FISA for Dummies

Senator Barbara Boxer stood proudly on the side of the people today. Her admonition on the Senate floor concerning this FISA abomination is a breath of fresh air.

Barbara Boxer Speaks to the Senate on Immunity, Law and Truth

At this point in time to give retroactive immunity kind of makes a mockery of the fact that we’re supposed to be a government of laws, not people. We are a government of laws. Do we then come back and say, “Oh, by the way, there’s three laws over here that we don’t really like, so we’re just going to say to the people that broke them it’s OK? ‘Cause we’ve looked at it and we think it’s OK?” This is America. We are a country of laws.

~snip~

Last week we celebrated the day we adopted the Declaration of Independence, Independence Day, July 4th. In that historic document is the following phrase: “That to secure these rights, governments are instituted among men deriving their just powers from the consent of the governed.” The consent of the governed. That means the law has to be behind you when you undertake to do something like this administration did. They didn’t care about the consent of the governed. They didn’t care about the law that was in place.

Since it seems likely that this bill will pass the Senate I find it important to describe what this bill does so that everyone knows. Because the outrage I might expect isn’t coming from anywhere significant.

Below are a few primers. Instructive and entertaining.

FISA Amendments Act Basics

1. The law retroactively legalizes a massive electronic operation to spy on the personal communications of millions of Americans – within the United States

2. The law allows physical searches of Americans’ homes and places of work without a search warrant or any other proof that anyone being spied upon is suspected of any crime at all

3. The law allows the same kind of unaccountable spying online and by telephone

4. Under the FISA Amendments Act, the only person with the ability to stop the spying is the same person who actually orders the spying to take place: The Attorney General of the United States.

Please enjoy this excellent video that will clear everything up.

67 days

And while you are at it, take a look at this call to arms.

Please Vote NO on FISA!

PUMAs won’t take this lying down. Just Say No Deal.

The folks on the right are celebrating losing their freedom as usual.

From the lgf:

“Today, Barack Obama is going to vote for the FISA bill he swore to filibuster when he needed the support of the far left.

The Senate is finally expected to wrap up the bill updating the Foreign Intelligence Surveillance Act today, which includes the controversial provision of retroactive immunity for telecom companies facing lawsuit. While the bill splits Democrats, it’s expected to pass with united Republican support.

Obama will be back for today’s vote and has said he’ll support final passage.

The voting starts approximately 11:15 am ET, and everything on FISA should be wrapped up by 12:30 pm ET or so.

The Daily Kos Kooks are already gearing up for a serious tantrum, of course: Daily Kos: F*** the Democrats!

F*** Reid, F*** Pelosi, F*** Hoyer, F***Rockefeller, and , yes, F*** Obama. F*** ‘em all!”

Those who fought and died for our freedom, died in vain .

Both parties should be disbanded.

Sen. Boxer doesn’t deserve the accolades. She’s influential among progressives, as we all know, but the woman sat on her hands throughout the primaries as Clinton was being bludgeoned to death by the media and the left. (And on June 4th she even swtiched teams and endorsed Obama.)

More importantly, Boxer sits on the Senate Commerce Committee, which oversees the F.C.C. and corporate ethics. In 2003 this committee under John McCain held a hearing on the radio boycott of the Dixie Chicks. So a few months ago, I spoke with Boxer’s office and later sent a three-page letter, asking that she push for a similar hearing on the 2008 election media bias, inviting the presidents of all the major broadcast networks, as well as Time and Newsweek. There are violations of anti-trust law and F.C.C. regulations, perhaps even a criminal conspiracy in the way Clinton has been piled on and Obama’s past (especially his connections to Iraqi agents) has been left unreported. When I heard nothing back from the senator, I started a campaign targetting the entire committee, which is still ongoing.

Now if Boxer had stood up for Clinton months ago and made this a different race in the eyes of progressives, Clinton would be seen as the leader of the party right now, not Obama, and this horrible capitulation to the Bush Admin would not have happened. For more on the Obama-Bush ties, here’s a new article.

