rules.”

The Rehnquist Court, according to Bugliosi, perverted the meaning and intent of the Equal Protection clause of the Fourteenth Amendment:

“no state shall… deny to any person within its jurisdiction the equal protection of the laws.”

By punishing states only Hillary won, the RBC became an arm of the Obama campaign, using its power to reward their favored candidate without giving equal protection to all Democratic voters:

The stark reality, and I say this with every fiber of my being, is that the institution Americans trust the most to protect its freedoms and principles committed one of the biggest and most serious crimes this nation has ever seen–pure and simple, the theft of the presidency. And by definition, the perpetrators of this crime have to be denominated criminals.

By going beyond its powers by taking away delegates from Hillary, the RBC became accomplices in another “theft of a presidency.”

The neo-liberal beta test was against Joseph Lieberman in 2006, a politician who had the gall to be socially moderate and hawkish on national defense — voting with Kerry, Edwards, Clinton and 73 other senators to approve the authorization to use force against Iraq.

It should come as no surprise that it was Howard Dean’s organization, Democracy for America, who spear-headed the anti-Lieberman drive.

Taking over the Connecticut Democratic Party’s nomination was relatively easily, but winning state-wide proved much more difficult. We’re likely to see similar results nationally.

The neo-liberal animus against Lieberman, like that against Hillary, is both crazed and hateful. A Daily Kos diarist, Susan Jumper, wrote that she’d like to “gas” the Jewish Lieberman, and others on her post compared Lieberman to a dog that should be killed. Der Stürmer couldn’t have said it better. While there are many examples of the crazed and hateful mindset of the Obama camp, one commentator at No Quarter exemplifies the violent imagery regularly used against Hillary, when writing:

“We all remember Bobby Kennedy was assassinated in June in California. I don’t understand it,” she said, dismissing calls to drop out.
Hillary is batshit, Liebercrat crazy.
Fuck her with a pitchfork.

Like Lamont, Obama is a light-weight candidate of the neo-liberal, Dean/Brazile/MoveOn.org wing of the Party. A fair number of his foot-soldiers and DNC insiders are willing to say and do anything to win, and this includes selectively disenfranchising voters. Like the Young Republicans chanting “Sore Loserman” in Broward County, the neo-liberals are intoxicated on their will to power.

It is likely that the hawkish, salt-of-the-earth John McCain will crush Obama. And after the RBC’s delegate stealing (perhaps the worst of the many offenses to occur during this campaign), many Democrats, disgusted with our Party’s undemocratic ways, will vote to help McCain do just that.

The Democratic party that cried about needing to count every vote in Florida in 2000, became the party of toss out enough votes to get the result they want in Florida in 2008. If Florida’s votes for Hillary aren’t going to count, why even bother of feigning to include them?

Obama wasn’t even on the ballot in Michigan. Despite this – they’re going to give him half of the Michigan delegates anyway. It is Affirmative Action in progress. What a big middle finger to that state too.

The irony is at so many levels. The reason that these delegates were thrown out to begin with is that these states dared to defy the Democrat party elites by holding their primaries too early. The little guy doesn’t matter to the oligarchy of rulers. Of course this was obvious when the rulers demanded to know who had their nomination hours after the polls closed on Super Tuesday. Sure the other half of the states who hadn’t voted will have their ballots counted: it just wouldn’t matter.

So why include half the votes of Florida and Michigan? Answer: they want Clinton’s supporters to leave her.

There is no way the Clinton supporters are going to drop their candidate of choice any more than the Obama supporters are going to drop their messiah. Counting only half the vote will be seen for what it really is: giving Obama the nomination.

I am frightened by how few Americans seem to have any understanding of or respect for objective principles. Most of us manage to justify any actions if it furthers our goals, even if it sets a terriblc precedent. I used to think this was much more of a Republican problem, but clearly I was wrong.

Our democracy is based on principles. How is it going to survive if our citizens are incapable of upholding them, even if it goes against their own self interest?

Voting rights are more important than ANY other in a democracy, because if the people lose them, the people lose any control they had over their government. Once that happens, all the other rights are easily taken away.

Obama is truly looking more and more like a fascist every day.

I was in the RBC meeting. I stood up after the Michigan decision and shouted at them that they had killed the Democratic party. People may say I “disrupted” the meeting, but I believe our Democracy is under assault right now, and if people don’t stand up against the immoral “RULZ” like people like Rosa Parks did, we WILL have fascism in America.

