Will The DOJ End Up Suing Half The Country…*Updated*

Over Immigration policies? Well, if a lot of people currently running for office win, I guess the DOJ will just have to since they all want to implement an Arizona-style immigration law. Yes, fully twenty-two (22) states are looking to incorporate Arizona’s law on their own books, as the report below highlights:

Wow – that is a whole lot of states – maybe Obama can use some of his Obama dollars (aka, Stimulus) to increase the staff at DOJ. He’s gonna have to, if almost half the country enacts legislation to mirror federal law. (Please don’t think about that one too hard – it will just make your head explode.)

And about that whole DOJ lawsuit targeting AZ…Well, I should say, ONE of their lawsuits targeting Arizona, the one directed at Sheriff Arpaio. Oh, yes – the DOJ is handing out these lawsuits in Arizona like they are candy. Not only are they suing the state, but they are suing the Maricopa Community Colleges for – get this – discriminating against would be employees by asking for additional paperwork. And why did they do this? Because the would be employer asked for a Green Card. And the DOJ is filing suit for that? WTH?

(UPDATE) Yes, this is how the DOJ stated their, um, “concern”:

[snip]The Justice Department said a valid driver’s license and a Social Security card are usually sufficient to show that a person is authorized to work. Requesting a green card amounts to “immigration-related employment discrimination,” said Thomas E. Perez, the assistant attorney general for civil rights.

Federal law forbids treating “authorized workers differently during the hiring process based on their citizenship status,” Perez said. He said the department’s Office of Special Counsel would bring legal actions against employers who impose “unnecessary and discriminatory hurdles to employment for work-authorized noncitizens.” [snip] (Click HERE to read the rest.”

Again, I say, WTH??? Asking for a Green Card is discriminatory?? You have got to be kidding me. Is the DOJ aware of the law passed in 1940 requiring naturalized and legal aliens to carry their papers at all times? Good grief.

Then there is Sheriff Arpaio, who allegedly committed Human Rights violations. Except maybe he didn’t, as this Daily Caller piece by Byron York indicates, “New Evidence Undermines Fed’s Case Against Arizona.” Oh, yeah – this is a doozy:

[snip] Despite the splash of attention from the newest lawsuit, the Justice Department’s investigation of Arpaio could end badly for Holder. When the Department first informed Arpaio that a probe was under way, back in March 2009, it sent a letter saying the investigation would focus on “alleged patterns or practices of discriminatory police practices and unconstitutional searches and seizures.” But now we learn that just six months before that, in September 2008, the Immigration and Customs Enforcement agency, known as ICE, did its own investigation of Arpaio’s office — and gave it a clean bill of health. Arpaio’s lawyers recently got a copy of the ICE report through the Freedom of Information Act.

The report, crammed with acronyms and bureaucratese, is not light reading. But struggle through it, and the key sentence is this: “The OI and DRO supervisors consider the conduct and performance of the MCSO … officers to be professional and meeting the requirement of the MOA.” Translated, that means officials from the Homeland Security Department’s Office of Investigation (OI), along with officials from the Detention and Removal Operations office (DRO), concluded that the Maricopa County Sheriff’s Office (MCSO), in its handling of illegal immigrants, acted in a professional manner and complied with a memorandum of agreement (MOA) under which the government gave them the authority to enforce federal law. That agreement included a ban on racial profiling.

What happens now? It’s been nearly a year and a half since the investigation began, and the Justice Department has not charged the sheriff’s office with violating anyone’s civil rights. Instead, Thursday’s lawsuit goes after Arpaio for allegedly failing to cooperate fully in the probe.

Failing to find proof of real discrimination in Maricopa County could ultimately doom the administration’s entire crusade in Arizona. The much-publicized suit against the new immigration law is based on the possibility that it might result in future discrimination, but at the same time the department is struggling to find evidence of civil rights violations in Arpaio’s office, which uses enforcement techniques similar to those outlined in the new law. Honestly, the whole concept of our Department of Justice suing one of our states for enforcing federal Immigration law is so mind boggling, I hardly have words to describe it. Visualize Scooby Doo’s shaking his head, and that’s what I am doing.

