Statement of Senator Hillary Rodham Clinton on the FISA Amendments Act of 2008

Statement of Senator Hillary Rodham Clinton

on the FISA Amendments Act of 2008

One of the great challenges before us as a nation is remaining steadfast in our fight against terrorism while preserving our commitment to the rule of law and individual liberty. As a senator from New York on September 11, I understand the importance of taking any and all necessary steps to protect our nation from those who would do us harm. I believe strongly that we must modernize our surveillance laws in order to provide intelligence professionals the tools needed to fight terrorism and make our country more secure. However, any surveillance program must contain safeguards to protect the rights of Americans against abuse, and to preserve clear lines of oversight and accountability over this administration. I applaud the efforts of my colleagues who negotiated this legislation, and I respect my colleagues who reached a different conclusion on today’s vote. I do so because this is a difficult issue. Nonetheless, I could not vote for the legislation in its current form.

The legislation would overhaul the law that governs the administration’s surveillance activities. Some of the legislation’s provisions place guidelines and restrictions on the operational details of the surveillance activities, others increase judicial and legislative oversight of those activities, and still others relate to immunity for telecommunications companies that participated in the administration’s surveillance activities.

While this legislation does strengthen oversight of the administration’s surveillance activities over previous drafts, in many respects, the oversight in the bill continues to come up short. For instance, while the bill nominally calls for increased oversight by the FISA Court, its ability to serve as a meaningful check on the President’s power is debatable. The clearest example of this is the limited power given to the FISA Court to review the government’s targeting and minimization procedures.

But the legislation has other significant shortcomings. The legislation makes no meaningful change to the immunity provisions. There is little disagreement that the legislation effectively grants retroactive immunity to the telecommunications companies. In my judgment, immunity under these circumstances has the practical effect of shutting down a critical avenue for holding the administration accountable for its conduct. It is precisely why I have supported efforts in the Senate to strip the bill of these provisions, both today and during previous debates on this subject. Unfortunately, these efforts have been unsuccessful.

What is more, even as we considered this legislation, the administration refused to allow the overwhelming majority of Senators to examine the warrantless wiretapping program. This made it exceedingly difficult for those Senators who are not on the Intelligence and Judiciary Committees to assess the need for the operational details of the legislation, and whether greater protections are necessary. The same can be said for an assessment of the telecom immunity provisions. On an issue of such tremendous importance to our citizens – and in particular to New Yorkers – all Senators should have been entitled to receive briefings that would have enabled them to make an informed decision about the merits of this legislation. I cannot support this legislation when we know neither the nature of the surveillance activities authorized nor the role played by telecommunications companies granted immunity.

Congress must vigorously check and balance the president even in the face of dangerous enemies and at a time of war. That is what sets us apart. And that is what is vital to ensuring that any tool designed to protect us is used – and used within the law – for that purpose and that purpose alone. I believe my responsibility requires that I vote against this compromise, and I will continue to pursue reforms that will improve our ability to collect intelligence in our efforts to combat terror and to oversee that authority in Congress.

And if there was ever a year to run as an Indpendent, it’s this year. If you’re not on the ballot in November, the planet loses, the federal government will go broke, and there won’t be any Congress by 2012. I’m here in California and everyday we’re just smoking and burning. You said you were going to fix all this in your campaign speeches. You had great ideas. Regardless of whether Hillary had any ulterior motives for this (and she was for this before she was against it) it does not matter. She voted the right way. Obama, although explaining how he would vote last week, did not. I do not accept the explanation. This is bad law and hopefully the Suprement Court will strike it out.

Retrospective legislation can never be right in a democracy.

Sod the TelCo sponsorship, it is not needed.

Sod fearing that the likes of the Repugs and the fronts they run. Voting for this will not stop them saying Dems are soft on terror. So instead they should have fought back. Repugs are wrong on the Constitution. To paraphrase, do not trade liberty for security or you will lose both

Rep. Jesse L. Jackson, Jr., D-Ill. just released the following statement as a reaction to the crude and disparaging remarks his father — the Rev. Jesse Jackson Sr.

