“Changing Tune”? No, Changing Semantics

The NY Times had an article recently entitled, “Changing Stance, Administration Now Defends Insurance Mandate as a Tax.” Why the hell is this news? Had they or any other water-carriers in the MSM actually done their jobs when this bill, now a law, came out, they would have KNOWN this already. Those of us who had our eyes and ears open sure knew it (not that we weren’t assailed by the Obamanation for claiming such a thing).

Is this really the level of press we have now in this country? No wonder we are in such dire straits.

Let me just share with you the beginning of this article:

When Congress required most Americans to obtain health insurance or pay a penalty, Democrats denied that they were creating a new tax. But in court, the Obama administration and its allies now defend the requirement as an exercise of the government’s “power to lay and collect taxes.”

And that power, they say, is even more sweeping than the federal power to regulate interstate commerce.

Administration officials say the tax argument is a linchpin of their legal case in defense of the health care overhaul and its individual mandate, now being challenged in court by more than 20 states and several private organizations.

Under the legislation signed by President Obama in March, most Americans will have to maintain “minimum essential coverage” starting in 2014. Many people will be eligible for federal subsidies to help them pay premiums.

In a brief defending the law, the Justice Department says the requirement for people to carry insurance or pay the penalty is “a valid exercise” of Congress’s power to impose taxes.

Congress can use its taxing power “even for purposes that would exceed its powers under other provisions” of the Constitution, the department said. For more than a century, it added, the Supreme Court has held that Congress can tax activities that it could not reach by using its power to regulate commerce.

While Congress was working on the health care legislation, Mr. Obama refused to accept the argument that a mandate to buy insurance, enforced by financial penalties, was equivalent to a tax.

Ah, yes. Obama’s refusal that this was a tax. As the article points out, Obama flat out lied, um, I mean, denied that was the case in his discussion with George Stephanopoulos. I am sure you remember this little video highlight:

So, apparently, Stephanopoulos was right, and Obama lied to his, and our, face.

We also know, now (well, those who denied it then know now), that this law WILL add a ton to our deficit. Another bigass lie from Obama, thanks so much. Pretty much every claim made by Obama, in that clip and while campaigning for this law, has turned out to be a lie.

I blame him, but mainly, I blame a Congress that didn’t bother to read the damn thing before voting on it, not unlike the recent “Financial Reform Bill,” and a media that failed to do their duty in accurately reporting the discrepancies between what Obama said, and what the law said. And I fault all three for ridiculing those of us who were asking reasonable questions about how this bill would affect our personal health care, how much it would cost, and how it would be paid, even, as always, using the race card against us. The attacks were constant and unrelenting.

Surprise, surprise – we were right all along. And one other thing about which we were right, which the article also mentions: those 16,000 new IRS agents, the funding of which was not set apart in the bill. Yes, we will have to note on our Income Tax returns whether or not we have health insurance. The IRS, despite its claims that it is not set up for this, and is not trained for this, will be policing us and our small businesses to make sure we are compliant.

Oh, and one last thing about the ObamaCare Law:

Can we finally agree that Obama is a massive liar, who uses condescension and derision to dismiss and discount reasonable questions about his plans? If not now, when? How much more are we going to be screwed before Congress stops doing Obama’s bidding?

I shudder to think.

Now this I think is a big political problem for POTUS and the Dems, who continually said this baby was Constitutional [remember Pelosi laughing at the mere question and saying 'are you kidding'], and then POTUS claimed outright that it was not a tax  [saying his opposition would claim everything was a tax], and furthermore he took a vow during the election that he would absolutely not raise taxes[income, payroll, etc.,etc.] on any American making under $250,000.

We all remember that, unles we were staggering around in a coma.

Gonna need some mighty fine tap shoes to dance around this reversal! Remember the reaction to Poppy Bush’s statement: “Read My Lips?”  That didn’t play too well to the peanut gallery.

Special Report tonight showed that clip of Oblahblah and George Stephanopoulos. Oblahblah made himself perfectly clear. Now one must come  to the conclusion that either he lied or else he didn’t know what the hell he was talking about. Either conclusion leaves us with a POS sitting in the Oval Office.

I don’t like “games” being played with language either Ferd. I don’t like when “lies” are called “spin” or a “flip-flop”.

“Remember the reaction to Poppy Bush’s statement: “Read My Lips?”  That didn’t play too well to the peanut gallery

History has a funny habit of repeating itself.”

