No kidding folks. This is happening right here in what is left of Democracy in America. It seems that Barack I Love FISA Obama is practicing for his Planned borderline Communist government in Missouri–or so he thinks.

I was nearly speechless when I saw the video below. What a freaking thug Barack Obama truly is. We are worried about his Marxist Socialist pals? This is down righta Communist behavior! No wonder Putin and N. Korea’s “Dear Leader” think he’s swell. No wonder every whackjob failed fringe anti-democracy, anti-capitalism party from the 60s loves him.

The threat?: If somebody in Missouri does an Ad that Barack Obama deems “A Lie,” then the sheriff and the State Prosecutor are coming for you. And as we all know, when it comes to Barack Obama, EVERYTHING ANYBODY says is “A Lie,” even if it’s true.

This is one brutal press release for one brutal, deserving Chicago-Thug candidate. Bravo, Governor Blunt. You just said what we all think:

Gov. Blunt Statement on Obama Campaign’s Abusive Use of Missouri Law Enforcement

JEFFERSON CITY – Gov. Matt Blunt today issued the following statement on news reports that have exposed plans by U.S. Senator Barack Obama to use Missouri law enforcement to threaten and intimidate his critics.

“St. Louis County Circuit Attorney Bob McCulloch, St. Louis City Circuit Attorney Jennifer Joyce, Jefferson County Sheriff Glenn Boyer, and Obama and the leader of his Missouri campaign Senator Claire McCaskill have attached the stench of police state tactics to the Obama-Biden campaign.

“What Senator Obama and his helpers are doing is scandalous beyond words, the party that claims to be the party of Thomas Jefferson is abusing the justice system and offices of public trust to silence political criticism with threats of prosecution and criminal punishment.

“This abuse of the law for intimidation insults the most sacred principles and ideals of Jefferson. I can think of nothing more offensive to Jefferson’s thinking than using the power of the state to deprive Americans of their civil rights. The only conceivable purpose of Messrs. McCulloch, Obama and the others is to frighten people away from expressing themselves, to chill free and open debate, to suppress support and donations to conservative organizations targeted by this anti-civil rights, to strangle criticism of Mr. Obama, to suppress ads about his support of higher taxes, and to choke out criticism on television, radio, the Internet, blogs, e-mail and daily conversation about the election.

    What stuns me about the video is the way the media handled it. No surprise, no questioning, no suggestion that there might be another point of view. Especially the part where they say these prosecutors and sheriffs will be “telling people Obama is for cutting taxes for people making less than 250,000 a year.” And the one prosecutor has an Obama sticker clearly visible on the door behind her.

    At a rally at a NC university this weekend, Obama’s campaign banned all signs, claiming security concerns. I believe that some university officials objected, saying that Obama was trashing their free speech rights. I know the Obama campaign pulled this same Gestapo tactic in Germany at the One’s big rally, but now he’s trying to get away with this in the USA? Does anyone have the link?

    The U.S. Code (Title 18, Crimes) has a specific name for this.

    § 241. Conspiracy against rights

    If two or more persons conspire to injure, oppress, threaten, or intimidate any person in any State, Territory, Commonwealth, Possession, or District in the free exercise or enjoyment of any right or privilege secured to him by the Constitution or laws of the United States, or because of his having so exercised the same; or

    Governor Blunt’s press release uses the specific words “using the power of the state to deprive Americans of their civil rights,” “intimidation,” and “silence political criticism with threats of prosecution and criminal punishment.”

    Any attorneys who read this, could you weigh in on whether, assuming that Governor Blunt’s allegations are proven, this constitutes a violation of the U.S. Code as shown above?

    Meanwhile, if these allegations are indeed true, then Barack Obama can be compared legitimately to Adolf Hitler. Godwin’s Law applies only when a comparison of a political opponent to Hitler or Nazis is a gross exaggeration, and “using the power of the state to deprive Americans of their civil rights” is exactly what Hitler and real Nazis once did to Germans.

    Now those action would put Castro to shame. Prosecuting people for lying was never in Castro’s repertory. He had to prosecute for actions, such as speaking against the regime. But not for lying. Prosecuting for lying is much better. And child can take their parents to court and imprison them for promising ice cream before bed and later denying it to them.

    I do not believe that the polls are outright wrong. I think they are skewed in Obama’s direction but they are not an out right fraud. For the polls to be even this close is unbelievable. How could anybody after looking at this guys history think that he is in anyway ready for primetime. Once again the electorate is being tricked into voting for an other Bush.

    I did not believe that GW could get elected in 2004 and people voted for him anyway. In 2000 Bush was given the presidency and what did we see in response from the voters. NOTHING They just bitterly excepted it and moved on. This must have turned a lots of heads as they realized that the electorate has become to fat and lazy and will not fight for their rights. They also realized that they can manipulated through the MSM into doing what ever they wanted.

    Now, 8 years later, with a war that should have never been fought, a non existent energy policy, the economy in shambles and 10 trillion in the hole (soon to be 11 trillion) we find our self with a man that could be even a bigger disaster then Bush.