I assume that this bill goes into effect right away which means that Bush can now legally do to Obama what eventually got Nixon impeached – wiretap him and his campaign looking for dirt to keep Republicans in power. That is where the real threat lies. The Bush administration has already shown its willingness to illegally use the power of the government to go after political opponents (just ask Don Seigelman). Now Democrats are making it legal for them to dig up dirt on themselves! How dumb can you get? They know that J Edgar Hoover used info he obtained from wiretapping presidents and other politicians to blackmail them. Why do they think they would be exempt from this kind of treatment? Or is the thought of wielding this power themselves just too tempting?
Putin must be impressed.

I think you need to take this thought process one step forward, particularly in regards to someone like Obama who has used his Gestapo-like internet denizens to his benefit, politically:

Some of the Democrats, like Obama, are making it legal to dig up dirt on THEIR opponents.

Don’t think it’s and “us” and “them” situation, because it is not. Obama is “them,” here. He has shown by his refusal to rein-in his ‘net thugs that he is very open to data mining-type operations for his own advancement.

The first thing I thought of when I heard that he was supporting FISA was just this. He is giving himself another possible tool, if he is elected, with which to try to enact his authoritarian consolidation of power.

This guy is dangerous. If he wins, get ready for the north-of-the-equator version of Hugo Chavez. That is, media outlets being shut down and opposition to him being made illegal.

I don’t know why people refuse to see this. He and his minions have already relocated the DNC and are openly talking about purges of the party and the establishment of shadow organizations for Democratic Party structures.

What does this guy have to do for people to wake up to what is going on? Does he need to fly flags with Che Guevera in his offices?

Oh wait, he already did that.

This is not about party, it is about our nation. I don’t care what anyone says about me, how they try to pigeonhole me or if people feel ‘odd’ to think about voting for a GOP candidate after having been Dems their whole lives:

If we don’t stop this guy then all of us will have to live with the consequences after the fact.

To repeat: It’s not about party, but country.

Barack Obama, his nutjob inner circle and his supporters like Jodie Evans hate this country and want to radically remake it. The ACORN gang, the Che lovers and Wright defenders are all part of this crew. The Xboxers don’t care, they just want to rebel against something.

I am not going to be led over a cliff because of a supposed fealty to party or a lockstepping antipathy to the other major party.

If it comes down to BaJoke vs McCain, I will donate to and campaign and vote for McCain without much of a second thought. I hope Hillary is nominated, but contingencies have to and are being made.

This is far too important an election for irrelevant categorizations to hold any of us back from doing what we must. Opting out is not, IMO, a viable option. We must actively reject this man, Barack Obama, or else live with his election.

I know many won’t move on this until after August, which makes total sense. I will also be working to get Hillary nominated during that time.

But if and when the time comes, please, do what needs to be done. For the good of our party and who is running it and how it is being run, he must be stopped.

NObama. Not now, not ever.

Period.

I need to find a more thorough explanation of this bill. The video on this post says, “anybody anytime.” If that’s true, that would include our representatives and senators. I find it hard to believe that they would authorize a total abdication of their own rights…maybe their constituents’, but not including themselves.

I’ll bet they the Prez could find a LOT of good stuff on a LOT of them, including Obama, of course, if they have been foolish enough to give away their own rights along with everyone elses.

IF WE DO NOT WANT ANOTHER SEPT 11TH ATTACK AND A PRESIDENT WHO WILL NOT ATTACK WE MUST NEVER GIVE OUR VOTE TO OBAMA!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

A Barack Obama presidency would spell danger for the Middle East and for America’s interests in the region, former U.S. Ambassador to the United Nations John Bolton told WND in an interview. Obama will not support the use of force to fight terrorism by U.S. allies, such as Israel Ahmed Yousuf, Hamas’ chief political adviser in the Gaza Strip, said he “hopes” Obama becomes president.

The FISA related voting today was in regard to three separate amendments to the FISA act.

