Barack’s Legal Backlash [Updated Twice]

Jane Mayer’s book, The Dark Side: The Inside Story of How The War on Terror Turned into a War on American Ideals [UPDATE 11/23/08: SCREENSHOTS BELOW OF THREE FULL PAGES FROM Ms. MAYER'S BOOK], is must reading for the Obama team and anyone else who wants to understand the legal mayhem created by George W. Bush and company since 9-11. When Barack Obama’s team takes over on 20 January they are going to be dealing with a serious case of legal shock. What do I mean? The Bush Administration has been the most anti-lawyer administration in the history of the United States. Look at the folks who held the top slots, particularly in the first term, who were not lawyers and had no formal legal training:
George Bush
Dick Cheney
George Tenet
Colin Powell
Don Rumsfeld
Paul Wolfowitz
Condi Rice
So what? The Bush Administration has pursued a variety of policies that cause most legal scholars to recoil in horror. There are some highly classified, compartmented programs instituted by the Bush Administration that, when examined by lawyers with more mainstream sensibilities, will likely be terminated. It is no surprise that an Administration so openly hostile to the law would adopt policies and engage in practices that have skirted the law and, in some cases, broken the law. It is quite clear that President Bush and Vice President Cheney treated international law and international treaties as some sort of meaningless bureaucratic burden. And they surrounded themselves with lawyers who enabled their behavior with farfetched, extreme interpretations of what was and was not legal.
Look at the list of folks they relied on for legal judgments. David Addington, Alberto Gonzales, John Yoo, and Doug Feith. Feith, described by General Tommy Franks, as not terribly bright (he used more colorful language to disparage Feith) played a critical role in persuading the non-lawyers that there was no legal obstacle to using torture and violating the Geneva Conventions. Vanity Fair put out an excellent article on this in May:
The abuse, rising to the level of torture, of those captured and detained in the war on terror is a defining feature of the presidency of George W. Bush. Its military beginnings, however, lie not in Abu Ghraib, as is commonly thought, or in the “rendition” of prisoners to other countries for questioning, but in the treatment of the very first prisoners at Guantánamo. Starting in late 2002 a detainee bearing the number 063 was tortured over a period of more than seven weeks. In his story lies the answer to a crucial question: How was the decision made to let the U.S. military start using coercive interrogations at Guantánamo?
The Bush administration has always taken refuge behind a “trickle up” explanation: that is, the decision was generated by military commanders and interrogators on the ground. This explanation is false. The origins lie in actions taken at the very highest levels of the administration—by some of the most senior personal advisers to the president, the vice president, and the secretary of defense. At the heart of the matter stand several political appointees—lawyers—who, it can be argued, broke their ethical codes of conduct and took themselves into a zone of international criminality, where formal investigation is now a very real option. This is the story of how the torture at Guantánamo began, and how it spread.
Conservatives traditionally rail against liberals for supporting “judicial” activism. Ironically, it is conservative lawyers in the Bush Administration who have themselves engaged in a vile form of judicial activism. They have encourage and justified policies and practices that, once fully exposed to the light of day, will be a permanent stain on the honor and integrity of this country. This is not the first time that politicians have ignored the Constitution and engaged in illegal activities. Democratic icon Earl Warren helped imprison in concentration camps American citizens of Japanese heritage.
I am hoping that Barack Obama and his team will recoil in horror at the attack on international and constitutional law carried out by the Bush team as they finally get a look at the “books.” Issues such as FISA, habeus corpus, and Guantanamo are the tip of a very large and dirty legal iceberg. Don’t be surprised when the media turns on Obama and circulates the story that he is jeopardizing our nation’s security by insisting that we abide by the rule of law. I frankly do not know if Obama has the courage to take this issue on. What do you think?