Says Jackson JUNIOR in a statement: “I’m deeply outraged and disappointed in Reverend Jackson’s reckless statements about Senator Barack Obama. His divisive and demeaning comments about the presumptive Democratic nominee — and I believe the next president of the United States — contradict his inspiring and courageous career. Instead of tearing others down, Barack Obama wants to build the country up and bring people together so that we can move forward, together — as one nation. The remarks like those uttered on Fox by Revered Jackson do not advance the campaign’s cause of building a more perfect Union.”

Concludes Rep. Jackson, Jr.: “Revered Jackson is my dad and I’ll always love him. He should know how hard that I’ve worked for the last year and a half as a national co-chair of Barack Obama’s presidential campaign. So, I thoroughly reject and repudiate his ugly rhetoric. He should keep hope alive and any personal attacks and insults to himself.”

Thank you Senator Clinton — I did not realize that the bush administration has still not given details to the Senators and that most were voting blind — not knowing exactly what they were approving.

Hannity intimated that Jackson says he wants to “rip Obama’s nuts off” on the tape. Hannity would not say “nuts,” but based on his description (portion of the male anatomy beginning with an “n”) I believe that’s the word he was going for.

What people dont realize is that there are those that treat people real crappy when they naturally “assume” you are voting for Obama because your black.The MSM has us painted as blind sheep playing follow the leader. No one never looks at it the other way around in the media on how it actually affects the community. Senator Obama has set race relations back and it will be a while before anyone feel comfortable with other AAs running in high positions because they will remember how an entire primary was won by using “your racist” as strategy to the extent the pundits and commentators began calling entire STATES racist because they didnt vote for him.

I am in Oregon also and most of my family voted for Barry. We rarely talk any more and never about politics. I used to chat with my sister all the time but now it feels too unsafe. I don’t think that many/any of them have even acknowledged the misogynistic/sexist behavior of the media and the DNC. If Hillary doesn’t get the nomination in Denver I hope Oregon will go for McCain, but who knows. My county had the highest vote for Barry in the state and that’s really disgusting and scary to me. Dodd wants to thank all those who fought the bill. And they fought the bill for one reason - They love their country.

So, what does that say about Obama, who Dodd supports, and who voted FOR the bill?

I read comments on here how people felt he would be refacing Mt Rushmore if elected. But I disagree, that’s not NEARLY grand enough for the messiah. I think he’d want to carve out his image on the surface of the moon. That way he could look down on ALL the world, AND moon us at the same time!

I’m just astounded that Obama voted yes for this bill. I just can’t believe he would do something like that. And I say this as a Hillary supporter who will vote for McCain if Obama gets the nomination.

I know Obama is a two-faced panderer, liar, and hypocrite who can’t be trusted, but this is just unbelievable. Does he not know how much this disappoints his core supporters? Does this know the kind of outrage it could cause in true Democrats? Does he just want to pander to the Bush-crowd so badly that he no longer cares about check and balances? I just didn’t think even someone like Obama could sell out the people who love him the most like this.

I’m so glad I’m not an Obama supporter, because I’d be going through a crisis. I’m happy Hillary did the right thing.

He is now pandering for the independent voters, but they are a different type of voter. They don’t like the flip-flopping that is going on. He won’t be able to win many of them over, that I guarantee. He is burying himself and our party at the same time.

Sadly, the CBS Evening News minimized this FISA vote, not even calling it FISA but “Warrantless Wiretapping” and putting it at :22 minutes into the broadcast. They did not saying how the candidates voted. Katie & crew disappoint me on this one

CBS did highlight BO escorting Ted Kennedy on the floor for the Medicare bill vote. No camera pan on Hillary.

I don’t get how the Obamabots can rationalize this one, except for their cult-following, knee-jerk support reactions.

Before you can do anything as president, you must first be elected president. That doesn’t require that you compromise your most basic principles, but it does require that you modifying your rhetoric toward the center ground. It can also require that you vote strategically during the final months of a presidential campaign, so as to avoid committing political suicide.