I see it playing differently, Peggy.  Poppy Bush was hurt over that by losing support from his own party.  The base of the GOP–then and now–was rabidly anti-tax anything, especially the raising of income taxes.  Poppy Bush lost so much support from his own party that he earned a serious primary threat from Pat Buchanan.  The same voters that would be disillusioned over such an issue would never vote for Obama anyway.  So I don’t see how he loses as much support there.  Perhaps some with independents, but not nearly at the same levels overall.

The Democrats do not have anything like that anti-tax base.  That’s why they’re Democrats–they generally support higher tax rates (especially on the wealthy) in return for a stronger safety net.  Of course there are differences on the margins of both parties, but by and large, this is the major fault line between the two parties.

  • Ferd Ritz Cracker Berfle

Indeed, helenk. A lot of deductions were eliminated under Reagan. Maybe that’s why That One talked so much about Reagan during the primaries.

I agree, Jackie, the tax, anti-tax position is a faultline between the parties, but the words were said, people heard them and shimmying around the message now is not a good strategy.  Plus the Indies are bailing like crazy.

This will likely haunt POTUS, mark him as “just another lying pol” after he and his team marketed him as something far different. The Dems have boxed themselves into a corner with a very unpopular healthcare reform package. They took a winning issue and turned it ugly.  I read and scan the Dem blogs.  There’s not a tremendous affection or even respect for what we ended up with, which looks more like a bailout to the insurance companies, Big Pharma and hospital administrators.  I’m sure you have an argument for this, but voters across the board are not happy.

    We shall see.

Stop expecting me to bail out those who haven’t the intellectual or intestinal fortitude to take care of themselves. I’m not interested.

  • BuzzLatte

I don’t think it’s even a “we shall see” issue.  Voters are completely pissed off.

It has been nearly 400 days since Obama had more voters that approved of his job as president than disapproved on the Rasmussen Reports Daily Presidential Tracking Poll.

Obama went into the negative numbers on JUNE 30, 2009!  The only thing that is sustaining him in  the WH is his shrinking pool of knee-jerk race and hopenchange voters.  He’s even lost 10 points among the blacks.

He is a lying pol.  He always has been a lying pol and he will continue to lie until he is escorted from the oval office and out of Washington DC.

“And that power, they say, is even more sweeping than the federal power to regulate interstate commerce.”

This sentence from the NYT is the one that really gets my goat.  Besides the outright lying and backtracking of OBeelzebub’s administration, I am furious about his use of what used to be our third branch of government–i.e., the judicial branch–but which is now just an arm of his supposed administrative branch though it is clearly becoming the dictatorial branch branch.

This is a bait and switch if I ever saw one.  The many suits and legal efforts against the HC bill are all set to argue the interstate commerce argument–that the federal government has overstepped its rights in that regard–that the federal government does not have the right to force citizens to purchase something (very simplified). Their turning it into a question of the federal government’s right to “lay and collect taxes” is just plain evil.

To me it’s not an issue between those who don’t mind taxes and those who are anti-tax.  This should be an issue about the honesty and integrity of the people who are elected.  This maneuver on the part of OBeelzebub is evil:  Remember that Satan is the Great Liar.  And the Stephanopoulos interview is proof that Obeelzebub is an outright liar if he is now willing to call a tax a tax when before he swore he would not.

Perhaps our resident Obeelzebub minion admires lying, cheating, swindling and all of that type of behavior in order to get her way because she knows so much more than we do or so she thinks, but I have always believed in the Constituional rights that elevate individual citizens as equals and that don’t declare some more equal than others in choosing what we want from our government.

I have always said that after the primary, the issues didn’t matter to me in the GE in 2008.  I would deal with issues later, but I wanted above all else HONEST politicians (or at least as honest as could be found).  And OBeelzebub is the biggest snake oil salesman ever sent to our country from the deepest depths of Hell, as far as I am concerned.

I hope my venting doesn’t disturb you all too much.

Ferd, I know that it is physically impossible for you to think outside of yourself, but here’s an idea: maybe Democrats like me support higher tax rates (including on myself) because they tend to make society function in a more generally healthy, egalitarian way for all American citizens.  Maybe I’m not so selfish and resentful of my fellow Americans as to assume that anyone in need of assistance in hard times is nothing more than a “leech” and a “taker”.  (If you must know, I’m well into the AMT by now, sweetheart).

That’s why a Democrat.  And that’s why you’re whatever the hell you are.

A decade ago, activist Ron Unz conducted a study of the ethnic and religious composition of the student body at Harvard.

Blacks and Hispanics, Unz found, were then being admitted to his alma mater in numbers approaching their share of the population.

And who were the most underrepresented Americans at Harvard?

White Christians and ethnic Catholics. Though two-thirds of the U.S. population then, they had dropped to one-fourth of the student body.

