Attorney’s for Unrepentant Terrorist Bill Ayers Go to Bat for Obama

Yes, I told you so. Way back in December I made what I thought was the obvious point that Barack Obama’s old friend, Bill Ayers, would likely become the poster child for one avenue of attacks against the presumptive Democratic nominee. Barack and his acolytes averted their eyes and harrumphed that this is preposterous. I also wrote about the longstanding, but hidden, relationship Obama had with Ayers (see here). Well, guess what? Even before Barack can deliver his acceptance speech a Republican 527 group is out with an accurate, understated ad calling into question Obama’s judgment. The facts are fair and the question is valid–Why did Barack Obama get in bed on both business and politics with a man who insisted that his only regret from his days as a member of a domestic terrorist group was that he didn’t plant more bombs?

I reported here the other day the missive sent by Barack’s campaign to the media buyers pleading with them not to air the ad and Susan followed up with the letter the 527 group sent to the same media buyers. Well, here’s the new twist. Lawyers acting on behalf of the company that made a documentary covering in part the life of unrepentant former terrorist, Bill Ayers, are going to bat for Barack Obama.
The folks behind the American Issues Project came prepared to battle. They know that you need to bring a gun–a big gun at that–to a gun fight.

Dear Mr. Keker:The undersigned represents American Issues Project, Inc. (“AIP”), a not-for-profit organization engaged in various activities and projects, one of which involves sponsorship of a television advertisement, “Know Enough?” A representative of the news media has forwarded to my client who has, in turn, forwarded to me a copy of your letter dated August 25, 2008, related to the referenced advertisement (“the Ad”).
You have alleged that the Ad improperly utilizes protected material from your client, the Free History Project’s documentary, “The Weather Underground”.
Please be advised that my client takes very seriously the protection of intellectual property. In that regard, we have reviewed carefully the snippets of footage to which you refer: news reel footage of the bombing of the United States Capitol and a brief video (without audio) of an interview with William Ayers.
The use of all materials in the Ad has been considered in the context of 17 U.S.C. §107 which sets forth the various purposes for which the reproduction of a particular work may be considered “fair”. We have also reviewed each of the four factors to be considered in determining whether or not this particular use is fair:
1. the purpose and character of the use;
2. the nature of the copyrighted work;
3. the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
4. the effect of the use upon the potential market for or value of the copyrighted work.Having reviewed the documentary and the Ad, it is apparent that any use is within the parameters of the doctrine of ‘fair use’ of publicly available materials and is protected by that doctrine in accordance with federal law.

Here is the problem for Barack. He tried to pretend that he barely knew Bill Ayers. Well, that is a bald face lie and it will be exposed. I don’t know why or how Barack “Barry Soetoro” Obama first came to meet Bill Ayers, but as Steve Diamond has documented Ayers and Obama entered into a formal business relationship way back in 1995. Ayers hired Obama to run his foundation. You don’t do that with some guy you happen to meet in the corner market.
Barack’s hope of keeping this quiet and off the front pages is crazy. And he made a further tactical error on Monday by releasing an ad ostensibly to push back against the American Issues Project but blamed John McCain in the process. He has now given John McCain’s folks the opening for going after the issue themselves. What a maroon. But there you have it.
This is just the beginning. The other issues–Barack’s true name for many years (i.e., Barry Soetoro), holding citizenship in other countries (i.e., Indonesia and Kenya), his adopted father, his medical records, his trip to Pakistan, and his romantic entanglements–will become stories at some point. Barack will be like a paratrooper on D-Day who has landed smack in the middle of a German Army unit. He will be spending so much time seeking cover and trying to defend himself that he won’t have time to pursue a focused, coherent campaign. James Carville’s critique of the lack of focus on issues last night is spot on and is a preview of coming attractions. Obama’s relationship with Ayers is a big problem, but it is not the only one that will be hanging around his neck come October. Women and children, to the lifeboats!!
