FISA for Dummies

Senator Barbara Boxer stood proudly on the side of the people today. Her admonition on the Senate floor concerning this FISA abomination is a breath of fresh air.

At this point in time to give retroactive immunity kind of makes a mockery of the fact that we’re supposed to be a government of laws, not people. We are a government of laws. Do we then come back and say, “Oh, by the way, there’s three laws over here that we don’t really like, so we’re just going to say to the people that broke them it’s OK? ‘Cause we’ve looked at it and we think it’s OK?” This is America. We are a country of laws.

Last week we celebrated the day we adopted the Declaration of Independence, Independence Day, July 4th. In that historic document is the following phrase: “That to secure these rights, governments are instituted among men deriving their just powers from the consent of the governed.” The consent of the governed. That means the law has to be behind you when you undertake to do something like this administration did. They didn’t care about the consent of the governed. They didn’t care about the law that was in place.

Since it seems likely that this bill will pass the Senate I find it important to describe what this bill does so that everyone knows. Because the outrage I might expect isn’t coming from anywhere significant.

FISA Amendments Act Basics

1. The law retroactively legalizes a massive electronic operation to spy on the personal communications of millions of Americans – within the United States

2. The law allows physical searches of Americans’ homes and places of work without a search warrant or any other proof that anyone being spied upon is suspected of any crime at all

3. The law allows the same kind of unaccountable spying online and by telephone

4. Under the FISA Amendments Act, the only person with the ability to stop the spying is the same person who actually orders the spying to take place: The Attorney General of the United States.

    We stopped being a nation of laws when both parties decided it was okay for people to cross our borders illegally. There’s no justification for this unlawful act. If people in other countries need help, our government should do all that is possible to help them. If our businesses need more labor, Congress should raise the quotas on immigration. Breaking the law is a bad policy that will lead to exponentially worse policies.

    But that’s the new America in the 21st century.

    I assume that this bill goes into effect right away which means that Bush can now legally do to Obama what eventually got Nixon impeached – wiretap him and his campaign looking for dirt to keep Republicans in power. That is where the real threat lies. The Bush administration has already shown its willingness to illegally use the power of the government to go after political opponents (just ask Don Seigelman). Now Democrats are making it legal for them to dig up dirt on themselves! How dumb can you get? They know that J Edgar Hoover used info he obtained from wiretapping presidents and other politicians to blackmail them. Why do they think they would be exempt from this kind of treatment? Or is the thought of wielding this power themselves just too tempting?

They can whine all they want, they could have had a great candidate, a wonderful president who was positioned to win big. This country will never have a just, humane, equal society as long special groups in the society keep working to get dominance over everyone else. LBJ put programs in place that more than make up for slavery, but lots of blacks don’t want to live a productive middle-class life.     another issue that really angers me. We should be helping reform Mexico’s corrupt government not allowing people to break the law by crossing our borders.     I think you need to take this thought process one step forward, particularly in regards to someone like Obama who has used his Gestapo-like internet denizens to his benefit, politically:

    Some of the Democrats, like Obama, are making it legal to dig up dirt on THEIR opponents.

    Don’t think it’s and “us” and “them” situation, because it is not. Obama is “them,” here. He has shown by his refusal to rein-in his ‘net thugs that he is very open to data mining-type operations for his own advancement.

    The first thing I thought of when I heard that he was supporting FISA was just this. He is giving himself another possible tool, if he is elected, with which to try to enact his authoritarian consolidation of power.

    This guy is dangerous. If he wins, get ready for the north-of-the-equator version of Hugo Chavez. That is, media outlets being shut down and opposition to him being made illegal.

    I don’t know why people refuse to see this. He and his minions have already relocated the DNC and are openly talking about purges of the party and the establishment of shadow organizations for Democratic Party structures.

    What does this guy have to do for people to wake up to what is going on? Does he need to fly flags with Che Guevera in his offices?

    Oh wait, he already did that.