Comes now a more scientific study from Princeton sociologists Thomas Espenshade and Alexandria Radford to confirm that a deep bias against the white conservative and Christian young of America is pervasive at America’s elite colleges and Ivy League schools.

The Espenshade-Radford study “draws from … the National Study of College Experience … gathered from eight highly competitive private colleges and universities (entering freshman SAT scores: 1360),” writes Princeton Professor Russell K. Nieli, who has summarized the findings:

Elite college admissions officers may prattle about “diversity,” but what they mean is the African-American contingent on campus should be 5 percent to 7 percent, with Hispanics about as numerous.

However, “an estimated 40-50 of those categorized as black are Afro-Caribbean or African immigrants, or the children of such immigrants,” who never suffered segregation or Jim Crow.

To achieve even these percentages, however, the discrimination against white and Asian applicants, because of the color of their skin and where their ancestors came from, is astonishing.

As Nieli puts it, “Being Hispanic conferred an admissions boost over being white … equivalent to 130 SAT points (out of 1,600), while being black rather than white conferred a 310-point SAT advantage. Asians, however, suffered an admissions penalty compared to whites equivalent to 140 SAT points.”

“To have the same chance of gaining admission as a black student with a SAT score of 1100, a Hispanic student otherwise equally matched in background characteristics would have to have 1230, a white student a 1410, and an Asian student a 1550.”

Was this what the civil-rights revolution was all about – requiring kids whose parents came from Korea, Japan or Vietnam to get a perfect SAT score of 1600 to be given equal consideration with a Jamaican or Kenyan kid who got an 1150? Is this what it means to be an Ivy League progressive?

Academic freedom continues to be destroyed by the tenured Left. Academic freedom today increasingly means that faculty members have the right to agree with radical leftists and Marxists but not the right to disagree with them. And criticism of radical leftist academics is never permitted. It is considered ”McCarthyism.” The absurdities surrounding the leftist take on academic freedom have never been so glaring as in a pair of events, involving two very different professors in Israel, both allegedly involved in ”sexual insensitivity.” Ben Gurion University in Israel has long been something of a public laughingstock….

So my grandmother happily gave that amount to each of her grandchildren, 5 of them, and both her children. None of us paid taxes on it, and it was deducted from her taxable income as well. I called for a Tea Party Caucus to bring members’ attention to the cries of everyday Americans who are asking for a return to the fundamental principles contained within our nation’s greatest document, the Constitution. Americans from all locations and backgrounds have united through Tea Parties….

Interesting question, jwjr. My car insurance isn’t a tax, but I have to pay private companies to be insured.
Taxes can often be deducted from income, like State or Local. Will this be deductible?
So many questions and no good answers.

  • jwrjr

In November 1941 Obama Sr. was 5 1/2 years old.  Last I heard only terrorists took recruits of that age.

  • BuzzLatte

You still haven’t given the WHY you insist Obama is so great.  I was a lifelong democrat that couldn’t in good conscience vote for Obama.

The lack of transparency of his background.  The obfuscation of his records and his past history embroiled in black theology and dealings with the likes of Rezko and Bill Ayers was enough to vote for McCain.

Now, we are the recipients of historical deficits, a healthcare law that is really a tax, more unemployment, more debt held by China, less commerce in oil production, less housing starts and more mortgage failures.  If you call that successful, then you must dwell at the Neverland Ranch.

One thing I will credit Obama with, he’s help to create a real coalition of Americans that will stand up for the country and the constitution. He’s also inadvertently revealed the REAL RACISTS in this country.

Can we count you among those racists?

  • jwrjr

  • lorac

People are bleeding – regardless of party affiliation.  No one wants more taxes.  This is not a partisan concern.  And no one should excuse presidential (repeated) lying.

  • lorac

Ferd, I think he is very incompetent and extremely unknowledgable about the policies he reads off his teleprompter.  But it is true that from the start, the health care penalties were going to be collected by the IRS.  So I certainly think at least SOMEone knew this was a tax!

  • lorac

I thought at first he said his dad, and then changed it to his uncle…?  There was some substitution of a relative, anyway, as I recall.  He also changed the battle, I think lol

You need to talk to some Holocaust survivors.  This is a shallow and offensive comparison to make.

  • BuzzLatte

I know Holocaust survivors.  I have Holocaust survivors in my extended family and WWII vets that saw the devastation firsthand. They don’t like Obama, either.  Why do facts and the truth scare you so much, Jackie???

As far as offensive…that’s your weak opinion because you don’t know what the eff you’re talking about 99.99% of the time.

