[Ohio Fraud Update] Open Thread * The Supremes May Hear Ohio Vote Case

Update: Here’s yet another, new Ohio vote fraud situation:

Ohio’s first-term Secretary of State, Jennifer Brunner, a Democrat who replaced the infamous Republican Ken Blackwell, has filed an “emergency appeal” with the U.S. Supreme Court. According to the news report I just listened to, when emergency appeals are filed, only one justice reviews the appeal. The justice for Ohio’s area is John Paul Stevens, considered by many to be the most liberal on the Supreme Court. (He’s also “up there” in years, and is one of the justices who conceivably may be replaced in the next eight years.) However, we shall see if he accepts the appeal, and then how he rules.

    If he is a liberal judge that is good for Obama. If it is a conservative judge that is good for McCain.

      I think if this goes to the Supreme Court, Obama will look like a fool trying to steal an election. It is common sense to want to make sure that all the votes are legit. By the way, the reviewing Justice is Stevens. That means it probably will go to court. Then again, maybe Stevens will see my point and throw the lady out of the courtroom.

            Hopefully, yes Brunner does get her corrupt rear end handed to her. We don’t need a second Katherine Harris. One was more than enough.

            I wish you had more info on whether it is a one justice call and that justice is Stevens.

            There certainly is a lot of room here for
            pay-back from the bench for 2000. But I don’t think that will happen. Especially since people like Ginsburg have class– which is why you don’t want to dis her.

              Despite the fact that you might not respect Thomas, you can’t call him a blathering idiot becuase the man never speaks. He is well known for NEVER asking questions in oral arguments and he wrotes few opinions.

              Neverheless, if this goes before the whole court, they will strike down the SOS attempt to count all these votes. I predict a 6-3 or 7-2 decision. It could even go 8-1 if Stecens decides it has merit. There is just too much time left to reslove the issue without infringing on the integrit of the election.

        That could well be. He must be concerned about Obama’s lack of experience, and he must worry that Obama never wrote an article for the Harvard law review.

        ALSO: It is GOOD to have liberals on the Supreme Court. It is justices like Stevens who have done much to advance legal rights and more. I am still a Democrat, and am probably voting 90+% Democratic when my ballot arrives. Just because I find Obama unqualified and believe that he and his thugs stole the nomination from Hillary doesn’t mean that I left my basic values behind.

            after completing a constitutional law class I have a new view of the SCOTUS, especially after Griswald, (cite?) the emminent domain case.

            The libs justices ruled it was OKAY to SEIZE a private persons land, home, to put in a strip mall or any other thing. It was in the past for roads, schools, hospitals only. They reinterpreted public good and benefit to mean ANYTHING the city council or mayor say will bring more tax revenue to the city.

            That is NUTS, wrong decisions and scalia and alito and roberts voted against it, but the ‘liberal’ justices I trusted pushed it through to my HORROR.

            also on 2nd amendment I am verry grateful as we see Obummer and his youth rallies and private police plans, that we were lucky enough to get the Constitutional right to bear arms upheld, I say that as a 20 yr Dem and bleedin heart lib.

            And another final word it was the CONSERVATIVE Justices who gave us the protection of RVW, a conservative bench made that ruling.

            It is not enough to apply our own liberla views and think that is how they will carry them out. I for one do not believe the city should be able to take my house and build another GD walmart or SRBX and say that sit he public good, but Ginsberg, Breyer, all the lib justices said it was appropriate and changed ALL our lives so that now anyone can come and take your house for any or alp reasons if city says yeah thatll get us more cash, plow down that post WWII community of single family homes!

            Nah, this argument has lost all weight with me now and I encourage others to look at the rulings and think freely on this issue :0)

          Justice Stevens is a sound Judge.
          He knows that the Constitution fails if there is fraud in the vote.

          If the court hears the case I believe that even the most liberal among them will see the necessity to insure the faith in the integrity of the vote.
          It will be easier for them to rule on this now then to have to ajudicate the result of a tainted poll.

          FOr the US this makes sense to hear the argument and rule unanimously in favor of the people and against Secretary of State Burnner

            I don’t know. The lefties might try to finagle the constitution to justify false voting. They certainly tried to stretch the commerce clause to include guns near school zones and argued that the founders were confused when writing the second amendment. If anything, this election shows how much we need our second amendment rights and how little we need the Ginsburgs and Breyers.