Obama’s was also adopted by a foreigner in a foreign country and his legal name is Barry Soetoro, as registered as an Indonesian citizen, where as Indonesia does NOT allow dual citizenship.
Obama’s adoption is a bigger disqualification as it also leads to what passport did he use to travel to Pakistan with in the 80’s.
Pakistan was closed to US travelers.

Obama has also failed/refused to release any records pertaining to school, college, medical.

I agree that Obama is not an honest man. His surrogates are not honest people. That said, I am getting off the “hope Obama fails miserably” train because the country is too critical to endure another failed administration. I just hope Hillary totally outshines him and becomes our next POTUS.

This is one of the principle reasons I voted for a third Republican term. Obama promised he would not vote for any FISA bill which granted immunity to telecom companies and would support a filibuster of the bill. Your admission that his vote was politically motivated tells me all I need to know about him and you for excusing it. McCain voted for the bill also, but he never said he wouldn’t.
Do you know what FISA is and the reason it was established? If you do, you are the first bot I’ve come across who does. It protects one of the most important rights in the Bill Of Rights. I am not entirely sure what has been pointed out here that is of such tragic nature unless you take Vanity Fair as a legitimate, unbiased new source (even though there are, again, no specifics). Again, if the behavior of the Bush admin. is a shredding of the constitution, illegal, criminal, etc. then the great icon of liberalism, FDR, is a criminal of unparalleled proportions. While the patriot act allows US to listen in on citizens phone calls, FDR imprisoned them in relocation camps. FDR charged many citizens with “unAmerican activities”, censored every new article print or broadcast and maintained an office of propoganda, attepted to pack the Supreme Court.
I will never take these charges of “constitution shredding” against the Bush admin seriously unless they are accompanied by a caveat to the effect of “no president since FDR has had such contempt for constitutional law, blah, blah blah”. When I look at this in a historical perspective it all looks pretty tame by comparison and unless you acknowledge the abuses of FDR it just looks partisan.

I share her concern. But this is what I pointed out, and please bear with me I will demonstrate some relevance to your point of this thread:
My point is somewhat tangential to yours but related: You are talking about some questionable legal decisions made by non-lawyers, and I presume these were justified by some actual lawyers using some pretty hefty legal mental gymnastics. My point is, these were decisions many in the right wing did not question, because it made us “safer.” Damn the consequences to our liberty, just as damn the consequecnes to our liberty when some in the left are calling for censorship under the guise of “fairness.”
The left was outraged at Bush for threatening our liberty, and now the left threatens our liberty in-kind as perhaps retribution even. The right threatened our liberty for “safety” (out of and using fear) and now they are complaining about the left. I think I am on to something major here that was maybe just too obvious to be noticed: we are on a treadmill and need to jump off to see we are going circular nowhere real fast. I hope others in the pragmatic sensible balanced middle will run with this.
It’s simple, I think: both sides want to cheat to their own advantage, so neither is willing to undo the circumstances that led to being able to cheat, even if it means that the opposition might sometimes cheat more effectively and get the upper hand. Bush et al cheated by ignoring laws and convoluted interpretations, the UnOne et al cheated by exploiting loopholes. If the Repubs could have exploited the nominating process to get the weak candidate, they would have (maybe they did). None of them is going to set this situation straight when they see legal tricks as a possible advantage. Remember it’s an ongoing game, there’s always another election.