If they TRY and call Obama the nominee before Denver, we have to make it well known he is “illegitimate”.

No that wasn’t me. She was great, though. I am male. I was in the front to the left of the committee. I was the only Clinton supporter in the middle of a sea of Obamabots. They were completely nasty and smug, as if they had gotten away with something they thought we couldn’t do anything about.

No matter what happens, Obama can never be legitimate. The DNC made sure of that when they “gave” him 4 of Senator Clinton’s delegates. That was not within their rights or the rules.

After that bit of corruption the DNC has lost all credibility and the Obama campaign and supporters and surrogates are simply as corrupt as any Republican and thus do not deserve our loyalty and should never get our vote.

Unless you think stealing votes is fine and dandy. In which case you don’t believe in Democracy anyway so have at it.

Obamacrats don’t care about the “party”. They care about Obama. Period. And evidently so does the DNC

I tuned into the very end of that conversation and all I heard was the female host ask Beckel “Is this worse than Michelle’s thesis?” Beckel insinuated it was much, much worse. He also said if it was a Republican, he’d tell them what it is.

That was at 5:30 am CT and the said he would be back on in 2 hours, so that’s 7:30 CT (my time zone). He should be back on in 30 minutes.

Did Beckel say anything else or was his appearance this morning just a tease for the bomb he’s going to drop? Or is he even going to tell us? Is he keeping it to himself?

Malphrus (number 2 in the above picture), was appointed as an Immigration Judge in March of 2005, with absolutely no immigration law experience. He was given an immediate reward in 2001, being appointed as Associate Director of the White House Domestic Policy Council, where his responsibilities related to matters involving crime and sentencing, law enforcement, and homeland security. Within the last few days, he was elevated again by Attorney General Mukasey to serve as a Board Member on the Board of Immigration Appeals. I guess that he learned all about immigration law in 3 years, and was ready to be elevated to that appellate administrative tribunal.

I was there in Washington DC for counting of votes of M and F. At the end it turned out to be discounting of votes, 50% plus 4. Woe! I can’t describe the emotion I felt, the pain and disgust everybody went through. Damn! I want to vomit! The party that I supported through and through turned to ashes, it’s gone….

Unfortunately, that is precisely what I’ve come to expect for the “New democratic Party”. I understand Hillary’s party loyalty after all she and Bill have put into it, trying to change things for the better, but it may be time to call it a loss and start from scratch. I believe the democrat and Republican brands have gone the way of New Coke, and it is time to go back to the original recipe or come up with something new. America is ripe for it (exactly what Axelrod has been trying to exploit), and the time is now. This might be the only election ion our lifetimes that an independent candidate can win a Presidential election.

Uh No: You and the Obamatons in the DNC need to pull your heads out of your asses, read the DNC’s rules and get a clue. They are actually trying to do what a few months ago was thought to be impossible. Give the Republicans a 3rd term in the White House. What the RBC did was a clear violation of several of their own rules, so if Hillary takes it to the accreditation committee she has a VERY strong case.

1)The DNC rules required an investigation into why the states moved their primaries. There was no investigation!

2)As Archangel says the rules do NOT give the RBC the option to give any candidate the delegates for uncommitted! Uncommitted is a certified vote by their rules and according to those rules, those uncommitted delegates must go to the convention as uncommitted delegates!

Arlen Specter’s been pretty useless these past years, but he’s a fairly sharp lawyer when he puts his mind to it. And I read yesterday that he–HE!–is pondering a formal look-see into the Dean/Brazile atrocity. Because, you know, primaries are run by state governments and are publicly financed; they’re not just a private parties where the hosts can pull any bullshit that tickles their fancy.

Regardless of the outcome of Specter’s latest brain storm, it’s pretty sad when a Republican is the best hope for defending Democratic voters against their own party.

The caucus states followed the rules? That’s rich. Tell it to all the people in those states who were not allowed to attend due to scheduling or physical limitations, or those who watched in horror as Chicago thugs pushed them around and grabbed official paperwork out of designated workers hands.

Besides, even the staunchest of ‘Bots in the MSM admit that you can’t count the actual popular vote in a caucus state – there’s NO WRITTEN RECORD, just the questionable tally of a bunch of screaming. Texas is the proof for that – Clinton whooped Barky in the written (legal) Primary, but thugs and bullies STOLE the votes in the highly illegal caucuses.

