From what I understand , there's a special division of the DOJ that has jurisdiction and that's the Civil Rights Division. The Civil Rights Division is separate from the general "division" where all the US Attorneys are. The Civil Rights lawyers don't take orders from the President and have the discretion to do whatever they hell they want. And that these Lawyers are basically Democrat partisans. This has been a problem throughout Bush's term.. there were so many people held over from the Clinton years who were totally opposed to the new policies and quite a few of these folks (in the CIA, Dept of State, etc..) did their best to sabotage the implementation of policy they didn't like.