    I truly believe that Obama is backed by Wall Street who want the US government to bail them out. Back in 2004 Bush did not make strong moves to avoid this disaster when it should have been apparent as to what was going on. He voted present on the economy much like Obama did last week with his infamous statement “They will call if they need me”. The Bush administration did not want to upset the apple cart that was keeping the economy from slipping into a recession and in the process made a lots of his so called friends extremely rich. However, the powers to be could see the financial meltdown coming a 100 miles away. Fannie Mae and Freddy Mac hired every lobbyist they could find so that any true oversight would be crushed. They were well aware that the house of cards was about to come crashing down. I don’t think even they expected for this to happen before 2009. They made a deal with the DNC to install Obama as President to do their bidding. You might ask if I have any proof for this. Well the proof is in the money trail. Wall Street has been giving large amounts of money to the democrats and especially to Obama at the same time they reduced their contribution to the republicans. They knew who they wanted in the White House. After all the Democrats have no problem with social programs and that is what this 700 billion bail out is. Obama is clueless and will do what ever he is told much like Bush is now. It was strange that the Democrats would agree to something that the Bush administration was pushing so willingly. The only reason they have not voted on it is because they want protection from the voters by forcing the republicans to vote for the bill as well.

    So if the electorate does not wake up another President will be installed and not elected. The news media has been bought and paid for and the anger from the left directed at Bush is used to keep the Democrats in line even though Obama went back on everything that he promised. He even said that he does not think any of the programs he wants to implement can be accomplished with the current financial situation. Further more he slaped the gay community in the face by campaigning with McClurkin. Plus his talk of tax cut for the middle class is just a ploy. Even if he pushes it through it will only mean at the most an extra $2000 pre family pre year and absolutely nothing for the bottom 40% of the population since they don’t pay income tax. Yes Wall Street might pay more in taxes but they rather do that and get a hold of $700 billion. After all they will be paying taxes with the money the government is giving them so for them it’s a win win. Health insurance program that Obama wants to implement will be a cash cow for the insurance companies by forcing every business to provide insurance for their employees.

    So here we are with 2000 all over again only now the Democrats are on the top and the Republicans are on the bottom but the game has not changed. We have a guy who has no experience and has no accomplishments except for getting elected to office. In 2000 it was much the same. The media was giving Bush a pass on everything. Did not ask him any difficult questions. Did not look into his DUI. Ignored everything from his past. Does that not sound so familiar. The only thing that has really changed is that they have gotten a lot better at it. That is why they could pass some one like Obama off to the public and have him be so close or ahead in the Polls.

    I really hope the McCain camp will be able to pull this off and flush the people who are behind this out. I am not a devoted McCain fan but the alternative is very frightening where you have the MSM and their backers determining who we will be voting for. At that point Democracy will seas to exist and going to the polls will be no different then sheep being led to the slaughter.

    I said this before but I am going to say it again…This is the kind of story the NYT used to cover. I said a bit more but I was upset so anyway…

    My parents and well my whole family lives in Missouri…I was raised there…If you have never been there it is full of small towns..very rural…I mean small towns with populations of 1200, some less some a bit bigger…Yes they have larger towns and a few big cities.. but there are Amish, small German towns…it is very middle America…and yes they feel they got took by Clair McObama…

    When I first read about this the other day I cried…yes my eyes teared up…to think Obama and his thugs were just taking over what little news these rural people got…yes you can get a dish but if you are outside city limits no cable television if the city even has cable..internet is like making a long distance phone call in most of the small towns…

    If you go to a church in the next town over chances are someone from even the next town over has internet and you meet up in the middle…sounds silly I know but I am telling you that is how hard it is to get information in these small communities. They get the alphabet soup channels but we all know how much they tell the whole story…right?

    Thanks for putting this up Uppity…I was hoping you would cover it…I was glad to see today that the Gov. had spoken out…I wonder how many other states this is happening in and they don’t have a TV station like the one in St.Louis who exposed them…how could we find out?

Imagine if Obama and gang had tried this is a state that had a governor who supported Obama. I doubt if the civil rights of anyone opposing Obama would have been protected. He is wanting people to be arrested and sent to jail for exercising their constitutional rights. Whoo! This is serious and no one in the MSM will cover it. How did our country come to this?

    Why don’t they tell who started the financial crisis that we are in now, (Jimmy Carter ring a bell), then in 1995 Clinton and his Democrats forced the banks to give a Trillion dollars worth of loans, that had no chance of being repaid.     Don’t get me wrong–I think this is absolutely horrifying.

    I’m a Democrat–NOT voting O. When I was teaching in a suburban high school, we all were lectured during the last Presidential election by our Administration. We were not to display campaign material or lecture in any way to influence students to our political opinion. It was unethical. I agreed wholeheartedly. A police officer displaying on police vehicles campaign materials should have action taken against him/her.

    Now, how did we get here? Karl Rove. Sorry Republicans. I am with you on this election, but you do bear some of the blame. Rove’s, Cheney’s, and their 527 group friends’ dirty, lying politics now makes some Democrats unable to think anything coming from a Republican is not dirty, They think ALL Republicans are liars. And they are unable to see the Democrats, whom they see as victims, as being liars and dirty politicians themselves.

