SCOTUS Ruling on Gun Rights Highlights Obama Electability Issues

Today’s Memeorandum.com top stories are atwitter with scrutiny of Obama’s various stands and mismatched statements on gun control, starting with Political Radar’s “Obama Camp Disavows Last Year’s ‘Inartful’ Statement on D.C. Gun Law.”

First, we have — shudders — a presumptive presidential candidate who talked gansta style in Philadelphia on June 13th. From my story, “Obama’s Gangster Mentality“:

If they bring a knife to the fight, we bring a gun. Because from what I understand, folks in Philly like a good brawl. I’ve seen Eagles fans.”

Obama’s words are dangerously poor examples to our nation’s youth. Obama’s words are unbecoming of a presidential candidate, let alone a president.

We’ve long known that Barack Obama is highly vulnerable on the issue of gun rights due to his all-over-the-map statements on gun ownership rights — and, most seriously, his voting record.

Before gun-lovin’ Idaho’s primary, Obama talked the talk about gun owners’ rights. But, during his terms as an Illinois state senator, he voted for laws that will disturb any gun ownership advocate. A CBS News story, “Obama Record May Be Gold Mine For Critics” — its subtitle is “Eight Years As State Senator Were Full Of Controversial Votes, Including Abortion And Gun Control” — reports:

He supported allowing retired police officers to carry concealed weapons, but opposed allowing people to use banned handguns to defend against intruders in their homes. And the list of sensitive topics goes on.

With only a slim, two-year record in the U.S. Senate, Obama doesn’t have many controversial congressional votes which political opponents can frame into attack ads. But his eight years as an Illinois state senator are sprinkled with potentially explosive land mines, such as his abortion and gun control votes. …

Obama regularly supported gun-control measures, including a ban on semiautomatic “assault weapons” and a limit on handgun purchases to one a month.

He also opposed letting people use a self-defense argument if charged with violating local handgun bans by using weapons in their homes. The bill was a reaction to a Chicago-area man who, after shooting an intruder, was charged with a handgun violation.

Supporters framed the issue as a fundamental question of whether homeowners have the right to protect themselves.

Obama joined several Chicago Democrats who argued the measure could open loopholes letting gun owners use their weapons on the street. They said local governments should have the final say, but the self-defense exception passed 41-16 and ultimately became state law.

“It’s bad politics to be on the wrong side of the Second Amendment come election time,” said Wayne LaPierre, executive vice president of the National Rifle Association. “It will certainly be talked about. You can take that to the bank.”

On the other hand, Obama parted company with gun control advocates when he backed a measure to let retired police officers and military police carry concealed weapons. …

Here’s that “inartful statement” featured today at ABC News’s blog, Political Radar:

ABC News’ Teddy Davis and Alexa Ainsworth Report: With the Supreme Court poised to rule on Washington, D.C.’s, gun ban, the Obama campaign is disavowing what it calls an "inartful" statement to the Chicago Tribune last year in which an unnamed aide characterized Sen. Barack Obama, D-Ill., as believing that the DC ban was constitutional.

"That statement was obviously an inartful attempt to explain the Senator’s consistent position," Obama spokesman Bill Burton tells ABC News.

The statement which Burton describes as an inaccurate representation of the senator’s views was made to the Chicago Tribune on Nov. 20, 2007.

In a story entitled, "Court to Hear Gun Case," the Chicago Tribune’s James Oliphant and Michael J. Higgins wrote ". . . the campaign of Democratic presidential hopeful Barack Obama said that he ‘…believes that we can recognize and respect the rights of law-abiding gun owners and the right of local communities to enact common sense laws to combat violence and save lives. Obama believes the D.C. handgun law is constitutional.’"

The Chicago Tribune clip from Nov. 20, 2007, is an inaccurate representation of Obama’s views, according to Burton, because the presumptive Democratic presidential nominee has refrained from developing a position on whether the D.C. gun law runs afoul of the Second Amendment.