    This is not about party, it is about our nation. I don’t care what anyone says about me, how they try to pigeonhole me or if people feel ‘odd’ to think about voting for a GOP candidate after having been Dems their whole lives:

    If we don’t stop this guy then all of us will have to live with the consequences after the fact.

    To repeat: It’s not about party, but country.

    Barack Obama, his nutjob inner circle and his supporters like Jodie Evans hate this country and want to radically remake it. The ACORN gang, the Che lovers and Wright defenders are all part of this crew. The Xboxers don’t care, they just want to rebel against something.

    I am not going to be led over a cliff because of a supposed fealty to party or a lockstepping antipathy to the other major party.

    If it comes down to BaJoke vs McCain, I will donate to and campaign and vote for McCain without much of a second thought. I hope Hillary is nominated, but contingencies have to and are being made.

    This is far too important an election for irrelevant categorizations to hold any of us back from doing what we must. Opting out is not, IMO, a viable option. We must actively reject this man, Barack Obama, or else live with his election.

    I know many won’t move on this until after August, which makes total sense. I will also be working to get Hillary nominated during that time.

    But if and when the time comes, please, do what needs to be done. For the good of our party and who is running it and how it is being run, he must be stopped.

    NObama. Not now, not ever.

    If Obama hadn’t played racial politics and ran on more substance, I would have voted for him. He goes out of his way to attack women in particular, if we can judge from his career. He plays dirty, though. The sexism his campaign indulged in and his smears against the Clintons – because it was the only way he could win. He needed crooked investors and media support. I don’t expect perfection from politicians or the world itself, but I respect decency more than ambition. Somehow, McCain has taken risks and stood firm on his beliefs, many of which I disagree on. I feel he should be rewarded with my vote. It’s too bad Hillary Clinton appears out, because she was the most qualified of all the candidates. Her vote today shows she is principled and the real progressive.

    McCain didn’t play nice. They tortured him until his body was broken. He stayed in the camp longer than he had to, making sure other prisoners were released. I hate to even bring it up, but just wanted to say being a POW is not just doing what you’re told. I say that, because as someone from a very abusive home, I know what it’s like to be a prisoner. Not anything close to what McCain endured, but it’s a horrible experience.

    I need to find a more thorough explanation of this bill. The video on this post says, “anybody anytime.” If that’s true, that would include our representatives and senators. I find it hard to believe that they would authorize a total abdication of their own rights…maybe their constituents’, but not including themselves.

    I’ll bet they the Prez could find a LOT of good stuff on a LOT of them, including Obama, of course, if they have been foolish enough to give away their own rights along with everyone elses.

    FISA allows the government to sidestep the judicial process to prove probable cause and get a warrant to tap into an individual’s phone, internet, etc. In the past, the telecom industry could be prosecuted for going along with taps that did not have a warrant. Now, there will be no reason the telecoms can state to hold off government intrusion.

    It’s a bad law. It’s being passed on the basis of fear of the terrorists, but there is not a good reason in reality to circumvent the constitution.

    I believe it should be challenged in the courts now and let the courts kick it to the curb.

    It’s a violation of our constitutional rights.

The US government has been trying to makes amends with our black population for years, but their demands just never stop. At the same time, I want America’s minorities to step to the plate and strive to better their lot by taking advantage of what America offers to ALL of its citizens. This starts with a free public education. Educate yourself, and enhance your freedom by doing so.

    Had these amendments passed, it would be possible/easier to sue the telecom companies who cooperated under FISA. With the failure of these amendments (the nays outnumbered the yeas), bringing suit against the telecom companies is not possible. (If I understand this correctly, I would have wanted my representative to vote “yes” (i.e. yes, you can sue the telecoms, we strip them of immunity) on all 3 amendments. However, the big vote, on the FISA compromise (recently passed in the House) is yet to come. Please, anybody, clarify if I have posted wrongly here and thanks.

    Yes, this would make sense. The amendments would have addressed the provision in the FISA act that gave telecommunications companies immunity to lawsuits brought by us citizens by stripping or delaying such immunity.

