Evan Peterson of the U.S. Department of Justice has stated no decision has been made to whether the government will file a response. (See below report).

It is most disturbing that the DOJ is even considering not responding. . .you do understand what that means, I hope. You see no sane attorney (or defendant) would ever risk not responding unless they know something. One can only assume there are unauthorized ex parte communications going on between the USSC and DOJ. Mr Berg must be a part of any such communications, if he is not they are prohibited. The Writ for Cert is not heard behind closed doors with only one party. Mr Berg should file a FOIA request and discovery request for all communication between the USSC and the DOJ on or about his WRIT for CERT. See below website:

Warren Throckmorton called the Office of the Solicitor General to ask if a response was planned by December 1. Evan Peterson emailed the following statement. So Mr. Berg’s odds don’t look good and it is unclear if the Solicitor General will get involved.

The case has NOT been dismissed. Justice Souter has the case and the Respondent has until December 1 to file a reply:

Will this case succeed? I doubt it, in this koolaid induced climate. But I applaud Berg for having the guts to try.

Objective Analysis

What people fail to realize is Judges (like in 1803 of Marbury v. Madison) are not drinking kool-aid. they have a rep to protect – THE US CONSTITUTION.

I think the intrigue of Obama having to reveal te following:

His long form birth certificate (Kenyan born)
His passport (is it Indonesian and did he use it to go to Pakistan in 1980/1981 with his friends since US citizens were prohibited from doing so)
The adoption to Lolo Soetoro and is his name – Barry Soetoro?
Why he forged his draft card and senate application knowing his name is Barry Soetoro?

Legal minds like myself are curious. We don’t drink kool-aid like others and buy balogney. Most of the time, if you are good jurist, you have to PROVE your worth.

Supreme Court would love to be relevant again and show that they can follow the law. Take for instance Gore v. Bush of 2000.

There are other lawsuits going on besides tbe Berg one in various states. One person filed a suit based on Obama not being a citizen even if he was born here. He lost citizenship when he moved to Indonesia. Personally I think the little son of a bitch was born in Kenya, far away from a Hawaii hospital. I’ve seen some dirty shit go in elections but this one takes the cake.

Did Palin Do Her Job?
Politico has an interesting piece on whether Sarah Palin accomplished what she was supposed to accomplish. She was picked for basically three reasons: (1) to excite the base and drive up turnout, (2) to attract independent voters, and (3) to pull the disgruntled (PUMA) women away from the Democrats as a punishment for not nominating Hillary Clinton. How did she do? First, as to driving up core Republican turnout, she didn’t. Core Republican turnout was 1.3% lower than what the embattled George Bush got in 2004. In fact, the reason Obama won Ohio was not that Democrats turned out in great numbers (Obama actually got fewer votes in Ohio than Kerry) but that Republicans stayed home in droves (300,000 fewer Republican votes than in 2004). Second, Palin didn’t help much with independents; they went for Obama by 8% and in numerous polls many of them cited her specifically as their reason for voting for Obama. Probably the biggest disappointment was her lack of support among women; Obama won among women by 13%. The idea that Hillary Clinton’s supporters would vote for any woman, even one who opposes everything Clinton stands for, proved completely false. Many people have written that just thinking this ploy would work is by itelf an insult to women’s intelligence and quite sexist. Clearly it backfired.

Generally, it is impossible to know how the campaign would have gone had hillary run. It’s unlikely Palin would have been selected (why? a relatively new Gov in a solidly GOP state with insignificant EVs). Perhaps Bill’s Kazakhstan ties and his library donors would have had some traction in mobilizing an anti-Hillary vote?

Andy Martin has a court hearing Nov 18th in Hawaii. He says it’s a lawsuit to pry loose Barack Obama’s original, 1961, typewritten birth certificate.

Despite Obama’s attempt to portray their relationship as a distant one, Ayers, in a new afterward to his book “Fugitive Days,” describes Obama as a “neighbor and family friend.” That’s in addition to their years of sharing an office and years of working on 2 boards together. And the coincidence that Frank Marshall Davis (mentor to Obama in HI as he states in his book) was close with Ayers’ dad. And the coincidence that Ayers was at Columbia U the same time as the missing years of Obama’s Columbia U days. The Weather Underground and Black Liberation Army pulled off the Brinks Robbery (3 dead and 1.6 million) nearby in Nanuet NY at that time. Coincidence that one man still in prison from that incident is Sekou Odinga. Yup. Odinga.