When Obama has been asked on multiple occasions to weigh in on the D.C. gun case he has regularly maintained that the Second Amendment provides an individual right while at the same time saying that right is not absolute and that the Constitution does not prevent local governments from enacting what Obama calls "common sense laws."

Although he has been willing to describe his general views on this topic, Obama has sidestepped the question of whether the ban in the nation’s capital runs afoul of the Second Amendment.

Remember this debate question by ABC’s Charlie Gibson?

Asked by ABC News’ Charlie Gibson if he considers the D.C. law to be consistent with an individual’s right to bear arms at ABC’s April 16, 2008, debate in Philadelphia, Obama said, "Well, Charlie, I confess I obviously haven’t listened to the briefs and looked at all the evidence."

In stark contrast, Sen. McCain has been a straight-shooter on the issue, reports Political Radar:

Sen. John McCain, R-Ariz., by contrast, has been forthcoming when it comes to the D.C. gun law. 
He signed an amicus brief in the District of Columbia v. Heller case, signaling not only his belief in the Second Amendment but also his view that the DC gun ban is incompatible with it.

Our friends at Reason magazine call Obama’s slippery statements “fishy.”

Earlier, Barack Obama had issued a fishy retraction of last year’s unambiguous statement that “the gun ban is constitutional.”

    I do not have a lot of sympathy with gun advocates, nor do I have any sympathy for Obama. I would be fine if he had a clear position supporting the handgun law in DC. What I find disturbing about this issue and so many others is that Obama is so unwilling to take a clear stand on controversial issues. I remember how he trashed HRC (with help from all the other Dem boys) at that debate (with Peter Potatohead of MSNBC) on driver’s licenses for illegals. This is different only because?????

    Here is where I veer from my buddies here. Gun control is the new abortion issue.

    It’s irrelevant to presidential elections.

    They have zip control.

    It’s a constitutional issue. It lies with the Courts, and unless the Courts are willing to usurp the constitution, it’s never going to fly.

    Guns are here to stay in America. Period.

    And I’m a bit tired of the discussion.

    I completely support any ban against military weapons.

    But handguns?

    That was sure to be shot down on solid constitutional grounds.

    No presidential candidate should be asked even about that.

    Me? I’ve never shot a gun in my life, wouldn’t have one in my home, and deplore people into that life.

    I’m a pretty good shot but don’t own a gun. But what bothers me about this is not the gun issue itself. AnninCa is correct about that. It’s a wash.

    What bothers me is that once again Obama dances around an issue. You don’t know where he stands on any given day.

    How can we possibly figure out what he’ll do as President? We’re supposed to vote for what? For the fact that he takes no tough stances and changes his opinion like the wind? That’s some fine leadership there.

    He is unelectable, for one, his stance on gun control is too far left. The 2nd amendment is written in our constitution, like it or not.

    I really don’t care what Obama thinks about guns, or anything else for that matter. So far as I am concerned Obama is not qualified to make any decisions that would affect national policy in any shape form or fashion. Anyone who associates with the type of people Obama is known to have associated with would not be a good source of responsibile counciling on the subject of guns, explosives, bio-chems, or any other materials or equipment that could endanger the American population. Obama is not just ignorant but he is dangerously ignorant and his arrogance makes that even more so, just like GW Bush.

    Inartful? The statement was artful on a difficult political issue.

    If Obama didn’t actually mean in the past the law was constitutional, he would today simply say, “the aide was mistaken.” No, Obama knows that he himself said constitutional. He claims to be a constitutional law professor.

    People should research the issue before taking a potshot at gun control.

    The Federalist Society hacks on the USSC twisted the constitution to support the NRA’s baldfaced lies about the second amendment and violated decades of precedent to come up with this decision.

    This isn’t the first time the high court has abused the Constitution and precedent in order to further a political agenda. Bush v. Gore was another.

    I will not be online due to a connection problem and am getting this posted through the assistance of my host.

    The following shows that the Delaware matter is nothing more than a vindictive attack by the Obama Camp those in powerful places who support Barack Obama’s dirty Chicago Style Politics.