BTW – Would you guys please get it straight? Clinton was pushing for FL and MI to be counter in January, before the DNC and MSM had crammed Barky so far down the public’s throats that we couldn’t even produce a gag reflex anymore.

because I’ve seen the Obot response to the “stolen delegate” accusation, allow me to give you the CORRECT story.

1) the “fair reflection” rule (found in both the bylaws and the charter) is about counting the VOTES THAT WERE CAST AS THEY WERE CAST…here is the wording from the bylaws Rule 13A

Delegates shall be allocated in a fashion that fairly reflects the expressed presidential preference or uncommitted status of the primary voters

It is the word “expressed” that gives the provision its meaning. The bylaws then go to considerable length to expain how “fair reflection” should be achieved…. a whole section talks about how delegates should be divvied up based on the RESULTS of the primary/caucuses.

So if anyone tells you that ‘fair reflection’ means ‘voter preference’ you know they are full of shit. Its about an accurate reflection of votes AS CAST.

(the ‘write in’ issue would be valid here — voter ERRIR should not preclude their vote from being counted. But based on the testimony, 30,000 write in voters were cast — that is 5% of the 600,000 valid votes counted. There is MINIMUM threshold of 15% of votes csst to make you eligible for a delegate, so there is insufficient write in votes to switch a single delegate.)

2) This is NOT what Michigan suggested. The “Michigan compromise” was based on FULL VOTES being given to each candidate. Under that scenario, Clinton would have maintained a 10 delegatee lead coming out of Michigan. Cutting the voting strength in half and then re-allocating delegates cuts her lead to 5.

The Michigan compromise was acceptable to the Clinton campaign PROVIDED that Florida’s delegation was seated at full strength as well — and it would have been impossible for the RBC to treat Michigan voters better than Florida voters.

Finally, the Michigan compromise could have been achieved WITHIN THE RULES. All it required was an agreement between the campaigns that Clinton would not compete for “uncommitted” delegate votes, and would submit the names of 4 Obama supporters as eligible to serve as part of her delegation. The RBC was required under the rules to seat Michigan as voted — ONLY the agreement of the candidates themselves could accomplish the compromise.

3) The vote was invalid. The RBC is required to hold all of its meetings in public, and no votes can be held in secret. An agenda was announced in the morning that was never followed in the afternoon session — and there was not vote to change the agenda. Two Challenges were offered, but the resolutions were limited to three — and no public vote was taken regarding the limits on resolutions. Debate was limited to 10 minutes by the co-chairs, and no vote was taken on limitation of debate.

A one hour lunch period was scheduled — the PUBLIC was told to return by the co-chairs in one hour, and they did so. NEITHER OF THE CO-CHAIRS, NOR THE PARTY SECRETARY, nor ANY MEMBER returned to the meeting AS THEY HAD BEEN INSTRUCTED TO DO AT THE END OF THE MORNING SESSION…. and according to everyone (including a personal conversation I had with Alice Germond) BUSINESS BEFORE THE COMMITTEE CONTINUED TO BE DISCUSSED DURING THE TWO HOUR PERIOD when the meeting was supposed to be public, but was held behind closed doors.

If a deal had been struck during the one-hour lunch period, that would have been ‘legitimate’ — there is no prohibition on memebers discussing business during their free time. But the TWO HOUR MEETING that occurred after the scheduled lunch period was “illegal” under the charter of the Democratic Party. It could ONLY have occurred had a vote for a recess been taken — and ALL votes have to be made IN PUBLIC.

Since I’m originally from Connecticut, I’ve been thinking about the Lamont/Lieberman contest throughout the entire primary process. I truly feel there is a chance (I haven’t studied the demographics, so it’s just a “gut” feeling based on being a long term resident of the state), that if Obama becomes the nominee, he could lose Connecticut to McCain (especially with Lieberman campaigning for him).

My guess is that many voters are more comfortable somewhere in the middle (moderate range, titling slightly left or right), value experience and feel more comfortable with candidates they are familiar with. Lamont’s anti-war stance wasn’t enough to get him elected, and I highly doubt if Obama’s anti-war speech will be enough to get him elected either.

Don’t rule out Obama losing NY, either. Besides it being Senator Clinton’s “home” state, much of the state outside NYC is highly conservative and afraid of Obama. Add to that the scars of 9-11 and Obama’s Hamas support, and you have a recipe for McCain here (although it would be much stronger for Clinton). Not to mention that most New Yorker’s don’t take too kindly to being pushed around and told how to vote.