I wasn’t attempting to “undermine” Hillary Clinton with that comment. My point was only that with Obama as the presumptive candidate, Senator Clinton is freer from worry that a vote entirely consistant with principle will be used against her as a weapon in the perceptual battle for the presidency.

A “NAY” on FISA would have been used against Obama by the right in exactly that fashion. The right loves to play the fear card. They know it’s especially effective with the voters. Bush’s selling of the war, his second-term election, and the empowerment of his presidency has relied almost entirely upon the utilization of fear tactics.

But you know the right is wrong. You know that this bill would give the president and the telecoms too much power. By not standing up against it, Obama is perpetuating the right’s ability to use the fear card in addition to compromising democratic principles. By voting for this, Obama enables the right to have it both ways.

By your logic it is okay for a presumptive nominee to do anything to get elected, including not keeping his words, as long as the candidate belongs to the right party. When you let a candidate manipulate you like that, there is no telling what else you would allow him to do once he is in office. Your excuse would then change to the necessity to keep a Democrat in power. What else would he compromise to stay in office?

I don’t know… I used to be an idealist. Now I like to think that I’m a pragmatist, rather than a person who’s simply lowered his standards.

I’ve occasionally wondered if what people must be willing to do to become president might not weed out everyone actually fit to be president. Can anyone successfully climb that ladder, and still be morally whole when they reach the top?

That’s not a question we’d want to dwell on for too long, but it’s probably reasonable to say that all candidates are likely flawed in some fashion. Most here focus on Obama’s presumed flaws. I focus on his presumed virtues. When I’m not defending the guy against attack, I’ll readily admit there are some things about him I don’t like; I didn’t like his vote on FISA, for example. I don’t like this attitude about illegal immigration. (Or Bush’s or Clinton’s or McCain’s, either.) But when I compare Obama’s votes and policies with McCain’s votes and policies, the list of what I don’t like about John McCain is far longer.

Hillary Clinton simply doen’t enter into the debate for me at this point. Unfortunately.

I understand your point. I am not an idealist either, but I do like to hold a candidate accountable for what he or she says. Obama just doesn’t pass that accountability test, because he does not care what his supporters think.

I don’t think it’s as easy as making a list. How do you even know that Obama’s virtues will be consistent? So far a lot he has backtracked on a lot of things. Right now it seems that the list of flip-flops will only be longer. The more important question is: How do you know you can trust him?

Have no one watch it. No one. Demolish the ratings. Get someone from Hollywood to put on some other show the same night that will draw in viewers. Anthing but the convention. 18 million people voted for Hillary. She accumulated a mass of delegates. And now we are concerned about “embarrassing Obama?”. Who is to say he was the front runner anyway? Hillary had both the popular vote and the electoral vote. Shame on the DNC. Shame on America.

It should come as no surprise to Senator Barack Obama that his vote today in favor of expanding the Foreign Intelligence Surveillance Act is drawing cries of outrage from many corners of the liberal blogosphere. After all, the senator’s own campaign Web site had become a focal point for his supporters to express their displeasure with Mr. Obama’s stance on the bill.

That was the case again today. Carl from Ft. Worth, Texas, posted a message on Mr. Obama’s Web site this afternoon. The subject line read: “Obama just lost my vote.” He continued:

“I am disgusted. Obama will NOT receive my vote in November, regardless of whether it means McCain wins (at least HE’S being honest with us). Once again, Dems picked the wrong guy in the primaries. Time to leave the party I guess.”

Other comments struck much the same theme. Patrick in Chicago wrote “Can I get my money back this candidate appears to be defective” and Christopher from San Francisco put it simply “Senator Obama, you fail.”

Ouch.

(Recall that Mr. Obama tried to calm his critics last week with a statement on his site emphasizing that his position on the surveillance plan, “…was not an easy call.”)

