TSA, Don’t Touch My Junk

This week marks a watershed moment for TSA and it is not good. The bullshit inspections being conducted at passenger screening checkpoints are becoming a point of anger for a growing number of Americans who resent the capricious, inconsistent and mindless execution of a policy designed to make air travel more safe. [These events took place roughly between 5:30 and 6:30 AM, November 13th in Terminal 2 of the San Diego International Airport. I'm writing this approximately 2 1/2 hours after the events transpired, and they are correct to the best of my recollection. I will admit to being particularly fuzzy on the exact order of events when dealing with the agents after getting my ticket refunded; however, all of the events described did occur.

This morning, I tried to fly out of San Diego International Airport but was refused by the TSA. I had been somewhat prepared for this eventuality. I have been reading about the millimeter wave and backscatter x-ray machines and the possible harm to health as well as the vivid pictures they create of people’s naked bodies. Not wanting to go through them, I had done my research on the TSA’s website prior to traveling to see if SAN had them. From all indications, they did not. When I arrived at the security line, I found that the TSA’s website was out of date. SAN does in fact utilize backscatter x-ray machines.

I made my way through the line toward the first line of “defense”: the TSA ID checker. This agent looked over my boarding pass, looked over my ID, looked at me and then back at my ID. After that, he waved me through. SAN is still operating metal detectors, so I walked over to one of the lines for them. After removing my shoes and making my way toward the metal detector, the person in front of me in line was pulled out to go through the backscatter machine. After asking what it was and being told, he opted out. This left the machine free, and before I could go through the metal detector, I was pulled out of line to go through the backscatter machine. When asked, I half-chuckled and said, “I don’t think so.” At this point, I was informed that I would be subject to a pat down, and I waited for another agent.

A male agent (it was a female who had directed me to the backscatter machine in the first place), came and waited for me to get my bags and then directed me over to the far corner of the area for screening. After setting my things on a table, he turned to me and began to explain that he was going to do a “standard” pat down. (I thought to myself, “great, not one of those gropings like I’ve been reading about”.) After he described, the pat down, I realized that he intended to touch my groin. After he finished his description but before he started the pat down, I looked him straight in the eye and said, “if you touch my junk, I’ll have you arrested.” He, a bit taken aback, informed me that he would have to involve his supervisor because of my comment.

We both stood there for no more than probably two minutes before a female TSA agent (apparently, the supervisor) arrived. She described to me that because I had opted out of the backscatter screening, I would now be patted down, and that involved running hands up the inside of my legs until they felt my groin. I stated that I would not allow myself to be subject to a molestation as a condition of getting on my flight. The supervisor informed me that it was a standard administrative security check and that they were authorized to do it. I repeated that I felt what they were doing was a sexual assault, and that if they were anyone but the government, the act would be illegal. I believe that I was then informed that if I did not submit to the inspection, I would not be getting on my flight. I again stated that I thought the search was illegal. I told her that I would be willing to submit to a walk through the metal detector as over 80% of the rest of the people were doing, but I would not be groped. The supervisor, then offered to go get her supervisor.

I took a seat in a tiny metal chair next to the table with my belongings and waited. While waiting, I asked the original agent (who was supposed to do the pat down) if he had many people opt out to which he replied, none (or almost none, I don’t remember exactly). He said that I gave up a lot of rights when I bought my ticket. I replied that the government took them away after September 11th. There was silence until the next supervisor arrived. A few minutes later, the female agent/supervisor arrived with a man in a suit (not a uniform). He gave me a business card identifying him as David Silva, Transportation Security Manager, San Diego International Airport. At this point, more TSA agents as well as what I assume was a local police officer arrived on the scene and surrounded the area where I was being detained. The female supervisor explained the situation to Mr. Silva. After some quick back and forth (that I didn’t understand/hear), I could overhear Mr. Silva say something to the effect of, “then escort him from the airport.” I again offered to submit to the metal detector, and my father-in-law, who was near by also tried to plead for some reasonableness on the TSA’s part.

The female supervisor took my ID at this point and began taking some kind of report with which I cooperated. Once she had finished, I asked if I could put my shoes back on. I was allowed to put my shoes back on and gather my belongs. I asked, “are we done here” (it was clear at this point that I was going to be escorted out), and the local police officer said, “follow me”. I followed him around the side of the screening area and back out to the ticketing area. I said apologized to him for the hassle, to which he replied that it was not a problem.