Fortunately, a regular at No Quarter, Noogan, summed it up well with this comment:

This is the issue that crystalizes my fear and loathing of this administration. Everything about it stinks to high heaven. It’s unconscionable. The Federal government suing the state of Arizona for passing a law which mirrors Federal law; at the same time allowing ICE and other government arms of the state to ignore Federal law? This is simply outrageous. It’s breathtakingly tyrannical.

It’s stunningly unconstitutional. Along with allowing the President of Mexico to come here, speak before Congress, maligning this country? These acts are the reason for the widely held suspicions about Obama; and no matter how many times liberals and the professional left mock the anger about it, the fact remains: The President of the United States is violating the Constitution, behaving as a dictator. That’s a very good reason to suspect the man.

I simply don’t have words to express my loathing of Eric Holder and Obama….

One thing is crystal clear – Obama and his Department of “Justice” have it in BIG time for Arizona. They are throwing anything they can against the wall hoping SOMETHING sticks to bring Arizona down. So far, though, all they are doing is demonstrating a callous disregard for the laws they are sworn to uphold.

The DOJ and Obama Administration are sure going to have their hands full if half the country follows Arizona’s lead of trying to enforce Federal law.

Wow. I have to stop now, before my head explodes…

    When these lawsuits come to trial, Discovery will be highly entertaining … but not for Obama and Holder.  Maybe the Two Stooges are figuring that Brewer, Sheriff Arpaio, and any others will be frightened and try to settle out of court.  Judging from appearances so far, that isn’t going to happen.  I sure hope not.

    IMO – this all dates back to the fact that John McCain/Sarah Palin had the nerve to actually run against the chosen one – he didn’t like McCain, still doesn’t , this is kindergarten payback revenge – just remember how thin skinned he & his kiddy admin is & everything falls into place – remember the fraud game plan played against Hillary (and also Bill)? I loathe this POS and can hardly wait for November – subpeonas will be up the yingyang – oh boy….. talk about Discovery………………..

    I’m no lawyer, but based on the little I know, the DOJ only needs to win or lose one case all the way to the Supreme Court.  That’s why the DOJ has only filed suit against one state.

    Good point there, susiepuma – it really does seem like Obama and the DOJ have a vendetta against AZ.  And even if, as Dario suggests, the DOJ only has to lose one case to  get to the Supreme Court, it seems like they are going WAY beyond and above anything rational. 

    I mean, really – suing a college for asking for papers?  Heck, I remember having to provide my driver’s license, Social Security card, and even a birth certificate (!!!) at one point, and at least for the two former, copies were made and put into my file.  As I understood it, that was the LAW.  I had no problem with my employer requesting that kind of info.  How in the world does someone who does not wish to present documentation get the Department of Justice to take on their case?

    Dangit – there went my head, exploding all over again…

    I agree on the payback to AZ, er McCain and Brewer.  I live in NM, and Santa Fe is a sanctuary city.  The police are trying to round up gangs, and their illegal relatives are complaining they themselves are being threatened with deportation if they don’t give info.  ”I am a hard working busser in a restaurant.”  Illegal students at UNM. Uptick in crimes.  Illegals coming from AZ now (no jobs here anyway).  But this is lefty libbylandia, and mustn’t ask for papers or anything like that.

    They are paid $300 to $500 to secure the release of apprehended illegals who have been here two years without any criminal charges on their records.

    They included the AZ malfeasance in the report to the UN on human rights violations, so nothing surprises me anymore.  I have run out of superlatives to describe this administration.  I just know that what little energy my damned MS does not drain from me MUST be used to save this country for my daughter’s sake.
    And, RRRA, I wish you a successful surgery and warp speed recovery.  And, I concur, do the physical therapy with a vengence.

    Sassy… I regret to inform you that because there are so many Totally Ticked Offs, I have had to restrict my practice to Unimaginably Ticked Offs.  I’ll be happy to scout around for some younger lawyers who might be able to represent you.  As to damages, although pain and suffering is good, it would be a better case if you actually become deranged.  My advice would be to wait awhile and see what happens.