) Sarah Palin made a vast difference in McCain’s favor. Compared to 2004, McCain lost 11 points among white men, according to the Fox News exit poll, but only four points among white women. Obama’s underperformance among white women, evident throughout the fall, may be chalked up, in large part, to the influence of Sarah Palin. c) The black vote made a huge difference; but young people did not. Obama, as expected, generated a big increase in African-American voter turnout. Fox News’s exit polls estimate that blacks constituted 13 percent of the turnout in 2008, compared with 11 percent in 2004 and 10 percent in 2000. But voters under 30 years of age were still the same 11 percent of the vote that they were in 2004. The surge of young voters, which was supposed to animate Obama’s rise, failed to happen.

d) The turnout efforts of groups like ACORN made a huge difference. Ultimately, it was the difference in voter turnout among Republicans and Democrats that, in addition to the higher black vote, elected Obama. According to Curtis Gans of American University, Republican turnout dropped from 30 percent in 2004 to 28.7 percent of the electorate in 2008, while the Democratic proportion of voters rose from 28.7 percent to 31.3 percent. Much of this increase came from newly registered voters, many as a result of ACORN’s efforts. Voter registration rose by 6 million in 2008, which may have accounted for virtually all the increase in turnout.

The message for conservatives is clear: The focus of Democrats on grassroots activism, begun in 1998 by MoveOn.org, was crucial to the Obama election. Instead of relying on the Republican Party to carry the message to the electorate, conservatives must organize their own grassroots movements — like GOPTrust.com — and boost turnout and enthusiasm among those who share their worldview. The backbreaking tasks of registering voters and getting out the vote are key to winning elections in the post-media era. Online networking and building of cyber-roots organizations is the way to go in competing in the new politics we face today.

Will the Republican Party get its act together to compete? Who knows. Will conservatives take matters into their own hands and build the kind of organization and Internet base that the liberals have over the past 15 years? They better. Unless we want to witness a fundamental change in our laws, society and culture, conservatives had better get busy and emulate their leftist brethren in building organizations to tap into their base. In the ’80s, groups like the National Rifle Association and the Moral Majority filled this need. Today, new groups must move to the fore to fill the void. And they better do it fast!

Obama’s Exelon ties, Ayers connection

Thomas G. Ayers (1915-2007)(left) is the father of Weather Underground leader and domestic terrorist—and Barack Obama’s friend, “neighbor” and boss of more than a decade—Bill Ayers (right).

Tom Ayers died in his Hyde Park home June 8, 2007. According to his obituary, Ayers was “president in 1964 and served as chairman and CEO from 1973 to 1980. He was the architect of ComEd’s nuclear power program in the 1960s and 1970s.” Following his tenure as CEO, Ayers continued as Chair of the Board of Trustees.

Another Ayers connection is through the Chicago law firm Sidley Austin, where Obama interned during Summer 1989. Here he met his future wife, Michelle Robinson. It was also the same law firm where Bill Ayers’ wife, Bernadine Dohrn, worked. The firm obviously had close ties to the Ayers family, including Tom Ayers.

Later, 1993 to 1996, Obama worked as an associate attorney at the Davis Miner and Barnhill law firm. Judson Miner was a friend of Tom Ayers.

Law professor Stephen Diamond, who blogs at Global Labor and Politics, wrote June 10, 2008:

As I have suggested in earlier posts here it is possible that Tom Ayers served as a mentor to the young Obama as far back as the time Obama spent as a community organizer on the south side of Chicago not far from Tom Ayers’ home in Hyde Park. Obama biographer David Mendell writes that Obama “had returned to Chicago from Harvard Law with an eye on the mayor’s office after witnessing Harold Washington’s historic tenure at city hall.” Tom Ayers’ founded Chicago United, Obama-led Developing Communities Project and Bill Ayers all worked on the same side in the Chicago school wars of the 1987-1988 time period.