From the Hartford Courant today:
(begin quote)Dodd Anti-Immunity FISA Amendment Shot Down
By Jesse A. Hamilton on July 9, 2008 11:58 AM | Permalink | Comments (7)
The amendment that Sen. Chris Dodd has been pushing to strip lawsuit immunity from an update to the Foreign Intelligence Surveillance Act was — as expected — trounced in a Senate vote this afternoon. It pulled in 32 votes against 66 in opposition.

In a post-9/11 anti-terrorism program, the federal government sought and received the cooperation of telecommunications companies in tapping the communications of its customers without warrants. Dodd — sharing his amendment with Sen. Russ Feingold, D-Wis. — thinks the customers should have a right to sue those companies

Sen. Joe Lieberman, who has been on the opposite side from Dodd on this issue, was among those cast votes against Dodd’s amendment.

The FISA bill — an update to the 30-year-old surveillance act — is expected to speed quickly toward passage.(end quote)
———- and —–
from the Washington Independent today
(begin quote) FISA Amendments Flail and Die
By MIKE LILLIS 07/09/2008 02:57PM
The Senate has postponed a vote on its eavesdropping bill while lawmakers enjoy a short luncheon, but the chamber did already get around to killing the three amendments that would have held the phone companies into account for any illegal acts they may have committed under the Bush administration’s warrantless wiretapping program. A quick run-down:

The Christopher Dodd amendment, which would remove telecom immunity altogether, fell 66 to 32.

The Arlen Specter amendment, which would have the courts determine the constitutionality of the wiretapping program before immunity could be granted, fell 61 to 37.

And the Jeff Bingaman amendment, which would delay immunity until an investigation into the program was complete, fell 42 to 56.

Sen. Barack Obama (D-Ill.) was in town and supported all three. Sen. John McCain (R-Ariz.) is on the road. Final vote to follow within the hour. That popping noise you hear is the folks at AT&T enjoying a champagne shower.(end quote)

Had these amendments passed, it would be possible/easier to sue the telecom companies who cooperated under FISA. With the failure of these amendments (the nays outnumbered the yeas), bringing suit against the telecom companies is not possible. (If I understand this correctly, I would have wanted my representative to vote “yes” (i.e. yes, you can sue the telecoms, we strip them of immunity) on all 3 amendments. However, the big vote, on the FISA compromise (recently passed in the House) is yet to come. Please, anybody, clarify if I have posted wrongly here and thanks.

Comment by ginaswo still says no to Uhhbama | 2008-07-09 14:23:39

no, a yes vote on the AMENDS was to take away immunity
on the final bill when the amends failed a YES was to give immunity and keep the program

Uhhbama voted for that, Hillary said NO

I will be sure to think of that the next time I am sending half of my 1st and the 15th check home to help out my aunt who raised me.

These people have no idea that there are people out there struggling to get by.

They want us to be divided so Obama can lose, so McCain can win. Why do you think there was 44 presidents and they were all White. It is our time, Obama is carrying all blacks on his back not only African Americans. Read more on youtube, they are still saying that we are inferior.Let Obama be please. They are all against him. We do not need to be also against him. Only good can come out of it for you and I. We need to get our pride back after slavery. Remember 50 years ago McCain’s father would not let your grandfather drink in the same fountain as him.50 years ago McCain mother made your grandmother sit in the back of the bus,50 years ago your mother couldn’t be in the same school as Cindy McCain. If Obama hadn’t played racial politics and ran on more substance, I would have voted for him. He goes out of his way to attack women in particular, if we can judge from his career. He plays dirty, though. The sexism his campaign indulged in and his smears against the Clintons – because it was the only way he could win. He needed crooked investors and media support. I don’t expect perfection from politicians or the world itself, but I respect decency more than ambition. Somehow, McCain has taken risks and stood firm on his beliefs, many of which I disagree on. I feel he should be rewarded with my vote. It’s too bad Hillary Clinton appears out, because she was the most qualified of all the candidates. Her vote today shows she is principled and the real progressive.