    Rev. Amy— Today it was time to renew my driver’s license in Texas.  Before issuing a renewal, the Department of Public Safety demanded that I produce either (1) a social security card issued by the Federal Government, (2) a Pilot’s License, (3) a Military ID, (4) a Medicare/ Medicaid card, (5) a certified college transcript that has my social security number on it, or (6) a Veterans Administration Card with my social security number preprinted on it.  Each and every one of these is designed to prove I am “legal” and not an imposter.  Proving one’s identity is simply a part of life.  If these are the rules for someone who was born in this country and has paid taxes all of his working life, what is the possible objection to asking someone for a green card?  I really, really don’t get it.

Suing one of your own states? 20+ states are working on repealing health care in their own states.  Is Holder going to sue all of them too while holding a box of Kleenex for Obama and warming up a baby bottle for him? He’s losing the House, maybe the Senate too and he still won’t cry Uncle.

    I just wanted say that as well. Put another way…

    If I, as a citizen of this country, by my actions follow the Federal laws, which require a LEGAL immigrant to carry this on their person, I am gonna get sued by the DOJ?

    I really can’t imagine what goes through the mind of a law enforcement person, when confronted by the reality that the DOJ is a detractor. Who’da thought that the blindfolded Justice would be considered an unwilling participant in a sadistic horror flick.

    This / these lawsuits could open up a floodgate of new defenses for offenses.  I was driving a friend’s car.  It was old and ugly.  I got pulled over and the cop just walked around looking for an equipment infraction.  You see.. poor West Virginians drive cars that probably have worn tires or tail lights out because they can’t afford to keep their cars up.  That is profiling at it’s finest.  I got off because the car just looked old and beat up, yet was in perfect order for a 260,000 mile Subaru. 

    Had I get a ticket I will, in the future, call Holder and ask him to file a suit against WV.  That state went over 70% for Clinton and McCain and, therefore, is obviously filled with profile targetable anti-O folks and the cops are just picking on us regular people for not being elite Volvo drivers.

    By the way.  The Miller victory in Alaska is an example not of Tea Party power, but the power of the blue class voter.  Sorry to tell the ivory tower this information, but the number of blue collar voters in America far outnumber the elite snobs.  The kids who supported O in the 08 are now looking for jobs and even the trash collector makes more money than these kids could make as a tax collector – if they could find a job outside of government. 

    The more O attacks America’s blue front line (the working CLASS) for acting stupidly and supporting GOP and Independent candidates, the deeper and more energetic the blue line grows.

    We don’t like a lot of things the three stooges are doing and we are showing up at the polls.  Go ahead.  Sue every state that voted against O in 08.  We appreciate the inspiration you give, with your actions, to the true Americans.  Josie Wells shot the rope that held his enemy’s barge in line.  The DOJ action against a free state will set the O boat down the river without an oar or a life line, and this will be written in future history books as one of the lowest points in our republic’s history. 

    This action will help create a pivotal point.  It will be a point in time when historians will admit the the reason that the GOP controlled government here from 2010 – 3010 was because the Dems tried to ignore the fact that the Federal Government was created with permission from the State Governments.

    I’m teaching a one-day class at the local community college this fall. I had to PAY to have my fingerprints digitally taken; I had to get a new social security card because my number or social security statements about future payouts wasn’t good enough; I had to jump through other hoops just to teach one 6-hour class! And they’re suing about green cards?

    I can’t stand Holder. My mother carried a green card for years before she became a citizen. So?

    It’s infuriating that when people get into power they waste tax payer money on their own vendettas. That’s one reason people are so pissed off about government. This is ridiculous! Holder’s law suits will unfortunately work in the Repub’s favor.

    Bay.  I have an honorable discharge from the United States Air Force and yet I have had to pull out my SS Card and other ID for work for the last (oh, well I won’t tell you how old I am :) ) many years.  I don’t mind having to do so.  

    You used a word that asks for a question.  Why did you say “vendettas”

    Do you think O had bad experiences, as an outsider, that makes him act in the way he does today – - a way that bothers us now?  He does not want to be asked about his origin.

    I think it is simple.  His father had sex with his mother.  His mother had a kid.

    I am curious if they would accept a TIN#.  Here in CA lots of illegals get a TIN and use that even for college.  This TIN# would then be on the college transcript and I will bet that would be acceptable ID.  In most cases the SS and TIN are interchangeable.