Armando Llorens, who blogs under the name Big Tent Democrat, at TalkLeft.com took issue with the comments Mr. Obama made yesterday saying that his support for the bill was not politically motivated, but rather represents a genuine policy disagreement with more liberal elements of the Democratic Party:

“I do not believe Barack Obama. I will go further. I do not want to believe him. Because the alternative is worse. Because if Obama believes the BS he said about the FISA Capitulation bill, then he is not fit to be President. If Barack Obama really believes this about the FISA Capitulation bill, then he is as dangerous as George W. Bush.”

Does Terry McAuliffe speak officially for Senator Hillary Rodham Clinton these days, if she’s suspended her campaign.

I hope to God he does not! And yet, I understand there’s a lot of negotiations going on to try to get HRC’s Primary Campaign debt reduced.

Getting her name on the first ballot is our only hope, and her main bargaining tool. Makes no sense to all of the people who worked hard in the primaries and caucuses to become a pledged delegate for her.

I heard about half of HRC’s debt has been paid down in recent weeks, and with a bit of effort, the rest could be paid off (by supporters) in a couple of weeks. Pray she is not beholden to BO.

He said last week he might “refine” his Iraq policies after traveling to the Middle East this summer, though he later insisted he was not talking about changing his stated plan to remove all U.S. brigades from Iraq within 16 months of taking office.

The McCain campaign on Tuesday released a list of 17 alleged flip-flops.

Will Obama even make it to August? It’s not surprising that he voted yea, he is pandering to the right in hopes of garnering votes from the republican party. Same deal with the language comment. See how wonderfully he plays with others?
This is all an attempt to make the general election look like a personality contest. Something like the primary race.
Only one problem here, how can you believe what he’s saying now?
Actually it’s the biggest problem Barack has, he’s a liar. Old saying, “a thief is a liar and a liar is a cheat”. Was taught this long ago in childhood. The point was never be a liar because then you are all three! Guess this was a lesson Barack didn’t learn growing up in the heartland. Pity.

Did anyone see Feingold on MSNBC. I’ve never seen so much double talk in all my life.

On one hand he said it was terrible that they passed the FISA bill (he did not vote for it) today and that people have a right to be disappointed but when a Democrat(Obama)gets into the White House they can work to change it. Only problem as we all know Obama voted for it.

Am I missing something. Maybe they’re all speaking Spanish so I don’t understand this type of language!

I think if we try hard enough we can drive a lot of Obama supporters insane. I see the losers he has begging for money on the streets and they are all a hop skip and a jump from the nut house. At a minimum you can get them all riled up if you go up to them and then criticize Obama.

FISA is a complete non-issue. The government has had the legal ability to monitor all foreign communications since at least 1947. Foreign communications have always been defined as a communication where at least one of the communicants is outside the U.S. or believed to be an agent of a foreign power, regardless of location. FISA works and protects our privacy. All the Hillary nut-jobs need to relax. Your e-mail’s and text messages are way to pointless for the government to care about.

Uh, hold on. I don’t agree it’s “a complete non-issue”. While FISA has been around since the days of Jimmy Carter, the big issue at present is how Bush may have been using it illegally without oversight or meaningful checks and balances, and to what extent letting him get away with it will establish precendents for improper future use. Granting retroactive immunity to the telecom industry without even knowing what actions you’re granting them immunity for is very disturbing. If Bush did something illegal–and granting that if probably requires a tremendous stretch–and private corporations were knowing accomplices, they ought to be held accountable.

I’m not so quick to make light of government e mail and internet monitoring. There are plenty of indications that this may now be almost universal. My own assumption is that all activity and all messages are now being rerouted through NSA supercomputers for analysis and data mining. If you don’t believe that, you haven’t been paying attention. Bush has apparently issued classified presidential directives along those lines that members of congressional oversight committees don’t even have access to. All that is known about them are their general topics.

I guess we’re just supposed to forget the law and the Constitution and just keep repeating this mantra over and over to ourselves: If I’ve done nothing wrong, I have nothing to fear.