The Clintons are the only Democrats that have taken the Upstate vote in quite some time.

All of the news reports talked about what a great job Obama did of “compromising” in this situation. Easy to “compromise” when you are being given votes and delegates you didn’t earn. This process has been such a farce. I have no problem with a fair race and with accepting if I lose that race but this presidential race between Obama and Hillary has not been fair from the beginning with the Democratic party deciding early on that Obama would be their dream nominee. It is disappointing, sad, desenfranchising and plain wrong! I will not be a “loyal” Democrat and vote for their messiah and have the will of the politicians, not the people shoved down my throat.

One of the members of the RBC bragging during the meeting that they told voters in the states being sanctioned that their votes would not count led me to believe the some members of the RBC were willing to brake the rules early on. The process of counting votes and certifying the primary election is not up to the RBC, but rather it is up to the laws of the individual states. The RBC rules only govern how delegates are selected from the votes, not if the voters do or do not count. The RBC had no right at all to tell anyone their vote would not count.

Aside from not applying the ‘fair reflection’ rule, it appears to me some members of the RBC were complicit in attempting to talk people into not voting in the first place.

But, of course, it was not just the RBC doing this. MSM, Kerry, Obama, and many other Obama supporters were also complicit in attempting to talk people into not voting in Florida and Michigan.

What the DNC’s RBC did on Saturday is a direct danger to our country in the same that the dictatorial aspirations of bush have been. Obama must be defeated in November if he is the nominee to stop this insanity. What they did is what the populations of China, Iraq, Iran, Russia would expect. THIS HAS TO BE STOPPED! My husband and I have left the Democratic Party as of yesterday and we will be voting for McCain, this is the only way the Democratic Elites will understand they are NOT THE WILL OF THE PEOPLE and this corruption MUST BE STOPPED.

Brilliant timing Bud White. I watched “Count the Vote” last night. I was struck by the similarities of this current situation as well To Bush v gore.

I started reading the dissenting opinion and ran across number of quotes by Dem’s back then who decried the courts decision and who have made 180 statements now. All Obama supporters and all hypocrites.

I feel I have been stripped of my freedom, and our democracy is in serious jeapardy with Donna Brazile and Howard Dean’s New Coalition.

I think the law is going to come up again regarding the seating of the Michigan delegates. I don’t think the DNC has jurisdiction over them. We have a category you vote for in Wa called “uncommitted”. Nobody can claim those delegates for themself, nobody can assign them to a candidate. Those delegates are uncommitted until the convention at which point they either remain uncommitted or they endorse somebody.

I seem to remember that Michigan also had the same election rules regarding uncommitted delegates.

This could get interesting, because it really is about state’s rights. States run their own elections, they make their rules. A higher court might be able to over rule them, but I don’t think the DNC has any authority or legal standing to assign uncommitted delegates to a particular candidate.

Hillary’s team suggested giving Obama all the uncommitted but leaving hers alone.

Before you all jump all over for me for my comments, please keep in mind that I am a moderate conservative who will probably be voting for McCain in November. However, I think it is perplexing that for people that seem to espouse the ideals of democracy, I only see hypocracy, ignorance, and downright bitterness within the comments on this blog.

First of all, to even begin comparing the RBC Meeting / decision with the 2000 election is starting on a false premise. THe RBC Committee was about how to seat renegade delegates while the 2000 case was about literally throwing away ballots and turning people away, and overturning the will of the people in a general election. THe rules of the U.S. Constitution apply in a general election, but the rules of the DNC apply in a primary. So this is not a case of civil rights, it is simply a process question that is up to the DNC RBC committee. In my mind that is a fairly easy concept to understand.

Representatives from both the Clinton and Obama camp voted for the Michigan compromise. The rationale behind the allocation was to offer ‘fair reflection’. Do you honestly think that giving delegates to Hillary (after the DNC claimed none would count) and giving zero to Obama is ‘fair reflection’? Over 30,000 people wrote in for Barack, not to mention the uncommitted ballots.

In my opinion, Michigan broke the rules and should have recieved zero delegates, but I understand the realities of the political situation. I think both of the decisions did represent a ‘fair’ reflection. You can moan and groan all you want, but arguing that this is a civil rights case is just pure ignorance of American voting history and disrepectful to those who have actually been disenfranchised.