    I believe that since Sheriff Arpaio is the “whipping boy” and “bogeyman” for all those that find more sympathy for the illegals than for the fear and suffering of their fellow citizens DOJ thought that going after him would be the popular and safe thing to do. Like many of the things that the Holder DOJ does it doesn’t seem to be well thought out legally but simply done as a political move.

    Free citizens are at risk when the DOJ is simply an arm of one party or one ideology or another. DOJ should be concerned with NOTHING but the law. Unless and until it is we have nothing more than political posturing posing as justice. And that is injustice.

    I didn’t like it when done by Bush’s DOJ and I don’t like it now. In fact I more than “dislike” it, as a free citizen of this country, I fear it.

    It’s not about the immigration issue for me; it’s about cynical abuse of federal power for political gain. 

    It’s a perversion of “Department of Justice.” It’s a corruption of the Constitutional balance of power under the Constitution. It’s political chicanery ala The Chicago Way, i.e., Abuse of Power. 

    It’s just disgusting. I’m really GLAD to see that 22 other states have followed suit; however, I wouldn’t count on SCOTUS to protect and defend the CONSTITUTION.

    Statism [overly powerful central governments] is a real threat to all Americans, from both political parties.

    At what point do WE get to sue the DOJ, Holder, Obama and the rest of the nasties who misuse their office against the American people?  How is it that Holder still has his job? 
    Under Bush the DOJ was atrocious and Gonzales was forced to resign, so why isn’t this happening under Obama?  Perhaps the people haven’t used a loud enough voice???
    Not being a lawyer, I have to ask if there is any liability for the DOJ in suing willy nilly for ‘preventive’ purposes.  Is there something akin to a false arrest charge which may be used against the agency?
    These scare tactics bear an uncomfortable similarity to tactics used during WWII on European citizens to keep them cowering and in line.  I don’t know about anyone else, but I seem to remember that we live in America and we don’t approve of dictatorships.  Perhaps someone could slip that memo to the prez???

    Perhaps we wouldn’t have to provide so much information if the government did a better job of keeping illegals out of the country and out of the workforce. 
    Think of how much this growing illegal, non English speaking population has impacted our daily lives.  I find it wrong to modify how we do business in order to cater to people who can’t or won’t learn our language.  Press 1 for English!

    Suing the University is really bizarre. I’m an employer and talk about getting screwed from all sides!! I can’t hire anybody without documenting, with 3 pieces of ID,  that they are legally entitled to work in this country.If I don’t have that paperwork on file, I can be fined and even jailed. However, if I request that documentation, I’m discriminating and can be sued. So the only real solution is to….stop hiring people. That’s okay because with Obamacare fines looming over my head as well as increases in unemployment taxes, I’m reluctant to hire anyway.

    bamaLV:  no it’s beyond that.  Obama wants to replace the traditional white majority in this country with a “majority of people of color.”  Easiest way–open the Mexican border and let ‘em all in.  That’s what it’s really about.  He hates white people.

    I have a question about this.  If the court decides the AZ law is unconstitutional, then can other states pass the same laws?  Will the DOJ have to sue each state individually?

     French Nail:  So how did you feel about the Bush admin. where the ideas of the corporate elite were forced on “the collective” so the corporations could make a bigger profit margin every quarter?  There’s not much difference between Communism and Facism.  That’s why they hate each other so much.

    I think Obama is doing all this stupid stuff because he knows he can’t get a mass amnesty through so he’s trying to prove to the Hispanic leaders that he really is on their side.  I still say La Raza has a hit out on him if he can’t turn all the illegals into instant citizens.

    My husband and I had green cards for years, during which time he became a prof in a medical school. We came and went overseas multiple times, as I remember one could not stay out of US more than a year in order to keep our residency. For years the only thing we had to do was fill out a simple form each year and hand it in at the Post Office. Eventually, even that was phased out.
    We keep the old cards nostalgically, sometimes looking at our youthful mugs! We were always amazed at how simple and non invasive the whole process was.
    Nobody ever treated us any differently as permanent residents, and how showing a card one should be proud to carry can be called discriminatory is totally beyond my comprehension!