              You are SO full of it. Have you actually READ the Second Amendment? Read the ACTUAL WORDS. Show me where it guarantees the right of the INDIVIDUAL to own weapons.
              The TEXT reads “a well-regulated militia, being necessary”. It does NOT say, people have an unfettered right to own weapons.
              If you use the “strict constructionist” argument to the Constitution (a favorite of Scalia, Roberts, Thomas), then NO ONE who is not a part of the US military has no legal right to own a gun. One *could* extend that right to members of the National Guard, but that doesn’t fall within strict constructionism. Strict constructionism argues that if it is NOT explicitly stated in the Constitution, then it’s not a guaranteed right of the people. Of course, strict constructionism has a bit of a problem when it comes to the 9th and 10th Amendments–both essentially allow the Federal government to decide what rights it has and what rights the States and people have. And when the rights of the States and people are in conflict with the Federal gov’t, guess which set of rights takes precedence? If a state wants to let 16-year olds vote, it can do so, but ONLY for state and local elections; a 16-year old will not be allowed to vote for US congressmen or Senators, much less President. The Federal government allows each state to determine how to award electoral votes and it allows each state to determine how to punish “faithless” electors. Incidentally, had the “strict constructionists” actually voted that way in the 2000 Florida case, Dubya would NOT have been declared President for several weeks at least. The Court, under the Constitution, has NO business in deciding the Presidential race. Of course, the “strict construction” argument only works when its adherents stick to it in all instances, not merely when it’s “convenient”–that becomes little more than the “judicial activism” the “constructionists” so widely deplore.
              Incidentally, the NRA’s original purpose was SOLELY to promote gun safety, as it related to HUNTING. The NRA’s founders never argued for the “individual’s right to keep and bear arms”; that came only within the last 50 years.

                Respectfully, at the time, most people thought nothing of owning a gun. It was a necessity. They could not think of NOT owning one.

                  Go and read the opinion DC vs. Heller. It will show you that the word “people”, as used everywhere in the Constitution and the Declaration of Independence is in reference to the individual and not the collective people. And the placement of the amendment, as #2, sandwiched inbetween two undeniably indivudual rights of speech, religion, assembly and the quartering of troops.

                  That is the whole point of the Constitution — you do not sacrifice the rights of the individual for the good of the collective. If you don’t like, there are pother countries for you — China and Europe for example. But that is the way the founders intended it to be, and it will be a cold day in hell when we turn over the individual rights enumerated in the Constitution to the government.

                  Once again, if you want to argue the point, get some edumacation.

          Um, in NO WAY, does “conservative” = “individualist”, Andrew.
          Don’t forget that it was the “conservatives”, Scalia and Thomas, who voted to uphold Texas’s position in the Lawrence v Texas case. Do you REALLY believe that an “individualist” (which I take to mean someone who supports the RIGHTS of the INDIVIDUAL) would believe that the State has a right to be in your bedroom?
          And Roberts, Thomas, and Scalia all largely believe that a fetus (completely dependent on the mother) should have a “right” to life, a position that has NO basis in the Founding Fathers’ own beliefs (in the late 18th Century, wives and children–both born and unborn–were mere property of the husband; abortion was rarely performed–as in “almost never”–and a woman was as likely to die while giving birth as she was to survive the birthing process).
          As to your reactionary stance on the ACLU, I’d remind you that without that organization, you might find the government would have a much easier time delving into your private matters. Or maybe you’d enjoy the gov’t deciding that because a brief chat you’d had with someone 10 years ago you now merited having your phones tapped because you now posed a “threat” to national security. Maybe the fact that you simply went to the same school as some alleged terrorist and you shared a single algebra class for one year was worthy of the government’s arresting you for questioning and having all of your family and co-workers taken in for questioning. (Think that’s farfetched? Check out the reality that existed during the 1950s when McCarthy launched his “Red scare”. Hell, Lucille Ball was questioned for HER Communist “ties”. You know what those ties were? A RELATIVE of hers had BRIEFLY been–in the early 1920s!–a member of an organization with Communist ties but THAT was enough for the FBI to question Lucy’s loyalty.)

            The individualist argument has merit because they want the individual sovereign states to decide these issues. By extension, because the individual has more power at the lower levels of argument, the individual has a greater chance of sel-determination on these issues at the state and local levels of goverment. Therefore, conservative does equal individualist.

            The conservative justices don’t want to make abortion illegal — they want a greater control for the individual to determine these cultural issues in a diverse ad respectbale fashion for the many different cultural communities throught the nation. If you want to get rid of the culture wars, make the states have more power over these issues.

          Yes, just like the focus group of ‘undecided’ voters on FOX last night. If they were still undecuded before the debate, they would not have been swayed so easily as they implied they were. ‘Because Obama speaks well’ is something they already knew, how would that sway an undecided so late in the game?
          Those people were already Obama supporters.
          It’s all about the media, they control what information gets through. They know ahead of time that they are giving airtime to Obama supporters over McCain. Just like a courtroom, they don’t ask questions they don’t know the answers to.