Comment by terri | 2008-07-09 13:50:24

If you think Obama is going to address your grievances, think again. This country will never have a just, humane, equal society as long special groups in the society keep working to get dominance over everyone else. LBJ put programs in place that more than make up for slavery, but lots of blacks don’t want to live a productive middle-class life. It’s not enough to more opportunity given to them than any other group in society. They’re like the evangelical christians. They want total power, dominance and everyone else in slavery making money to hand to them. Ain’t going to happen.

The US government has been trying to makes amends with our black population for years, but their demands just never stop. As a white American, I want all Americans to be successful because it bodes well for the country if EVERYONE partakes in its success. At the same time, I want America’s minorities to step to the plate and strive to better their lot by taking advantage of what America offers to ALL of its citizens. Ed Schultz is devoting at least part of his radio show today indulging in his favorite sport, pointlessly bashing the Clintons and alienating their supporters:

“How much longer can Hillary keep this up? Does she really expect Barack to BEG for her help? How much more can she push this? Pretty soon she’ll find the train has left without her. What IS IT with the Clintons?”

Guest: “Well, their agenda has never been the party’s…”

Schultz: “And THATS THE PROBLEM. STOP RIGHT THERE. Hillary needs to just stop this and get on board, no one want to listen to any more of this, how much more is this going to take…”

I wonder: Does Schultz really want Obama to win in November? Because I swear, every time he opens his mouth he loses his candidate thousands of votes.

Comment by wodiej | 2008-07-09 14:01:03

Well FUCK HIM THEN. Hillary and Bill should just tell them all to kiss their asses and leave and we’ll see how far asswipe and his nitwit supporters get then.

Comment by Hope | 2008-07-09 14:32:32

Exactly, there will be no time in this election or any of the future in which the Dem party will back her as they have Obamination. She would have to run under another party. It is a horrible moment to realize we have been denied such a gracious, knowledgeable, compassionate, and productive President. Ahead of her time, the party doesn’t deserve her, but we sure do!

Comment by terri | 2008-07-09 13:44:46

We stopped being a nation of laws when both parties decided it was okay for people to cross our borders illegally. There’s no justification for this unlawful act. If people in other countries need help, our government should do all that is possible to help them. If our businesses need more labor, Congress should raise the quotas on immigration. Breaking the law is a bad policy that will lead to exponentially worse policies.

But that’s the new America in the 21st century.

Comment by wodiej | 2008-07-09 13:59:49

another issue that really angers me. We should be helping reform Mexico’s corrupt government not allowing people to break the law by crossing our borders. I’m all for helping people but we can’t help every single person in the world. It goes back to the accountability issue and welfare. I believe part of the problem is people know they can come here and get tons of freebies.

Comment by AnninCa | 2008-07-09 14:16:00

We won’t be on the same side on this issue. LOL*

Sorry, but I am from So. Cal. and there have been tons of research that shows that the immigrants pay far more in taxes than they take out from benefits paid.

Our flipping economy rests on the backs of those folks. Is it right? No. But that’s a reality right now, anyway.

Comment by Hope | 2008-07-09 14:33:34

Then why not acquire legal citizenship?

Comment by AnninCa | 2008-07-09 15:19:30

Heck, does anyone get through the legal process these days? Something like 9 years on a list and then get turned down in the end.

It’s not an option right now anyway.

Comment by wodiej | 2008-07-09 14:45:03

nope, they absorb much more benefits than they pay for. If they didn’t they wouldn’t be able to survive on the wages they make. If you add in the free medical care they get and the free education for their children, they are getting much more than they pay for.

*yippee!*

I never expected to agree with Hillary 100% on all matters, but this one was a biggee to me. This is absolutely unjustified, and Pelosi should go down in flames for supporting it.

Schultz doesn’t seem to understand that when he says “they need to stop whining, they need to grow up, they need to get on board and stop this nonsense” he may mean “The Clintons,” but we HEAR “Clinton’s supporters.” That means ME- and I don’t appreciate some overpaid faux-Progressive (he spent an hour this winter bitching that his $3900 business class flight t to Fargo was delayed- yeah you’re a Real Man of the People, big Eddie) radio hack telling me to “get over it” and “get on board.”