    On June 16 and 17, 2008 two letters from the Social Security Administration were mailed to my Duluth home stating that my disability and medical benefits had been terminated for the following reasons:

    “Our records show that the following warrant for your arrest was issued for a parole or probation violation:”

    Issued by: New Castle County Superior Court

    N King Street, Ste 500

    Wilmington, DE 19801

    Date of Warrant: February 5, 2008

    Type of crime: probation or parole violation

    Warrant Number: U708000607

    Originating case number: U708000607

    NCIC Number: W283822252

    What is so telling about this is the following:

    1. I am not now nor have I ever been on probation or parole from the State of Delaware.

    2. I have not ever been charged with, tried nor convicted of any crime in the state of Delaware

    3. The information contained in this letter does not match the case number indicated on the court documents dated June 23, 2008 from the “alleged” warrant used to arrest me by DC Metro Police on June 18, 2008.

    I am not on any probation or any parole from any State or Jurisdiction of any kind nor have I been since my Colorado Parole was discharged on May 5, 2000.

    It is just amazing how I am being targeted with non-stop manufactured warrants and charges which only surfaced after I began making public my claims against Barack Obama.

    Even more interesting is Social Securities letter being dated the exact same dates that the DC Metro Police and the National Press Club security director begin organizing their plan to take me into custody on a non-existent “Fugitive from Justice” warrant.

    THIS ACTION HAS NOTHING TO DO WITH THE COLORADO MATTER AS PER SSA OWN PROCEDURES. SO ANY CLAIMS BY OTHER BLOGGERS TO BE RESPONSIBLE FOR THIS ACTION ARE NOTHING MORE THAN THEIR TRYING TO APPEAR MORE IMPORTANT THAN THEY ARE. THIS ACTION WAS DONE BY OFFICIALS CONNECTED TO THE OBAMA CAMP AND THE DATE OF THE SSA LETTER SUPPORTS THIS.

    Did you read all 157 pages of opinion and dissent? Did you read the majority’s analysis of all federal and state court precedents regarding regulation of personal firearms? Did you read how the court looked at similar provisions in state constitutions? Did you read how the majority analyzed legal treatises from before and after the civil war on this very issue? There is no precedent to scrap the second amendment to which you so fallaciously allude. All precedent cited in the opinion supports the individual right.

    In Heller at 56, “the enshrinement of constitutional rights necessarily takes certain policy choices off the table. These include the absolute prohibition of handguns held and used for self-defense in the home. Undoubtedly some think that the Second Amendment is outmoded in a society where our standing army is the pride of our Nation, where well-trained police forces provide personal security, and where gun violence is a serious problem. That is perhaps debatable, but what is not debatable is that it is not the role of this Court to pronounce the Second Amendment extinct.

    That is not an abuse of the Constitution, nor is it politics. It is the Supreme Court doing what it should do, say that the rights enshrined therein are inalienable and vested in the individual.

    I heard that the Obama camp will be registering black people who don’t traditionally vote–who, as a previous blogger commented–will be homeless, felons, and dead people. (Of course, in the case of the latter, it wouldn’t be untraditional for Chicago pols!) Hopefully, more and more states and/or precincts will be asking for ID. One thing we can be sure of is that the Repubs won’t be pushovers when it comes to Dems attempting voter fraud, since the former are age-old masters of the art! And, of course, during the primaries when there were one Dem and one Repub overseeing the action, the Dem might have been an Obamaniac. The Repub wouldn’t have cared if Hillary was cheated, but he/she will care during the GE when it involves McCain!
    If Hillary is not the nominee, you must vote for McCain! A write-in or vote for Nader, etc. will be wasted, and WE MUST KEEP OBAMA OUT OF THE WHITE HOUSE!!

    Obama’s camp should be proud. In everything they’ve done to this man, they’ve succeeded in changing me into a believer. A Larry believer. Trumped up charges. Taking away his medical. His pay. Demanding he pay back money on these trumped up charges. The judge couldn’t even find the charges. They didn’t come from a blog, it came from DC.