      As a first step / gate keeper? I think the full court would hear the appeal if the gate keeper lets it through?

      I doubt the court will intervene even with a liberal judge as gate keeper considering the flack SCOTUS took when they took the Gore/Bush election case in 2000.

      It might actually help McCain if they take the case since it will rip open wounds from that contested election. Obama will have become Bush. Well he already is. :mrgreen:

Our Raleigh News-Observer had a front-page story, just under the debate story, about the Ayers petition that educators were signing….that numerous professors from my area (UNC-Chapel Hill, Duke AND NC State) had signed.     I am not an expert on Supreme Court rules, but if one justice denies an appeal I think there is more recourse. For example, rule 22 of the Sup Ct states:

    A Justice denying an application will note the denial thereon. Thereafter, unless action thereon is restricted by law to the Circuit Justice or is untimely under Rule 30.2, the party making an application, except in the case of an application for an extension of time, may renew it to any
    other Justice, subject to the provisions of this Rule. Except when the denial is without prejudice, a renewed application is not favored.

      More than likely, the case will be sent back down to the lower court for some technical reason, then bounced back to the Supreme Court in a delaying action so they don’t have to get involved until after the election.

      All Brunner has to do is keep appealing. It will take Stevens time to make a ruling and if the Repubs can then appeal… that’s it, game over, there factually will not be enough time to verify status. Interesting precedent for states with a large number of illegal aliens if Stevens believes it is not necessary to verify the right to vote.

          I saw your post about being young and concerned about the outcome of the election. The other night we were doing phone calls from local GOP, a young guy came in, turns out he was fulfilling a high school course requirement by canvassing for McCain. He turns 18 in December, so he can’t vote in this election.

          I jokingly asked the GOP coordinator if we could have ACORN come in and register the kid anyway!

          If you can take one thing away from this election, it’s that the MSM is not your friend. Our nation has had incidents in the past where bogus journalism has influenced public policy, going back to the days of W.R. Hearst and yellow journalism. After Watergate, the flavor of newspaper reporting changed, after all two newspaper guys had taken down a POTUS. Now the objective has evolved to MSM trying to create a POTUS.

The Paris Hilton ad mocked the celebrity meme. Mocking the ridiculous media line that O is Presidential and ready to lead is easy to mock.     Zero fines for those small businesses who do not enroll their employees in a mandatory health care plan that promotes ‘universal’ health care.

    There are so many lies in that answer is unreal.

    First it cancel universality. That’s exactly what Hillary said he would do. He would not make it universal.

    If universality is canceled then you do not get premium reductions. Period. Because the system remains a healthy group base system.

    Zero fines will simply cancel the objective and the promise of health care is rendered null and void. Everything else after that is hogwash.

    Employers with zero fines will obviously choose not to enroll their employees. Is that simple.

    The issue of tax credits that would apply to enrollments has not been explained at all. I suppose is another hoax.

    But if a 50 of the expense is refunded in a tax credit, then the cost would have to be offset by a huge tax increase or else it would be a prohibitive ‘entitlement.’ And it would be an entitlement since he said it would work as a ‘right.’

    And he ranted for entitlement reductions a few minutes before.

    I don’t think it would pass the court system for some business to be fines and others not and for some business to get credits and not others. He knows that and that’s why he is ‘lying.’

    Breaking News—-The trolls are out using strong arms!

    Had a guy come to my home office door- a tall half hispanic black guy-He looked like a Boxer in a boxing ring, but on the chunky side. He started asking me questions concerning a lost dog- as if I was going to fall for this crap. First, I live in a single homes for retirees and nobody is allowed to have children under the age of 18 living in the area. The guy said he just moved in with his wife and children in the neighborhood and lost his dog. That was the first mistake of the conversation. No children are allowed in my neighborhood. I was polite- but, he kept looking around checking out my home office from the open door. I knew he was not here to just look for his puppy- one of the worst excuses. Since I do have a nice personality I rapped with him on my porch about his “missing” dog. I observe him and knew that he was hired by someone to intimate me. Even though he doing his best to talk about his little lost dog (if you saw this guy- you know he would have a pitbull-not a toy poodle as he stated) but, I managed to smile and talk to him about the love of things concerning animals. I started talking to him about kindness and love -things that normally neighbors talks about and he became relaxed. I managed to get him to reveal who he was- he said he worked as a internal security man and did security surviellance at the Mall around ten miles from me. I purposely ask him for his phone to look at his puppy’s picture(which he had tried to show me in the beginning of our encounter)- of course this was to show him that I wasn’t scare to give him my fingerprints. Which I did, for I have nothing to hide for being a outspoken critic of Obama. What he didn’t know was that I took a piece of small paper and put it in my hands to get his fingerprints when he shook my hand. He was nice but nervous- but at the end he stated to me, “It looks like you might need a big man to protect you – you don’t know what might happen to you in the future.” And, he smile and put his hands up to show his strength while he walked to his car. He didn’t say this harshly as if it was to be taken as a joke… Nice man….but….I knew who he was…and why he has come to intimate me in a nice way…….So, I say to the NEW Party…..even if Obama becomes the President of the United States…I will continue to be your critic…your New Party’s disbursement of strong arms does not scare me….and that fingerprints that I gather shows you that we are aware of the socialist tactics that the NEW Party is doing just to elect you……by the way….while I looked at his phone showing his precious little phoney puppy story…..I managed to get his last four numbers 9430 on his cell……that is how fast my brain works when it comes to “awareness”.