    Had Colin Powell’s wife not nixed the idea he would have been the first serious candidate as VP for AA’s. Again I believe that the Republicans have the Dems beat. There is an article that shows that a majority of Republican voters would have voted for Powell. And I truly believe that they would have voted for the package (his beliefs and policies and the whole man) opposed to the Dems voting for Obambi for reasons that totally escape me other than his being “the first black” or just because he has a D by his name. Also in that poll 2 women, Rice and Dole had 18% each. Beginning to believe that Republicans have certain stances such as no gay marriage, but that they hold no ill will against people on an individual basis. Example Cheney’s daughter. He and Lynn do not believe in gay marriage but support and love their daugher, her life partner and their child. Palin made the Choice to have her other than perfect child but has not forced anyone else to bear a child they do not want. Palin may not believe in gay marriage but vetoed a bill that would have denied benefits and rights to gay partners. I think Obambi is a homophobe as he is a mysogonist and would deny gay rights as well as equal rights to women. McCain has never made a big deal about his campaign staff and their wages, but he has more women who make more than their male counterparts opposed to Obambi having fewer women in leading positions and paying all women less then men in those same positions.

    Those two prosecutors and any sheriff or judge who agreed with them to take part in this nutty endeavor could probably be charged with a violation of 18 USC 241 for violation of the person’s First Amendment right to petition his government and to free speech. That is the federal statute that federal prosecutors used to prosecute Koon and other police officers for beating up Rodney King.

    But you need the US Attorney in Missouri or the Dept of Justice, Civil Rights Division to go before a grand jury, obtain an indicment and choose to prosecute.

    If those two yahoos actually went out and arrested someone, I think they would be liable for monetary damages if the individual chose to sue them in a civil suit; the state or county also might be liable for money damages since the prosecutors have now publicly announced what they plan to do, using the authority granted to them either by the state, the city, the county or whatever governmental body is involved.

    i wonder what law school those two prosecutors graduated from and whether they are appointed or elected to office. i assume that they are in a district that is overwhelmingly pro-Obama or they would be voted out of office or recalled in any sane locality.

However, seeing the complete left wing bias of the media, I have begun to wonder in the last few weeks how accurate of a picture we have gotten about Bush in the last few years. He is the one man scape goat for everything now. After seeing what is being done by the MSM on behalf of Obama, I have no idea the accuracy of what has been reported about Bush. They add employees because their goods and services are being used and they need more employees to make those goods and services more accessible and convenient to the buyer. Nobody is going to lose their job. There will be more jobs because the quality of life for many Americans will increase and they will use goods and services that they previously didn’t have the means to purchase.

    If you’re a family making less than $250k, you’ll receive more money under an Obama administration. Or that perhaps those two prosecutors who must have gotten their law degree from the internet ever studied it?

    John Peter Zenger was born in 1697 in Germany, and migrated to New York as a child in 1710. His father died during the journey and his mother raised the child alone. He was accepted as an apprentice to New York’s only printer, William Bradford, until 1718. . . .

    Zenger and Bradford became partners in 1725 until Zenger started his own shop the next year. In 1733, former New York Attorney General, James Alexander, gave Zenger the opportunity to print America’s first party newspaper, the New York Weekly Journal.

    Zenger’s paper had been successful until he criticized William Cosby, Governor of New York, and the governor had him arrested and jailed. The jurors were stunned and didn’t know how to, or even if they were allowed to, address whether the law itself was “legal.”

    At the end of the trial on August 5, 1735, the twelve New York jurors returned a verdict of “not guilty” on the charge of publishing “seditious libels,” despite the Governor’s hand-picked judges presiding. Hamilton had successfully argued that Zenger’s articles were not libelous because they were based on fact. Zenger published a verbatim account of the trial as A Brief Narrative of the Case and Trial of John Peter Zenger (1736).

    “No nation, ancient or modern, ever lost the liberty of speaking freely, writing, or publishing their sentiments, but forthwith lost their liberty in general and became slaves” stated Zenger.

    Hamilton had served for free. In gratitude for what he had done, the Common Council of New York City awarded him the freedom of that city, and a group of prominent residents contributed to the production of a 5½-ounce gold box that was presented to him as a lasting mark of their gratitude. The box was preserved as a family heirloom for many years and is now in the possession of the Atwater Kent Museum near Independence Hall, Philadelphia.

    Each year the Philadelphia Bar Association presents a replica of the box to the outgoing Chancellor of the Association. A Latin motto inscribed on the box, identical to the original, is translated as “Acquired not by money, but by character.”

    Zenger died in 1746 at 48 years of age.

    Two houses with 1/8 of a mile of mine have proudly displayed their Obama signs for many months. Both signs are now worn and faded, but have remained there (without molestation or removal) for nearly nine months. I pass both signs every day.

    Two days ago, I traveled to the local GOP office to get my long-awaited McCain/Palin sign. Though I had called in advance and was told that I could get a whole stack to give to my enthusiastic neighbors, because of the exceptionally high demand it ended up that they could only give me one sign, which I happily accepted.