One last point – to all those people out there who will vote for Hillary but not for Obama – I find that section of the population to be downright laughable. Their policies are so ridiculously similar that your grasping at straws to actually give credence to the idea that McCain would better represent you than Obama. (ie: abortion rights)

Attack me all you want, but I think if you take a step back and think about the state of the union, you will realize how petty you have become.

I’m not sure why you are presuming to understand my political background – but I will expand.

I said I was a moderate conservative, that is the truth. I voted for Bush twice b/c of economic concerns and foreign policy. For example, I think a homeowners bailout is ridiculous, I think global warming legislation is absurd and against our economic and political interests, and I think leaving in Iraq as soon as a President is elected is a mistake. However, I consider myself moderate because I am extremely liberal on social issues. For example, I am pro-choice, pro gay marriage, against the death penalty, etc.

Anyway, just thought I would clarify my political background and add that I am white, 24, and an American history and civics teacher.

Barack Obama appeals to my moderate side b/c I found him to be inspirational, symbolic, intelligent, and willing to talk to the American public like real people, and not ‘low information’ voters. (ie: gas tax pandering)I find his speeches to be inspirational, and while I understand that we need more than ’speeches’ in a President, I still don’t understand why people are still claiming that obama’s and Hillary’s policies aren’t similar. I just went on both their websites to confirm their stances, and yes, they are strikingly similar.

On one hand, we have two candidates who generally want universal healthcare (you can argue the details) but this drastically differs than McCain’s policy. Both want an exit from Iraq.

Please inform me about the major differences! The only one I can think of that is substative is the negotiating with foreign leaders of hostile nations, which I think needs a closer look at it anyway.

I actually didn’t realize that this blog only welcomed proHillary comments, I just stumbled upon this blog.

And as mentioned previously, it’s good for political parties to shed some dead weight once in a while, a healthy development that only hastens the party’s evolution. And let’s face it. I have been a “support the nominee” voter ever since my preferred candidates dropped out. I personally don’t see a ton of difference between Clinton and Obama.

What I can not fathom is the attitude that you want McCain to win if your preferred candidate can not be the nominee. That seems just sick and wrong to me.

And this is why they are given “individual voter” status — inviolate status. There are many reasons a person might vote that way… as yet undecided, preferring the other party’s candidate or platform, planning to vote in the convention for Obama, or for Edwards, Richardson or some yet unknown person, for that matter. Even, eventually for Hillary Clinton.

I’m furious about the RBC robbing Clinton of her votes, but would be just as mad if some blustering entity decided IT KNEW BETTER how my vote should be cast without my permission to take it from me!!! How could the RBC truly KNOW how I intended my uncommitted vote to eventually be cast???

Exactly. And, not only did they feel they had the ‘authority’ to strip the uncommitted voters of their constitutional rights, but that they could also determine, regardless and totally ignorant of, perhaps even AGAINST, those voters’ desires for whom their votes should be cast!

I might have even preferred they never allowed Michigan their votes, if it were only done, as is apparent, to award unearned votes to a candidate who purposely removed his name from the ballot. I mean… Hey! Why not give ME those votes? I did not choose to be on the ballot either!!

Two other points in my craw… It was not ONLY FOUR (4) votes taken from Hillary. It was EIGHT (8) !!! Obama getting 4 more (on top of the 55 others he also never earned) meant her lead was reduced from 18 to TEN (10)!!! And, if the uncommitted voters’ rights were observed, it might have been as high as *55* by convention time, if none of the uncommitted wanted to vote for Obama anymore by then. And THAT should have been their CHOICE!!

Lastly, something I’ve not seen mentioned yet, and that is about campaigning in the penalized States. As regards Michigan, Obama did in fact campaign there, along with a concerted, maybe even ‘joint’ effort with Edwards (and Richardson, too, I gather) to make up for their belated realization of bad judgment in taking their names off the ballot. A very large, wide-ranging campaign, by phone, print and the Internet, was waged to get their supporters to vote ‘uncommitted’ in hopes of just such a remedy as was afforded by the RBC’s biased and unscrupulous actions on May 31st. Weren’t all the candidates, on or off the ballot, told to NOT campaign in MI or FL under the DNC sanctions imposed on them for violating the DNC’s rules??? Maybe Hillary should have waged an ‘anti-uncommitted’ campaign; although, they’d have probably found some reason to drop the boom on her for that, too.

Shameful mess the DNC and RBC have created for our party. Shame, shame shame…