  • Jackie

You still haven’t given the WHY you insist Obama is so great.”

No, I already explained “why” I was quite pleased with how he has governed:

“I am extremely pleased with how successful this administration has been in this, the most successful legislative term since the 1930′s.”

    ***************************

“Now, we are the recipients of historical deficits, a healthcare law that is really a tax, more unemployment, more debt held by China, less commerce in oil production, less housing starts and more mortgage failures.  If you call that successful, then you must dwell at the Neverland Ranch.”

We already were all of those things before he took office.  Just because all of those problems haven’t been eradicated in 1 and 1/2 years doesn’t make the president a failure.  He has averted a 2nd Great Depression, saved millions of jobs, rescued the auto industry, signed Lili Ledbetter into law, appointed Sonia Sotomayor, about to sign into law sweeping financial reform, and enacted universal healthcare for the first time in American history (just to name items off the top of my head).  You may not like these things, but they are a record of staggering legislative accomplishment.

“He’s also inadvertently revealed the REAL RACISTS in this country.”

Absolutely.  He’s really brought the Mark Williams’ of the opposition out into the limelight.  Inadvertently…

“Can we count you among those racists?”

Should I ask if you’ve stopped beating your wife?  It would be as valuable and fair a question.

  • Jackie

I don’t know.  Is John McCain “a notion”?  I have come to despise that overused Baby Doc word.”

No, but his potential presidency obviously was, which is all I was referring to with “the notion of a President McCain”.

  • Jackie

“As far as offensive…that’s your weak opinion because you don’t know what the eff you’re talking about 99.99% of the time.”

Right, and you think enacting a centrist national health care plan is no different than marching Jews off to the gas chambers.  Get a clue yourself, friend.

NJ Gov Christy explained recently about NJ being saddled with paying retirement benefits to union workers, aka, teachers as well as the auto industry’s in other states.  One of the Teacher’s Union spokesperson had said, “Christy needed to be killed”!  Why was this?  In his efforts to make good on campaign promises to slash spending in NJ Christy asked the the teachers to pay a fraction of their teacher’s health insurance which was next to nothing but would save his state millions.  They refused as well as launched an ad campaign that he should *die* for this unpardonable sin.

Christy went on to explain that an avg teacher in NJ, with a 30-year tenure would only contribute a total of about $124,000 into her/his own retirement benefits funds.  Once the state tax payers kick in their huge contribution toward this teacher’s retirement fund, that one teacher’s retirement benefits would yield her/him $3.8 million!!

Is it any wonder the state of NJ, CA and many others are or will be going broke paying retired union workers as much or more than what they made working.  Then add the exhorbitant salaries as well as hourly wages paid their current workers!  I find this more outrageous than paying non-working people welfare money to exist on.  There is no difference for me – it is all highway robbery.  This is what’s causing the riots in Greece today - bankrupt pension funds.

BTW, the Teachers Union and the Auto Industry Unions are Barack 0bama’s biggest supporters and contributors to his 2008 primary and ge campaigns.

You will never get rid of the mindset of the Jackies of the world Ferd. You can hear an echo of the “I am Obama the savior of the world” messiah complex in what they say.

We will never be rid of them because there will always be those that think they know best and have a right to take from productive citizens in order to do what they deem the right thing.

They haven’t the insight or the intellect or even the compassion to see that they haven’t the right to force their ideas on the rest of us. They can’t see beyond the idealoguy that blinds them to reality.

The right-wing religious wackos are the same kind of critter. Force what they believe on the rest of us.

Sometimes, not often, justice is swift and sure. If I was convinced that this racist woman would not find a nice safety net within her community I would be cheering. I am not convinced.

I also suspect, with the exception of Beck and possibly Hannity, that the story will be given little attention. And unless someone watches them they won’t even be aware of what Ms. Sherrod said or did. Because as we all have come to see and know, black racism doesn’t count, whereas even a perception of white racism is cause for fauxrage of monumental proportions. It is all just so…

It appears that the famous liberal listserv – the so-called Journolist made up of prominent MSM reporters, academics, and pundits – was everything conservative critics said about it.

The Daily Caller has acquired documents that show the conspiratorial nature of the list and its ability to massage and manipulate the news.
This is especially true in the case of how the press leaders on the list conspired to kill the Reverend Wright story:

    http://www.americanthinker.com/blog/2010/07/journolist_docs_show_libs_cons.html

    From the article:
“Part of me doesn’t like this sh*t either,” agreed Spencer Ackerman, then of the Washington Independent. “But what I like less is being governed by racists and warmongers and criminals.”