    After I placed my new sign on my property, any guess as to how long it lasted before it vanished?

    Less than 24 hours.

    As a former chief deputy state (and federal) prosecutor (and a graduate of the Career Prosecutor Course of the National District Attorney’s Association — mentioned only to point out that I wasn’t just passing through like many young attorneys — I took it very seriously), I can offer a few insights.

    Disagree if you like because, with respect to civil service regulations in particular, individual state provisions can certainly vary widely. But, on the rest. It’s a slam dunk.

    These two appear to be prosecutors, from the titles under their names on the screen, but they are not in any other sense of the term. Not only should they be ridiculed, they should be censured if not fired (and would be if they worked for me) and, if it were up to me (I’m not a citizen of Missouri or a client of either of these nuts), I would refer them to the Missouri State Bar for disciplinary action.

    They are an embarrassment to the profession.

    But, to the specific questions asked above (and please, someone chime in if you have something recent and relevant).

    #1. Violation of Civil Rights by State Action. Of course, this silliness is a violation of the statutes cited above (and others). To use the power of the state to deny a citizen any right guaranteed under the U.S. Constitution (look up “state action”) is a Sec. 1984 violation along with a host of other no-no’s. That’s a no-brainer. These aren’t lawyers threatening a lawsuit. These are government prosecutors. They ARE the government.

    Now, to more practical problems with this watchdog censorship group. Without even looking at the specific Missouri law they’re talking about using to bring these “lying” charges, there are some practical holes in this scheme large enough to drive a certain ego through.

    The charge is lying (presumably it’s called something more elegant but I use the term because we all know what it means). A criminal prosecution involves the elements of fact and intent.

    First, it has to be a lie. And the prosecutor doesn’t get to presume the proof before they’ve proved it. The judge or jury does that.

    So, let’s say one of these nuts “charges” someone with the offense (assuming it’s a misdemeanor and chargeable by a criminal “information” issued by the prosecutor — otherwise, they’ve got to go before a grand jury with this mischief — thus, the reason to involve the Police or Sheriff — these folks can make an allegation (themselves? the prosecutor is not ordinarily also the complaining witness/victim but what the hell, let’s give them that one and let them swear to their own complaint and issue their own information based on their own complaint — what they’re doing is no sillier than that on balance) and the Sheriff or Police Chief can go arrest the culprit, without any trial or showing at all (assuming they know who the culprit is — see more on this below).

    Anyway, ambling on, lying is the offense and, therefore, subject to proof. So, first, they have to prove the lie is a lie. In a political ad? Good luck. Second, they have to, I would hope and assume, prove intent.

    All told, they have to prove what was said, who said it (or, in this case, since it’s an entire campaign and probably an ad agency to boot, what cabal of conspirators said it), that it’s a lie and, if you get that far, that the person (or persons) directly responsible knew it to be a lie.

    We’re talking criminal prosecutors. Not somebody suing their neighbor because they said the guy’s wife was fat when, in fact, she’s quite svelte, in his opinion. Whatever. That’s not what this is.

    If it were, we’d let them go fight about it and the case would be over sometime after Chelsea Clinton’s second term. But, this is state action. This is criminal. People get put in jail for these things.

    These are state prosecutors. This is the government. It’s reprehensible. That is not what this country is supposed to be about but you see what people will do when threatened, or when they are so “invested” in something that they can’t see clearly any longer. There are limits and lines you don’t cross but you don’t see the lines anymore. They won’t be the first prosecutors to suffer from that affliction (certainly not the first attorneys, please). But, it has to be stopped and they have to be grabbed and shaken to come to their professional senses. Or, they need to go sell shoe laces on 7th Avenue, as a good friend used to say.

    On a personal note, the sight of these two law enforcement officials (which is what they are) threatening to prosecute people and, in the next breath, spouting off campaign platform and campaign worker talking points, was Alice in Wonderland (e.g., “We’re not only going to crack down on crime, we’re going to explain that our guy’s for lower taxes for everyone under 5′ tall.”)

    I thought it had to be a joke at first. SNL could have done it. It would be an improvement on their recent material. But, no, apparently it is not a joke. The Governor certainly didn’t appear amused.

    Next relevant question:

    #2. Civil Service Regulations. In most jurisdictions, including all with which I am familiar, state employees (I don’t know who pays the salaries of these people) are prohibited from engaging in any political activities at all (aside from exercising their personal rights to contribute to and support and, of course, vote for, the candidate of their choice) on state time (while working).

    The serious problem with these numbskulls is that they’re going far beyond merely putting a bumper sticker on their city, county or state vehicle (which is generally prohibited, at least in any jurisdiction I’ve even heard of).

    They are talking about using their official governmental offices to investigate and prosecute anyone they (as sole arbiters of fact and fiction) think is lying (and they’re not clear on this — does it apply to a lie told at the corner coffee shop, or only on television — how about the Web — how about national ads run on networks, by 527′s in other states or on national cable channels — this is interstate commerce, involving the federal government, the U.S. Constitution and the FBI).

    This is ludicrous if only from a practical standpoint.