    Look back at your history, for just a moment. The last time that Israel launched a “targeted strike” against a nuclear facility was in 1981–AGAINST IRAQ.
    The ONLY reason the Islamic world did not react violently was the major Islamic agitant didn’t demand it. That major Islamic agitant? The Ayatullah Khomeini, who was the effective leader of Iran. And Iran, in 1981, was in the midst of a war with Iraq (a conflict which would continue until 1988). (A few Arab neighbors, especially Saudi Arabia, weren’t thrilled with the UNPROVOKED–one could say “terrorist”–attack, since their own security was threatened, but they also largely recognized Saddam’s ambitions, long before the Reagan administration, which was eager for a counterweight against Iran, ever did.)
    Don’t forget that it was, largely by Khomeini’s accusations, that led to several Muslim attacks and demonstrations at US embassies in largely-Muslim states (Pakistan’s being most notable) after the attack on the Kaaba in Mecca (something which Saudi authorities quickly pinned on Shi’ite “pilgrims” from Iran).
    If an attack were done against ANY Iranian facility (especially by Israel), you would see *official* relief on the part of a number of Arab governments, but the calls from the Muslim clerics–not just Shi’ite but Sunni as well–would swell the ranks of groups like al-Qaeda. Also, the small number of groups opposing the central government in Tehran would be completely undone as they would ALL take offense that an “outsider” had dated attack THEIR country. (If you’ll remember the outrage of 9/11 and how ALL Americans rallied behind Dubya, regardless of their own political opposition to him, you’ll have some idea of how an attack anywhere in Iran–especially by “the Zionists”–would be met. The big problem, of course, is that outside Iran, many other Muslims would declare “We are also Iranians”, the same way many Europeans made a similar statement of support with America.)

    Sen. Boxer doesn’t deserve the accolades. She’s influential among progressives, as we all know, but the woman sat on her hands throughout the primaries as Clinton was being bludgeoned to death by the media and the left. (And on June 4th she even swtiched teams and endorsed Obama.)

    More importantly, Boxer sits on the Senate Commerce Committee, which oversees the F.C.C. and corporate ethics. In 2003 this committee under John McCain held a hearing on the radio boycott of the Dixie Chicks. So a few months ago, I spoke with Boxer’s office and later sent a three-page letter, asking that she push for a similar hearing on the 2008 election media bias, inviting the presidents of all the major broadcast networks, as well as Time and Newsweek. There are violations of anti-trust law and F.C.C. regulations, perhaps even a criminal conspiracy in the way Clinton has been piled on and Obama’s past (especially his connections to Iraqi agents) has been left unreported. When I heard nothing back from the senator, I started a campaign targetting the entire committee, which is still ongoing.

    Stop the new FISA
    Allowing the new surveillance law to stand would seriously cripple our free press.

    If the sweeping surveillance law signed by President Bush on Thursday — giving the U.S. government nearly unchecked authority to eavesdrop on the phone calls and e-mails of innocent Americans — is allowed to stand, we will have eroded one of the most important bulwarks to a free press and an open society.

    The new FISA Amendments Act nearly eviscerates oversight of government surveillance. It allows the Foreign Intelligence Surveillance Court to review only general procedures for spying rather than individual warrants. The court will not be told specifics about who will be wiretapped, which means the law provides woefully inadequate safeguards to protect innocent people whose communications are caught up in the government’s dragnet surveillance program.

    The law, passed under the guise of national security, ostensibly targets people outside the country. There is no question, however, that it will ensnare many communications between Americans and those overseas. Those communications can be stored indefinitely and disseminated, not just to the U.S. government but to other governments.

    This law will cripple the work of those of us who as reporters communicate regularly with people overseas, especially those in the Middle East. It will intimidate dissidents, human rights activists and courageous officials who seek to expose the lies of our government or governments allied with ours. It will hang like the sword of Damocles over all who dare to defy the official versions of events. It leaves open the possibility of retribution and invites the potential for abuse by those whose concern is not with national security but with the consolidation of their own power.