I made my way over to the American Airlines counter, explained the situation, and asked if my ticket could be refunded. The woman behind the counter furiously typed away for about 30 seconds before letting me know that she would need a supervisor. She went to the other end of the counter. When she returned, she informed me that the ticket was non-refundable, but that she was still trying to find a supervisor. After a few more minutes, she was able to refund my ticket. I told her that I had previously had a bad experience with American Airlines and had sworn never to fly with them again (I rationalized this trip since my father-in-law had paid for the ticket), but that after her helpfulness, I would once again be willing to use their carrier again.

At this point, I thought it was all over. I began to make my way to the stairs to exit the airport, when I was approached by another man in slacks and a sport coat. He was accompanied by the officer that had escorted me to the ticketing area and Mr. Silva. He informed me that I could not leave the airport. He said that once I start the screening in the secure area, I could not leave until it was completed. Having left the area, he stated, I would be subject to a civil suit and a $10,000 fine. I asked him if he was also going to fine the 6 TSA agents and the local police officer who escorted me from the secure area. After all, I did exactly what I was told. He said that they didn’t know the rules, and that he would deal with them later. They would not be subject to civil penalties. I then pointed to Mr. Silva and asked if he would be subject to any penalties. He is the agents’ supervisor, and he directed them to escort me out. The man informed me that Mr. Silva was new and he would not be subject to penalties, either. He again asserted the necessity that I return to the screening area. When I asked why, he explained that I may have an incendiary device and whether or not that was true needed to be determined. I told him that I would submit to a walk through the metal detector, but that was it; I would not be groped. He told me that their procedures are on their website, and therefore, I was fully informed before I entered the airport; I had implicitly agreed to whatever screening they deemed appropriate. I told him that San Diego was not listed on the TSA’s website as an airport using Advanced Imaging Technology, and I believed that I would only be subject to the metal detector. He replied that he was not a webmaster, and I asked then why he was referring me to the TSA’s website if he didn’t know anything about it. I again refused to re-enter the screening area.

The man asked me to stay put while he walked off to confer with the officer and Mr. Silva. They went about 20 feet away and began talking amongst themselves while I waited. I couldn’t over hear anything, but I got the impression that the police officer was recounting his version of the events that had transpired in the screening area (my initial refusal to be patted down). After a few minutes, I asked loudly across the distance if I was free to leave. The man dismissively held up a finger and said, “hold on”. I waited. After another minute or so, he returned and asked for my name. I asked why he needed it, and reminded him that the female supervisor/agent had already taken a report. He said that he was trying to be friendly and help me out. I asked to what end. He reminded me that I could be sued civilly and face a $10,000 fine and that my cooperation could help mitigate the penalties I was facing. I replied that he already had my information in the report that was taken and I asked if I was free to leave. I reminded him that he was now illegally detaining me and that I would not be subject to screening as a condition of leaving the airport. He told me that he was only trying to help (I should note that his demeanor never suggested that he was trying to help. I was clearly being interrogated.), and that no one was forcing me to stay. I asked if tried to leave if he would have the officer arrest me. He again said that no one was forcing me to stay. I looked him in the eye, and said, “then I’m leaving”. He replied, “then we’ll bring a civil suit against you”, to which I said, “you bring that suit” and walked out of the airport.

I will put up a post tomorrow detailing what should be done. What is clear from these two incidents is that we have reached a tipping point. Americans are no longer willing to surrender their civil rights in the name of bogus security practices.

    I’m sorry this is pure BS.  Since when do American citizens submit to what looks and sounds like a damn police state?  The vid of the three year old is outrageous.  Anyone who has raised kids knows that many children don’t liked to be touched/groped by strangers and kids can get cranky very easy.  To terrorize a small child in the name of so-called security should be the tipping point to Hell.

    Btw, I’ve never liked the idea of these body scans.  I think they’re an absolute invasion of privacy and the Government swore up and down that the images [that are far more detailed than people were told] would never be stored.

    Now we know they lied.