    It gets worse. For example, are they talking about national ads by the campaigns? Both campaigns? Since the candidates are required now to acknowledge and expressly approve advertisements, does that mean these two yahoos are going to issue arrest warrants for John McCain (I would say “and” Barack Obama but it is obvious that this is not intended to police anything the Obama camp might say — only McCain — does the term “equal protection” mean anything?)

    Next, they use the term “lying” but in their statements, they refer to these “character attacks” so I’d suggest they are about to step into some perilously muddy water. What is a character attack? When is it a lie? Are these candidates public figures? Yes. Are the rules different for public figures? Yes. What on earth are these people thinking? Or, are they merely two loose cannons who nobody had the good sense to talk out of this nonsense?

    Finally. And I’ll assign this to my opinion though I suspect that some ethical cannons have been bruised if not trampled here. I’m not a member of the Missouri State Bar so I cannot speak for them. But, I certainly have an opinion.

    #3. Not only should they be fired, censured and otherwise dealt with by their employer, presumably the state or county government. In my view, these two should be referred to the State Bar of Missouri and disciplinary proceedings should be brought against both of them. My opinion is they should be disbarred but I’m a little tough in these areas and I don’t have a vote. But, that probably won’t happen and there are always at least two sides to a story. However, at a minimum, they should be severely reprimanded and placed on (Bar Association Judicial Council) probation. Meaning shape up and shut up.

    That’s my 2.5 cents worth.

    Palin did not cut funding for special needs education in Alaska by 62 percent. She didn’t cut it at all. In fact, she tripled per-pupil funding over just three years.

    She did not demand that books be banned from the Wasilla library. Some of the books on a widely circulated list were not even in print at the time. The librarian has said Palin asked a “What if?” question, but the librarian continued in her job through most of Palin’s first term.

    She was never a member of the Alaskan Independence Party, a group that wants Alaskans to vote on whether they wish to secede from the United States. She’s been registered as a Republican since May 1982.

    Palin never endorsed or supported Pat Buchanan for president. She once wore a Buchanan button as a “courtesy” when he visited Wasilla, but shortly afterward she was appointed to co-chair of the campaign of Steve Forbes in the state.

    Palin has not pushed for teaching creationism in Alaska’s schools. She has said that students should be allowed to “debate both sides” of the evolution question, but she also said creationism “doesn’t have to be part of the curriculum.”

    Today, I heard Obama’s radio ad saying that McCain opposes stem cell research and has a more extreme stance on this issue than George Bush. McCain SUPPORTS and voted FOR stem cell research. I guess you could say his stance is more extreme than Bush’s in a republican stand point since Bush is against it and McCain is for it!

    But threatening anyone with prosecutors and law enforcement has a chilling effect.

    Look at any dictatorship.
    It starts with what is and isn’t allowed to be aired, spoken, written about.

    The Obama campaign is trying to keep 527 ads from being aired in several states. Agree or disagree with the groups views – what happened to freedom of speech?

    You can dispute the truth of any matter. But not allowing people who disagree to have their say is a sign of dictatorship and oppression. Pick up a a history book. It’s not as though it’s never happened before.

    BTW Germany was a democracy too. Hitler used the democratic process to take over. By the time the opposition figured out what Hitler’s real goal was it was too late.

    Obama Wants NRA Ads Banned

    The Obama camp has been threatening television and radio stations to keep them from airing anti-Obama ads.

    The latest target is the NRA and stations in Pennsylvania.

    Earlier this week, the National Rifle Association’s Political Victory Fund released a series of radio and television spots to educate gun owners and sportsmen about Barack Obama’s longstanding anti-gun record. In response to the NRA-PVF ads, a clearly panicked Obama campaign and the Democratic National Committee (DNC) are doing everything they can to hide Obama’s real record by mounting a coordinated assault on the First Amendment.

    They have gone to desperate and outrageous lengths to try to silence your NRA by bullying media outlets with threats of lawsuits if they run NRA-PVF’s ads.

    This week, Obama’s campaign general counsel Bob Barr wrote to stations in Pennsylvania seeking to censor the ads.

    Old Media Pushes False ‘Rape Kit’ Charge Against Gov. Palin

    At least since September 8 the extreme left has been pushing a lie that Governor, then Mayor, Sarah Palin “charged rape victims for rape kits” performed upon them in the Alaskan town of Wasilla. The charge stems from a May 22, 2000 article in the local Wasilla paper The Frontiersman and has been spun from a comment made by the Wasilla Police Chief. This comment was somehow made into a Sarah Palin policy.

    Evidence of the incident, though, shows no involvement by Palin at all.

    Still, many Old Media outlets continue to keep illegitimately linking this rape kit billing claim to Sarah Palin, even though the truth is easily discovered.

    As mentioned first up was The Frontiersman story from 2000. In that story Police Chief Fannon was quoted as standing against legislation that would force local municipalities to pick up the costs of rape kits being performed. In the interview Fannon said that, upon conviction, he favored the criminals being charged for the costs.

    After Palin was picked to be VP, on September 8, a blog called Americablog found the old story and brought it up as evidence of “a rather nasty window into Sarah Palin.”