My greatest hope is that some day in the next ten years we can stop talking about Bush every time Fraudbama’s name comes up. All I know is this…whatever happened in the past is past. Now, if we take all the advice here, it’s time to move forward. All I have seen throughout the Fraudbama campaign is continual threats to personal rights and freedoms. Please stop saying “well Bush did it, so we can.” That logic doesn’t fly. My concern about the Fairness Doctrine, and the way I understand the left will interpret and “stretch” it, has nothing to do with Bush, Cheney, Condi, etc. They’re not in this mix. Dawnelle, history isn’t disconnected points on a line which have no relationshiip to cause and effect. It is an infinite series of events each leading to the next. The Bush presidency will not end when he walks out of the White House for the last time any more than the Lincoln presidency ended with his death, but was a continuation of our history.
We can no more throw away parts of our history as a nation than we can our individual pasts that make us who we are. Why can’t we learn to avoid the fire once we have been burned? If some one tells me to forget about Bush and give Obama a chance to prove he is different when reason tells me he isn’t, I have learned nothing. I live in this country and there is nothing I can do to change anything now because it will require a collective consciesness and that probably will not happen until we crash and burn.
I think you need to get used to the fact most people here are very concerned about the legacy of Bush presidency and will continue to express their concerns. Many of the concerns you have about Obama arguably stem from abuses and increased executive powers stemming from decisions made during the Bush administration. You can chose to ignore this, but don’t expect others to. I respect your viewpoint of course.

Many here are from the left or are centrist left leaners (like me although I embrace principles from both “sides”). We don’t hate free speech and defend it. Would you like me to generalize and say: Why does the right hate free speech so much?
I know not all on the right think this way. But some of the social conservatives back measures to censor “pornography” or “obscenity” under the guise of “protecting children.”
My point is, both sides are pro-censorship when it suits their agenda and scream the loudest when the other side tries to censor. The rest of us stuck in the middle don’t want any censorship, except for things like screaming “fire” in a crowded move theater, and things of that nature.

I do not see everyone always bringing up Bush. What I do see is you keep criticizing people for bringing up Bush. I understand you don’t like it. You don’t have to reply to people here that bother you. If you want a blog where people don’t bring up Bush critically as much as you see that happening here, there are plenty out there I am sure. But I think there is something here that draws people here from many backgrounds. I always expect friction and inhomogeneity here.

Obama will stay away from challenging legal issues but in my estimation because his strategy would be to surmount by rallying up the masses of supporters in a radical socialistic fashion - a la Chavez. Yes, I still see him in that category - as following in Chavez’s instincts.
I don’t see the Obama administration working civilly. I see them continuing to work by rallying up the MSM the same way they so successfully did during the campaign. I think after Jan 20th. the campaign will begin again, subtly but firmly - the campaign of justification by rallying the support of the masses. In other words, they will revive the army of Obots and keep feeding them. That’s they way I see it.
Having wrote that, now I will say that it just dawn on me that the reason for bring Hillary up as SoS synchronizes perfectly with my previous statement. And in that sense Hillary as SoS adds substantially to the danger that Obama possess to not only the U.S. but the world at large. What I am saying is that by having Hillary in the SoS position, it will be much easier for Obama to rally not only his loyal army of Obots but to develop a ‘royal army’ of Obots worldwide that will include Hillary supporters.

Obama might have a law degree, but he also has no scruples. This makes him more dangerous, as far as I’m concerned. He will walk right up to the line and put his toe over it again and again and be able to justify it legally. Having his competition eliminated when he ran for the Illinois Senate may have been “legal”, but it showed a lack of ethics or morals. The way he conducted his campaign was seriously ethically challenged. Does anyone really believe that he will do the “right thing” once he is in office.

RT, Larry is being pragmatic. He has been a loud vocal critic during the campaign and will continue to share his strong views as things unfold. Being pragmatic, he sees no choice but to hope for the best. If/when Obama fucks up, I am certain to the core of my being Larry will be the first to speak out.

Sadly, mainstream media have totally ignored this inconvenient truth and are not even been willing to even look at this birth certificate issue. They are all still in-the-tank for Obama, but even more so now that he is in line to be President. They have been too quick to label as “trash” or “garbage” any legitimate questions asked about Obama’s real birth certificate. Even high-ranking governmental officials in the state of Hawaii where Obama was allegedly born, won’t reveal what’s on Obama’s original birth certificate. All they have said is that they have it. They have not said (1) where Obama was born, (2) when Obama was born, or (3) even to whom Obama was born.