Ironically we are now governed by racists, [race-]warmongers, and criminals.

I want to add something to my first comment…

Please think about my major point….The BAIT AND SWITCH tactics that the Obeelzebub administration used on the HC issue.  That marketing trick has been outlawed; it’s illegal.  But that law doesn’t apply to politicians.  Just keep getting out that message about the bait and switch.

If Obeelzebub used this tactic deliberately from the start, then he is even more evil.  If he’s using it now that he knows a right-to-tax argument is more likely to win than his interstate commerce argument would, he is still very evil, dishonest, slimy, and all that.  He’s using court cases to get his way.  He’s using the corrupted legal system to get his way.

The Demwits hated it when W did that, but they certainly don’t mind when Obeelzebub does it.  What hypocrites all.

Answer that, Jackie.  Heck, I know you can’t because your brain is too intoxicated with devil love to understand the point I’m making.

Dana Perino (in for Greta last night) mentioned the bait and switch, too.  That argument is more important to me than the “read my lips” comparison.  The trickery of using and corrupting the legal system is the most dangerous thing about Obeelzebub’s tactics.

The fine print from the 2010 Health Care Acct as Amended by the 2010 Health Care Reconciliation Act:

The shared responsibility penalty will be assessed and collected in the same manner as an assessable penalty under sub-chapter B of chapter 68 of the Internal Revenue code; However, the IRS will not be permitted to:
…file a notice of lien with respect to any property of a taxpayer by reason of any failure to pay the penalty, or
…levy on any property of a taxapayer with respect to any failure to pay the penalty.

The above was written to prohibit the IRS from collecting the penalty or tax or whatever you want to call it to fit your narrative.

  • EWard

The healthcare reform bill would mandate that most US citizens and legal residents purchase “minimal essential coverage” for themselves and their dependents. They can get this either through their employer, or, if their employer doesn’t offer health insurance, they can buy it through new marketplaces that will sell policies to individuals.

If you ignore this mandate and don’t get health insurance, you’ll have to pay a tax penalty to the federal government, beginning in 2014. This fine starts fairly small, but by the time it is fully phased in, in 2016, it is substantial

There are exceptions. Certain people with religious objections would not have to get health insurance. Nor would American Indians, illegal immigrants, or people in prison.  (Source: CS Monitor)

Do you think that individuals unable to afford HC would be homeowners too?  That excerpt you included is a joke just like Obama.  I take that back BO is a nightmare.

  • bamaLV

obama seems to have his hand in almost everyones pocket now.(except of course his own). now he wants to limit the tax deduction on mortgage interest. many people buy homes as opposed to renting,  because of the tax deduction. its one of the few we have left. he wont be happy until everyone is on the public dole and he can play big daddy by giving handouts to those he deems worthy. the rest of us can “eat cake”

EWard, I agree with you to a certain extent.  But there ARE people out there who are homeowners but who do not have HC insurance.  I know, for instance, that my sister, who owns two ranches and some rental properties just does not buy HC insurance, as she has a considerable savings account also to pay for a hospital stay.  On the other hand, she does pay for long-term care insurance.

I know a young couple who decided to buy the house and in order to make payments for the utilities, etc., stopped their HC insurance with the excuse that they are “healthy” and could afford whatever doctor visits they may have over the next few years.  They also figure, like some CEOs, that the penalty they may have to pay is cheaper than the monthly insurance costs.

  • Diana L. C. the Hazelnut Nut Thin Cracker

If they don’t straighten him out in this regard, then he will have to explain why we have to count whatever our employers provide as part of our HC premiums as “income” instead of as a tax.  Do employers then get to count their expenses as taxes and not as part of their payroll expenses.  Very confusing>

  • surfered

I am making no editorial comment.  As a CPA, I am only quoting the law, which is written to specifically prevent the IRS from filing a lien or making a levy on property for failure to pay the penalty.

  • EWard

    Diana

The fact that people can afford health care and refuse to purchase it was one of the arguments against the hc legislation.  As a result, taxpayers are footing the bill for this monstrosity.

Paul Ryan’s proposal made the patient and doctor the nucleus of the hc market.  Tax rules would be reformed making is possible that everyone gets the same tax benefits to purchase their HC.  Every American would receive an advanceable, refundable tax credit to buy portable health insurance.  It would have encouraged businesses to offer ins. with tax incentives.

Democrat Congressional leaders ignored it.  The law passed is very punitive.   More importantly, it puts Berwick in charge of Medicare and Medicaid which has a bigger budget than the Pentagon.

Watch for Dr. Death Berwick and the rationing to begin.