    Americablog is run by a man named John Aravosis, a Democratic strategist, sometimes gay activist, and Washington D.C. lawyer who once worked for Alaska Senator Ted Steven before he, Aravosis, formally switching to the Democratic Party.

    Later that day The Daily Kos also picked it up and from here it began to morph even further adding false claims to the story. In one of those additions to the story, Kos blogger Steven R claimed that Palin hired Police Chief Fannon because he was in favor of charging rape victims for rape kits.

    Steven R said he was “Pro-Charging Rape Victims for their OWN TESTS!!!” (bold in original). I cannot find this claim anywhere prior to the meme being picked up by the Old Media echoing this Kos diarist.

    From here the Old Media began to pick up the charge that Palin had put in place or at least agreed with this charging of victims policy.

    On September 12, for instance, The L.A. Times repeated the charge.
    “When Sarah Palin was mayor of Wasilla, the city billed sexual assault victims and their insurance companies for the cost of rape kits and forensic examinations.”

    The L.A. Times also helped further the warped claim that made it seem that the only Alaskan town that charged victims for rape kits was Palin’s Wasilla.
    “Then-Gov. Tony Knowles said Thursday that Wasilla was unique in the state in charging rape victims for costs incurred by law enforcement in trying to solve the crime.”

    This charge then began to appear in all sorts of opinion columns, blogs and in the comments sections of many of the Palin stories in papers all across the country.

    On September 21, the Chicago Tribune repeated the tale, as well. The Chi Trib tried to spin this tale into one that made Palin notorious in the Alaska State Legislature over the practice.

    “While she was mayor of Wasilla, her town was the only one in Alaska that required rape victims to pay for their own forensic tests. Charging victims for the “rape kits” necessary to collect evidence and convict sexual predators was a “cost-cutting” measure that continued until complaints about her administration’s policy prompted the Alaska State Legislature to pass a bill that banned this anti-victim practice statewide.”

    Many other papers also mention that Palin charged victims for their own rape kits. Papers such as Denver Daily and Philadelphia Weekly, for instance.

    There are far more than the few I mention here.
    So, the impression all these stories leave us with is that the town of Wasilla was a major impediment to passage of a bill in the state legislature that would end the policy of charging rape victims for their own rape kits being administered.

    We are told that “Palin charged rape victims” and we are told that she hired a new police chief because he also wanted to charge victims. One would think that if all this were true, Palin would have been all over Alaska’s news in the year 2000 because of it. But, in reality, none of these charges can be found and Jim Geraghty of NRO has done a little investigative work to prove it.

    Geraghty looked to see how often Wasilla and Palin were mentioned in the debates about the rape kit bill. But he finds that there is not one mention of the town of Wasilla in the hearings over the bill.

    Far from being the mayor that had “complaints about her administration’s policy” (as the Chi Trib says) being the one forcing the state legislature to pass the law, Wasilla is not mentioned at all in the debates about the bill.

    Geraghty also could not find a single instance of a rape victim ever having been charged for her own rape kit.

    To clarify: In preparation to attend a hearing and support the bill, one of the state’s top law-enforcement officials found no case of a rape victim ever being charged.

    And roughly a month after 30 Democratic lawyers, investigators, and opposition researchers, not to mention reporters from every major news agency in the country, landed in Alaska, we still have no instances to consider.

    For her part, Palin spokeswoman Maria Comella has said that the governor “does not believe, nor has she ever believed, that rape victims should have to pay for an evidence-gathering test.”

    Yet, the media still repeatedly bring this false charge up at every possible opportunity. Geraghty is right. The Old Media and the Obama campaign owes Palin an apology.

    The Complaint Process

    Anyone who believes that a lawyer has engaged in unethical conduct may file a complaint with the Office of Chief Disciplinary Counsel. The complaint will be screened to determine whether the matter is the proper subject for a disciplinary investigation. If not, the complaining person (the complainant) will be notified and no file will be opened.

    In some instances it is appropriate to refer the complainant to the Complaint Resolution Program or Fee Dispute Resolution.

    Once a file is opened, the complaint will be investigated by the Office of Chief Disciplinary Counsel or by a Regional Disciplinary Committee. The investigation may be entirely in writing, or it may involve telephone calls and personal interviews.

    To assist in the investigatory process, the Chief Disciplinary Counsel has authority to issue subpoenas for documents and witnesses to testify under oath.

    Based on the results of the investigation, the Chief Disciplinary Counsel will take one of the following three actions:

    * Close the complaint file upon a finding that no violation occurred;
    * Issue a written admonition (becoming part of the lawyer’s record) if it is determined that a minor violation occurred; or
    * File a legal document, called an Information, if it is believed that a serious violation by the lawyer has occurred. The Information sets out the charges being made against a lawyer. If this happens, there will be a hearing at which a complainant may be required to testify.

    The complainant will be notified of the action taken.

    Apologies for not answering some questions earlier, was looking up work permit and political asylum information for France.

    Okay, much of this has been covered above and all now have the State Bar of Missouri addresses and rules.

    Here’s the skinny, subject to other comments, of course.