    Thought I share this true story that took place 20 minutes ago at my house. So, to them….I just disbursed the fingerprints to a friend….try to intimate me again..     I’m trying to make sense of the RCP numbers. They show Obama trouncing McCain in every single swing state. 14 points in PA, 12 in MI, 5 in OH. Why does there numbers differ so much from Gallup and Zogby?

    Why is McCain even bothering in PA if he is down by 14 points?

      Their internals must show otherwise. Gov. Rendell said PA was still in play this week too. Zogby was more reliable in the last election cycle. It seems like they are all guessing this time around with increased registrations, cross-over votes, likely vs. registered, and weighting the polls according to their own agendas. I don’t think anyone really knows what’s going to happen. Don’t forget: Kerry was up 51 to 40 at this time, and in all the battleground states. Nov. 4th is all that counts.

    I just checked wiki on Stevens and he seems fairly moderate, toward conservative to me. I think he’ll rule fairly, if he agrees to hear the case at all.

    This whole Acorn thing is a non-issue and a waste of time. If you want to get Repulicans voted in focus on more important isssues.

    Just because some lazy voter registration person puts in a bunch of false names does not mean voter fraud. You actully need to have someone vote under those false names. No one can vote under those false names because they are false names and they would have zero ID to match those false names.

    Just because a bunch of false names were registered does not mean that a bunch of false or fraudulent votes were cast….

    Wasting your time and effort…..

      Except of course for the now known Vote From Home absentee ballots sent to individuals who do not reside in the state. Not much of anyone thinks these pro Obama activists were going to use those ballots for wall paper. Tip of the berg.

      There are many places that do not require picture id’s. If someone is provided forged documents, and the names were recorded (as has been reported), then people can be sent to different locales to vote repeatedly. You don’t think this is possible? I do.

        when McCain mentioned Acorn the Republican response on the audience meter on the CNBC and CNN debate meters went down with the independents and republicans on the meter… this means that not only do independents not like this issue, but also many republicans…

        it is a reason McCain is losing… this and Ayers turns people off… it is damaging…

        make the case on jobs, taxes, spending or whatever… not these BS issues… independents don’t care about this stuff….

    I have a question: if Brunner filed an emergency appeal, does that mean she is still bound to follow through on the other court’s order to provide them with an oversight system by the end of the week to check the registrations, or does it delay it? This is crucial, because if she can just run out the clock, those registrations will not be checked in time. Reportedly, she is holding back 200,000 questionable registrations! Bush only won Ohio by approximately 120-140,000 votes (I don’t have the figure with me now).

    To be filed under “suspicions confirmed,” patently partisan-for-Obama supporter Democrat Ohio Secretary of State Jennifer “I-never-met-an-ACORN-worker-I-didn’t-like” Brunner has stomped her feet and decided that she should not be required to do her job; that of protecting Ohio voters from election fraud. She has also decided that she will elicit help from the US Supreme Court in upholding her desire. There are over 200,000 already identified flawed and fraudulent new registrations, which Brunner has not only personally refused to check but, has advised local registrars that they may not check, either. These are voter registrations that Brunner has admitted she has been “hiding” from local election boards. And whence did these registrations come? You got it—ACORN!

    Note: With this admission, one can only surmise that the 200,000 registrations were given to Brunner directly by ACORN. Brunner and Obama’s other adherents are now actively working to subvert the US democracy. Of course ACORN is also the group that—despite his attempts to hoodwink the public into believing otherwise—Democrat presidential candidate Obama has worked with and heavily funded for years and the group that is currently under federal investigation for voter fraud in between 12-15 states.

    The FBI is investigating whether the community activist group ACORN helped foster voter registration fraud around the nation before the presidential election.

    A senior law enforcement official confirmed the investigation to The Associated Press on Thursday. A second senior law enforcement official says the FBI was looking at results of recent raids on ACORN offices in several states for any evidence of a coordinated national scam.

    The FBI should question Ohio Secretary of State Jennifer Brunner as well. She’s part of the problem!