In fact, all Schultz does is make Obama and his ilk more repellent to me. I’m sick of being talked to like I’m a fricking POW who needs to admit defeat and play nice. I have another option, and I’m taking it. My vote is going to McCain.

Eat that, “Big Eddie.”

Comment by Hope Floats | 2008-07-09 14:33:56

McCain didn’t play nice. They tortured him until his body was broken. He stayed in the camp longer than he had to, making sure other prisoners were released. I hate to even bring it up, but just wanted to say being a POW is not just doing what you’re told. I say that, because as someone from a very abusive home, I know what it’s like to be a prisoner. Not anything close to what McCain endured, but it’s a horrible experience.

Comment by John | 2008-07-09 14:12:57

Right- Obama isn’t the innocent receiver of the media’s largesse. He fed talking points to them and was a willing and eager partner in their vicious character assassination of Senator Clinton and her husband.

Air Obama Radio stuck a thousand needles of spite into Hillary while holding up Obama as a paragon of virtue unprecedented in American politics, and Obama sent paid spokespeople to appear on that station to spread the gospel.

Sorry, but “hey, don’t blame Obama he was just a bystander” isn’t going to fly here.

Comment by Alice Paul | 2008-07-09 14:34:15

I was wondering why this would suddenly come up (Jon Benet,God rest her soul).

They will do anything to not report serious news.

Could someone give me the low down I don’t have time to read everything, did they pass the FISA bill or not. Is it good for us or bad?

Comment by AnninCa | 2008-07-09 14:39:13

FISA allows the government to sidestep the judicial process to prove probable cause and get a warrant to tap into an individual’s phone, internet, etc. In the past, the telecom industry could be prosecuted for going along with taps that did not have a warrant. Now, there will be no reason the telecoms can state to hold off government intrusion.

It’s a bad law. It’s being passed on the basis of fear of the terrorists, but there is not a good reason in reality to circumvent the constitution.

I believe it should be challenged in the courts now and let the courts kick it to the curb.

It’s a violation of our constitutional rights.

CNN will be spinning this for Obama shortly.

Air America and all of the liberal radio stations will tell us how this is for national security. They’ll tell us that Obama isn’t really for it but is pretending to be to get elected. So Obama is doing whatever it takes to get elected. I thought that was a bad thing.

The same groups that screamed about it all this time are now for it. So how are they different from Republicans? So why shouldn’t someone vote for McCain? He was for FISA.

From the Los Angeles Times
Stop the new FISA
Allowing the new surveillance law to stand would seriously cripple our free press.
By Chris Hedges

July 11, 2008

If the sweeping surveillance law signed by President Bush on Thursday — giving the U.S. government nearly unchecked authority to eavesdrop on the phone calls and e-mails of innocent Americans — is allowed to stand, we will have eroded one of the most important bulwarks to a free press and an open society.

The new FISA Amendments Act nearly eviscerates oversight of government surveillance. It allows the Foreign Intelligence Surveillance Court to review only general procedures for spying rather than individual warrants. The court will not be told specifics about who will be wiretapped, which means the law provides woefully inadequate safeguards to protect innocent people whose communications are caught up in the government’s dragnet surveillance program.

The law, passed under the guise of national security, ostensibly targets people outside the country. There is no question, however, that it will ensnare many communications between Americans and those overseas. Those communications can be stored indefinitely and disseminated, not just to the U.S. government but to other governments.

This law will cripple the work of those of us who as reporters communicate regularly with people overseas, especially those in the Middle East. It will intimidate dissidents, human rights activists and courageous officials who seek to expose the lies of our government or governments allied with ours. It will hang like the sword of Damocles over all who dare to defy the official versions of events. It leaves open the possibility of retribution and invites the potential for abuse by those whose concern is not with national security but with the consolidation of their own power.