My speculation – and, of course, since the Obama campaign won’t discuss these issues in any depth it remains speculation – is that Obama was seriously considering picking up the reins of the late immensely popular first black mayor of Chicago, Harold Washington, whose second term was cut tragically short when Washington had a heart attack in his office.

From his earliest days in Chicago, Barack Obama’s path has been intertwined with that of Bill Ayers, his father, Tom Ayers, and Exelon. There can be no doubt about this. None.

The irony was that I was trying to post an on topic comment on the Rachel vid thread, but it wouldn’t take it.

I posted comments and it didn’t appear. Then I tried reposting and it would say Duplicate comment and STILL not show up.

I then noticed a lot of activity at the top of the thread with someone using the same name, Linda, only and that some of their comments were deleted and started wondering if something was going on because my name too was Linda.

I’ve decided to go to using what I used to use on other blogs as an identifier, but that doesn’t seem to have help my problem.

OLD GRUMPY GUY: I called into the radio show–did you hear me? I used the shortened form of my first name–Juli–and clarified what Homey3 was saying about the birth certificate issue. Woot! I didn’t even know this station existed, and wonder of wonders, it’s local to me. Too bad Hillary’s Village wasn’t aware of it. I see no posting about it on their site. I’m sure Homey3 and I have woken up lots of Las Vegans (and enraged to Obots, assuming any would have been listening).

Sign the Petition : 95,332 Letters and Emails Sent So Far
Article II, Section 1 of the U.S. Constitution reads: “No Person except a natural born citizen, or a citizen of the United States at the time of the adoption of this constitution, shall be eligible to the Office of President; neither shall any person be eligible to that office who shall not have attained to the age of thirty five years, and been fourteen years a resident within the United States.”

There are numerous questions as to Obama’s citizen status raising suspicion and doubt about Obama constitutional qualification to be president. To settle these questions Mr. Obama must produce proof of citizenship!

Documents that must be produced include;
(a) a certified copy of “vault” (original long version) birth certificate;
(b) certified copies of all reissued and sealed birth certificates in the names Barack Hussein Obama, Barry Soetoro, Barry Obama, Barack Dunham and Barry Dunham;
(c) a certified copy Certification of Citizenship;
(d) a certified copy Oath of Allegiance taken upon age of maturity;
(e) certified copies of admission forms for Occidental College, Columbia University and Harvard Law School; and
(f) certified copies of any court orders or legal documents changing his name from Barry Soetoro.

It is reasonable that these documents should be produced considering that his father is Kenyan, his adoptive father is Indonesian, and his grandmother claims to have been present at his birth in Kenya. If he is a natural born citizen then producing these documents should not be any problem.

These allegations will not go away until Mr. Obama produces proof to federal authorities and the public. If he will not do so voluntarily he must be compelled by every means available. You, as an employee of The People, have sworn an oath to support and defend the Constitution.

We The People are demanding you to make every effort, both public and private, to resolve this fundamental Constitutional question before 20 January.

Pfft, this is garbage. All you people think Obama is illegal yet you fail to realize the simple facts. Obama does not have to show everybody his original birth certificate, that poses many security issues. A Certificate of Live Birth is what I got when I lost my original, it is just as valid.

Berg has to convince the court, not Obama. Secondly you think the DNC would’ve let him get this far? You think McCain wouldn’t have jumped on this early, or Hillary for that matter? Just use your common sense people. You are all just itching for controversy, it’s actually really funny.

All Berg is doing is looking for an outdated loophole that only applies to his mother, he was born on US soil. Now the constitution is not clear on the matter exactly, which is too bad, but if there was a real concern not even the media could have saved him long before the primaries even took place.

If you visit their home page, you will see an enlarged section from a 1963 Hawaiian birth certificate box 7c with the caption “Foreign Country” which they claim proves that Hawaii allowed foreign-born persons to register on the Live Birth form. The fraud is that blocks 7a-7g are the MOTHER’S RESIDENCE, not the place of birth, which is in block 6a and has nothing about “Foreign Country”. It’s a total scam which they hope nobody will notice since the full certificate showing the context is too blurry to read.