    Larry, This is nothing compared to what I went through at ORD.  I went through the full body scanner as part of what I thought would be a routine screening process.  Before I went through, I had to remove everything, including my cotton pocket square, from all of my pockets.  As I had already removed my belt, shoes, and everything metal, this means that I was only wearing my shirt, trousers, undershorts (boxers, in honor of the Speaker of the House) and socks.  Every other carry on possesion that I had with me was going through the Xray machine,
    I stepped into the scanner and “assumed the position.”  There was a hum, and the female TSA operator exclaimed, “Holy shit, come and take a look at this!”  Male and female TSA officers ran over and gathered to take a look at whatever was appearing on the screen.  There was a lot of excited mumbling among them that I couldn’t quite make out.
    After about five minutes of this, a female TSA supervisor approached me and advised that I would have to follow her for “Further secondary screening, in private.”  I couldn’t imagine what further could be screened, as I was essentially naked under my empty-pocket clothes but, being a good citizen, I complied.
    Following the female supervisor, I was led to a small room, inside of which were four female TSA agents.  As I stood in front of the female supervisor and the four other agents, the supervisor said, “You’re packing quite a load there, partner (ponting below my waist), for such a small guy.  Drop’em and let’s see just exactly what you’ve got.”
    I was stunned, but with five armed agents facing me down, what could I do?  I “dropped “em,”  whereupon one of the TSA agents said, “Could be a clever concealment device, remember that Chinese guy with the full face mask.  Better check it out…”
    OK, OK, it didn’t really happen.  But what with stupid, poorly though out proceedures being executed by thousands of poorly-paid dim bulbs who think, as did one TSA screener at LAX who went off his rocker recently and ran screaming through the terminal, that they are “God,”  I just wanted to demostrate that the truth of what is happening at our airports nowadays is weirder than pretty much any story that I could make up off the top of my head.
    And with all of this rights violation of American citizens going on routinely every day at airports throughout the land, our Attorney General is agonizing about the right of KSM to a trial in the regular court system?

If they are, that would be the ultimate irony — checking everyone except the terrorist in a burka..I am being sarcastic but you get the point and Drudge is right when he says terrorists have won when moron TSA employees traumatize three year-olds.

    The TSA has opened an investigation targetting this guy from Oceanside, CA.

    “Michael J. Aguilar, chief of the TSA office in San Diego, called a news conference at the airport Monday afternoon to announce the probe. He said the investigation could lead to prosecution and civil penalties of up to $11,000.
    TSA agents had told Tyner on Saturday that he could be fined up to $10,000.
    “That’s the old fine,” Aguilar said. “It has been increased.”

    It would be laughable if it wasn’t so serious.

    Frankly I’m surprised California would allow this — for example I’ve noticed certain shoe polishing products can’t be shipped there, for crying out loud.

    The more I read these stories, the more I am convinced the TERRIOST is in the WH and flying around on Air Force One!!! I would never allow anyone to touch me in those places with full frontal hands except my DOCTOR!!  This is illegal and it is sexual assault.  Imagine the trauma, that rape victims go through having to be forced to this type of search.  INNOCENT AMERICANS BEING SEXUALLY ASSAULTED LEGALLY!! This must stop NOW!  Until we all demand it to stop, stop flying, stop allowing the search of our own bodies, it will never end.  I am seriously disgusted with all this BS!  IMHO, if they do attack us again, I truly believe they will not do it by air, maybe train, subways or malls.  And don’t you think the real terrorists are ROFL at us Americans for what WE are going through BC of 9/11 with all this BS we are having to go through?  They really did win when we have to live in a country like this!!

    Seriously, I will not take any personal trips by air any longer. In fact, instead of travelers protesting use of the machines and flying anyway, I believe the message would have greater impact if people would opt out of flying at all this season. It could be “The No-Fly Holidays.”  With tools such as Skype, people can visit via the internet and save a whole lot of money and hassle by refusing to fly at all. Between charging for bags, food and jacking the prices sky high (no pun intended) why bother flying when there are other, more economical ways to keep in touch?

    Whatever happened to “Give me liberty or give me death?” Oh, right, that has been replaced by, “Bend over, please, and have a nice day!!!”

    Bogus? That was years ago. Today its “out of control”. TSA is acting as if going to any airport for a domestic flight is like going through the customs zone where a US Citizen has very limited rights. What I also found extraordinary was the implication that the guy was carrying an incendiary devise without reasonable cause as an attempted excuse to detain him or send him back through the check point. Which also makes no sense since that was the cause of the problem in the first place. 

    The police officer here is also part of the problem. He has partial jurisdiction as well and he of all people should know better.

    The first video won’t oad referring to copyright; but I have to ask, are they really do this type of “search to a 3 yeard old? Not flying again, and God help them if they put their hands on my grandchildren. What about infants? I can’t get over the madness that is now being touted as a behavior we are suppose to accept, hell a police officer can’t do this( I don’t think), unless you are arrested. About anyone being allowed a pass on either type of body inspection via machine or groper, I call Bullshit. Just like everyone else you don;t get to travel either. Waiting to see what a hit the airline industry takes over this. I know, I know if you have nothing to hide.. but see I don’t and I still don’t think that anyone has a right to invade my privacy to this level for thesake of security. How about using your brains TSA, instead of your hands or a machine, lets see profile with a combination of known violent felons? Oh wait we wouldn’t want to tromp on their constitutional rights. Just like verything else, we all PAY, for what a few have done, whether it be buying beyond ones means, too lazy to take a job regardless, lying on taxes, or flying with bombs in ones underwear; yeah that makes sense, everyone has to be punished. Idiots.