    These prosecutors are two things, wearing two hats, if you will. They are attorneys (saddens me to say it but yes). As such, they are subject to the Cannons of Ethics and Disciplinary Rules of the State Bar. Now, a tricky twist in the stream of logic: The State Bar (pointed out above) is an Association. It is allowed (sort of) to police itself as an unspoken exception to some other requirements not relevant here.

    However, the entity that actually “admits” attorneys to practice is the Supreme Court of the State of Missouri (and other states, as well — perfectly normal). In which case, it is also the Supreme Court that “un-admits” (i.e., disbars) attorneys and under which the Office of Chief Disciplinary Counsel falls. That’s why the address for lawyer complaints is @ the Supreme Court, not the Bar Association.

    Having said all that, I wouldn’t worry about the formalities and the ins and outs. Having been formerly quite involved in another state’s Bar Association, I can assure you that a barrage of letters, phone calls and/or e-mails to State Bar Headquarters will stir up the hornets quite nicely.

    Now, that’s to get it STOPPED.

    And, don’t forget, you’ve got the Governor of the state behind you. And the might of the U.S. Constitution. How often people (for instance, Mr. Obama) forget that. It’s still there, standing at the doorway, holding it open for freedom so the thugs like him can’t slam it shut and have their way with the country behind closed doors. It has survived worse than this and this pipsqueak, it can also handle. If it is unleashed and allowed to do its job.

    Okay, that’s the lawyer part. Yes, a formal complaint can be filed as well as just “getting in their face” (or, in this case, ears) but, for now, they need to hear from people, without too much focus on form or procedure. And, truthfully, my guess is that the Bar wants to hear from you/us. This image being blasted out across the nation is not good PR for attorneys from Missouri. So, if you write, or call, or send fruit baskets, I’d assume that you’ll get a sympathetic ear. If you don’t, cut loose. No problem there.

    As for the second hat.

    These people are also prosecutors. They stand in a very different place. They are officers of the court. People might believe the Chief of Police or Sheriff are the highest ranking law enforcement officers in the county, but not so. It’s the District Attorney.

    These two human fruitbaskets (the two prosecutors) work for the County prosecutor (unless they are the county prosecutor, in which case it’s worse than I thought). [Now, it's possible that they are state prosecutors, working directly for the Attorney General's Office but there are very few of those -- lots of Assistant AG's, yes, but not prosecutors -- that is left to the counties in most places, unless Missouri is different.]

    These people represent the state. They are the government. When they read off the case in court, it’s “The People of the State of Missouri” or wherever vs. “Sleazy Criminal X” for example.

    So, there is another entire area here aside from their professional certification. They are the state. They are using threats of prosecution (translate: persecution) in the same press interview with campaign slogans of a political candidate and, essentially, saying “We like this candidate and if you say anything about him, we’re prosecutors and we can and will prosecute anybody we think is doing any of this “character assassination” against this particular candidate that we both like a lot.”

    The code sections questioned earlier are applicable, yes. Sorry for taking so long to answer. But, those apply to any person (or group, for conspiracy) engaging in the conduct prohibited by those statutes. It would apply if you or I did those things.

    Again, to beat it to death, these are state officials. They have the enormous power of the prosecutor’s office behind them. As pointed out earlier, for certain alleged crimes, they can have you arrested on their affirmation alone. And, they are immune from civil suit for any act they take as a prosecutor. You can’t sue them (I know, there are exceptions, but so rare as to be meaningless).

    That’s where Title 18, Sec. 1983 comes in. “State action” to deprive someone of a recognized civil right. That is when you get the U.S. Attorney General involved and the FBI and all that.

    So, if you’re all tired of me by now, I’ll shut up.

    What to do with all of this meandering information.

    Yell.

    I’m serious, actually.

    But, you ask, to whom.

    Just the places mentioned by others above.

    Thank Governor Blunt for his courage. He might need it again to go further so we should thank him and let him know he did the right thing.

    Call, e-mail (if you can find some individual e-mail addresses, I’ll look but didn’t think to before) or write to, the State Bar of Missouri AND the disciplinary Council’s office at the Supreme Court Building (address is listed above).

    Cover up FOX and CNN and the rest (I always hit all of them — who knows — even Rip Van Winkle woke up eventually) with this story.

    Finally, write to the Attorney General of the United States, Civil Rights Division. And, though it’s not exactly voting related, I think I’d start with the Voting Rights Division only because I expect they’re more attuned to what’s up (and are very aware of the ACORN violations, for example). That would be:

    Please investigate the following persons. Bob McCulloch and Jennifer Joyce, Jefferson County Sheriff Glenn Boyer, Barack Obama and David Axelrod. In my opinion their threats violated Federal Civil Rights laws. McCulloch and Joyce, and Boyer, three public authorities might well be forcing a “chilling effect” on 1st Amendent free speech. If Barack Obama or any of his people have any fingerprints on this, they should be prosecuted as well.

He chose not to slam Obama on the bailout eventhough he clearly could – he chose restraint because I think he would rather win in the Senate getting the right bailout legislation (ie without the ACORN earmark) than win on this point here at the debate.