    Just to show what our friendly nations think of these silly procedures:
    I was flying back from Frankfurt several years ago with a trade group, standing in line to go through security. The policy at the time was to conduct random searches of carry on baggage and questioning of passengers. I was selected ‘randomly’ for this procedure, which consisted of rifling through my suitcase and some perfunctory questions by a bored security type. I then noticed that there seemed to be a lot of Americans in my group which led me to inquire a bit of my fellow passengers. It turned out that all of the ‘random’ searches were Americans.
    It wasn’t that much of an inconvenience and the search ‘action’ was not directed personally at the passengers but even then our allies were making the point about silly, stupid, intrusive, unnecessary procedures.
    It’s about time we started pushing back on these faux security measures.

    Or we could start a “just say no campaign” against crotch bombing. We could put photos up like they want to do with cigarettes. “Warning, wiring an explosive device to your junk could be hazardous to your health.”

    Airports can opt-out of TSA  being their screeners and instead have a private screening company.  Seven airports have done it.  (Link below).

    I hope in “what should be done” you talk about the fact that we have a choice. That choice is to accept relinquishing some of our privacy rights and allow the TSA to know more about us before we even enter a terminal or know more about us as we go through a full body scanner and pat downs. I am sure that we are not far from cavity searches int he near future.

    Flying is a voluntary privilege and not a constitutonal right. The government and airports have a fundamental right to do whatever is necessary to maintain absolute safety in the air. We have to decide how best to achieve that.

    “We spend our child’s whole life telling him that only mom, dad, and a doctor can touch you in your private are, now we have to add TSA agents, and that is just wrong. At some point the terrorists have just won.” This quote was in response to his EIGHT YEAR OLD SON being ‘selected’ by TSA for a more intense ‘pat down’ because we all know second graders are a leading demographic in air terror.

    Annapolis Woman’s Child Taken By TSA In Atlanta

    UPDATE: The TSA has responded:
    TSA’s policy is that officers will not ask parents to do anything that would distance them from their children during the screening process. Our goal is to provide the highest level of security while ensuring that all passengers are treated with courtesy and respect. TSA is currently reviewing the circumstances involving the screening procedures for this family and will take appropriate action if necessary.
    There is not much we can add to this tale of a woman from Annapolis traveling with her infant son through Atlanta. The TSA separated her from her infant while they searched him and refused to heed her cries and pleas.

    Don’t argue that in a court of law. Especially in front of a jury. Rights are not abrogated by commerce, whether it be transportation of people, or whatever. We do not give up our rights to enslavement by a nation of crypto-fascists whether their wings hang to the left or right. The Patriot Act is fascist as Mussolini or Hitler ever dreamed. It is not those who lay down to be slaughtered who win freedom but those who fight to the last man, the last breath, and the last drop of blood. Your business as usual be damned, sir. We are not, yet, bound to heaven in cattle cars and we have not gven up the idea that free people act like free people, and treat one another like free people. This crap is just a bump in the road. We will overcome it, as we have other violations of civil rights and human rights. God Bless America!

    And, of course, since the body scanners DON’T SEE THROUGH SKIN, there is no way to know, unless a cavity search is conducted!

    This is a CRIME being committed by government employees. Start complaining to your Congressional Representatives about it. 

    Refuse to fly; if you must fly, refuse the body scanner, and force them to grope you, then write about your molestation to your Congressman/woman. Call their office and write them every day.

    It is apparently a false story. The TSA came up with video showing her going through the security process and at no time was she separated from her son. It took less than ten minutes for her to get through security. Here is the link to the story follow-up on Eye on Annapolis.

    I agree with your comment.  It seemed to me that neither of these parents possessed any natural instinct to protect their child.  Instead, the father/reporter’s commentary seemed apologetic on behalf of the TSA and sought to rationalize his daughter’s behavior.  It sickens me to see people who are so willing to give up their liberties for “safety” that they can accept any sort of intrusion on themselves, and worse, on their children.  Allowing their child to be violated in this manner at such a young age will naturally acclimate her to strip searches as a natural, normal part of life.  She will be trained to be as docile as, or more docile, than her parents in the face of authoritarianism.  I wonder if they would have tolerated a body cavity search on her.  Unfortunately, I suspect they might have all in the name of “safety.”

    I don’t understand how any man in this county can allow the TSA to literally hold them by their balls while taking nude pictures of their wife and children at the airports.

    In other words, if a man will not fight for the honor and dignity of his family, then he will not fight for anything. Hence, from the looks of things I’m becoming more convinced this once great nation is finished. That is, unless at some point we begin to fight like men, or should we allow ourselves to be fully enslaved?