    There are good and bad people on both sides and I wish people would quit pointing the finger at Republicans like the Democrats are saints-they aren’t. The fact is the Republicans wanted oversight for Fannie Mae and Freddie Mac, Democrats didnt. Democrats wanted minorities, low income and people not even legally allowed to be in the US to have homes they weren’t qualified for, couldn’t afford and did not have the accountability to take care of. Consequently, they lost a home they never should have had. They all are going to find someplace to rent while the rest of us clean up the mess. I believe Mac to be moderate and Bill Clinton was too. He wanted accountability and that is why he was not liked and likely alot of reason Democrats didn’t want Hillary as the nominee. She felt people should work for what they want and the Democratic party doesn’t.

    We need to get to work and make sure Obama doesn’t get near the White House. I can’t imagine something as hateful as Michelle Obama representing this country as First Lady. No thanks. I am working the week before election day and on election day. I also donated another $25 to John McCain and Sarah Palin yesterday. Do what you can even if it is just sharing your knowledge. Alot of people are COMPLETELY OBLIVIOUS to what is going on w Obama. A friend told me last night “yea but Obama doesn’t take money from lobbyists”. I said ” you’re kidding me?? He is the 3rd biggest receipient of lobbying money from Fannie Mae. And Chirs Dood, a Democrat, head of the banking committee has received the most, $13 million. Then he started talking about what the news says. I said they are all in tghe tank for Obama, they are not telling the real story.

    Barrack was obnoxious rude and constantly trying to interrupt and very unpresidential.

    John McCain was solid nuanced and controlled.

    Have I gone insane, or is KMOV in St. Louis, Missouri, actually reporting that “Senator Barack Obama’s presidential campaign is asking Missouri law enforcement to target anyone who lies or runs a misleading television ad during the presidential campaign”?

    The report goes on to say that “prosecutors and sheriffs from across Missouri are joining something called the Barack Obama truth squad.”

    Look, politicians are all about lies. It may be annoying (I find it entertaining), but that’s for their opponents and good-government groups to counter — not law enforcement. That’s especially true since whether or not criticism is “misleading” is open to debate. What’s being said may be simply a different interpretation, a bit of spin — or a better version of the truth than candidates and their friends like.

    Even if the officeholders joining the “truth squad” are nominally stepping out of their official roles in order to put on their (political) party hats and play politics, it’s inappropriate. They wield too much power to use it to wag their fingers at people who say un-nice things about political hopefuls. Prosecutors and sheriffs are, after all, normally thought of as people with the clout to put their targets behind bars.

    Somebody, please drop me a note to tell me that the station has it all wrong.

    By the way, if the report is accurate, it fits all too well with the legal threats the Democratic candidate’s campaign is leveling against TV stations that run NRA ads critical of Barack Obama. John Lott, a noted economist and firearms scholar, has copies of the Obama campaign’s cease-and-desist letters on his Website. He also defends the content of the ads (emphasizing the debatable nature of “misleading.”)

    What was really frightening in the video is that the law enforcers didn’t seem to think that there was anything wrong with what they were doing. Obama’s camp also seemed brazen in admitting that this is what they were doing.

    I see lawsuits on the horizon but I don’t know if they will have any effect because of the timing.

    What purpose is served exactly by reporting on details of Sarah Palin’s pregnancy and labor, or her daughter’s pregnancy? What purpose is served by suggesting Sarah Palin be gang-raped by Sandra Bernhard’s “big, black brothers”? What purpose is served by calling Palin “trailer trash”, mocking her accent, hair style and glasses?

    Perhaps this is an attempt to intimidate Palin and any other woman who might choose to run for public office? Because it is all completely irrelevant as far as Palin’s ability to perform as vice-president.

    I think a big part of Obama’s reason for running for president is to stop the Rezko investigations. If he is elected, all federal prosecutors will be replaced. That is the way it is always done. Patrick Fitzgerald will be fired, and Tony Rezko might meet with an unfortunate accident, commit “suicide” or have a sudden heart attack (a more modern version of sleeping with the fishes.)

Notice that the public prosecutor states that Missouri officials will be joining Obama’s Truth Squad to remind Missourians that Barack Obama is a “Christian.”Does that mean that Missouri police will threaten and possibly arrest anyone who questions Obama’s religion? If Missouri public officials are SO concerned about truth-in-advertising, why don’t they open a non-partisan Truth Squad to review ALL ads?
    ALSO, be aware that the Obama campaign has sicced its legal team on stations in Pennsylvania and Ohio, urging them to refuse to broadcast NRA ads attacking Obama’s anti-gun positions. I’d like to see the results of Obama’s efforts thus far to intimidate media outlets; have any refused the ads? Public officials running for elected office are fair game when it comes to speech, the normal definition of libel does not apply. The Obama campaign knows that they have no legal basis to challenge critical speech and they don’t care; their actions are designed to get results via intimidation. The Missouri officials should be fired.

    UPDATE 2: How ironic that Obama supporters tell me how fearful I should be of Supreme Court appointments under a McCain adminsitration, when Obama himself has ZERO respect for the First Amendment.
