The Age limit for Senator has been waved three times in the past — for Men.

Henry Clay 1806, 29years, 7 months, 9 days.
Armistead Mason 1816, 28 years 5 months, 17 days.
John Eaton 1818, 28 years, 4 months, 30 days.

These were in fact the ages of the three men, which they never denied.

We are now to deny to a Woman what has three times been granted to men??

All three men sought their position, which was by appointment, not popular election, with the full knowledge that they did not meet the age requirement set forth in the First Article of The Constituion.

It was waved for all three men and the appointments made.

We are asking no more and no less for Chelsea Clinton.

As in the privious three cases, this will be by appointment until 2010.

When Chelsea is required to run for the seat in 2010 she will be Thirty years of age as required.

When the term expires in 2012 and she is again required to run, she will be Thirty Two.

I am aware of the change to the Popular election of Senators and that the requirement has not been waved since.

But, This is an Appointment! The precedent to wave on Appointment exists and David Patterson would be within his Constitutional Rights To wave it.

The 1935 Holt V Hatfield dispute was not an “Appointment” to the Senate, but an election.

Holt’s delay to take the oath did not violate the requirement and was O.K. with the “Majority” that elected him, so the Senate sided with Holt.

Again: David Patterson is appointing and will be in keeping with the precedent of the three previous “Appointments” that waved the requirement and will NOT violate the Holt precedent.

A “Democratic” Senate will not upset a sitting Democratic Governor on such a mute point.

Chelsea will turn Thirty eleven months before being sworn in after winning in 2010.

That means the seat will be held by a person who was not Thirty for just thirteen months.

Well, you “think” wrong. Biden was born on Nov 20, 1942. He was first elected to the Senate on Nov 7, 1972, at the age of 29 years, 11 months and 19 days old. He assumed the office of Senator on Jan 3, 1973, at the age of 30 years, 1 month and 15 days.
As long as a person will have reached the required age BY THE TIME HE/SHE TAKES THE OATH OF OFFICE, it doesn’t matter how old the person is when elected. (With the Presidency, as long as the person turns 35 NO LATER THAN Jan 20*, he/she is eligible to begin running for the office several years earlier.) As to this folderol about the “age requirement” being waived, it cannot be applied to Chelsea Clinton.
The history is as follows:
Prior to 1935 (you do see that date, correct?), only 3 men (I could have said people since no woman held the title of Senator until the late 20th Century, but I digress) younger than the Constitutional requirement were sworn in as Senators: Henry Clay (age 29 yrs, 7 mos, 8 days); Armistead Mason (age 28 yrs, 5 mos); and, John Eaton (age 28 yrs, 4 mos, 30 days). Clay took office in 1806; Mason, in 1816; Eaton, in 1818. The first problem is that birth records in those days were not entirely accurate–a number of politicians, as well as common folk, never really knew when they were born; in most cases, the problem was simply a matter of days or weeks but for some, especially those who were born out of wedlock or days after a “shotgun wedding”, months could be subtracted or added to the *official* date of birth to avoid or lessen scandal. Also, childbirth and early infancy was a struggle for many families and children’s births weren’t always formalized for 1-2 years, by which time it was incredibly easy to forget exactly when the child was born (or even how old he really was). Some early Census records carried question marks beside people’s ages because the person wasn’t exactly sure of his/her own age.
Another factor to be considered here is that all 3 men lived in an age when Senators were not all popularly elected (but instead, selected by their State Legislatures).
Now, to 1935. Rush Holt, who in 1934 ran for the US Senate seat then held by Henry Hatfield, was only 29 years old. During his campaign, he was aware that he was officially too young to take office on Jan 3, 1935 so he swore that he would not take the oath of office UNTIL he officially turned 30 until June of 1935. Hatfield filed a challenge to this with the Senate and demanded that he be declared the winner since he received the most votes of the other “eligible” candidates. The Senate rejected this and determined the age requirement applies at the time of oath-taking ONLY. (It also rejected Hatfield’s claim to being declared the winner by default.) Holt, who’d been elected at the age of 29 yrs, 4 mos, 19 days, took the oath of office on June 21, 1935, at the age of 30 years, 3 days.
By the time that Chelsea could do the same thing, she would have practically served no time at all in the Senate before the seat would be up in 2010. It’s REALLY unlikely that the Senate will waive the eligibility requirement, especially after Holt’s precedent. (And, if there’s one thing about “precedent”, the one that most closely matches both the spirit and the letter of the law is the one that will be followed thereafter–until the law is absolutely changed.)

*An exception is typically made when January 20th falls on a Sunday and the formal Inauguration Ceremony is then held on January 21st. This has very rarely happened throughout history (even before the 20th Amendment) but the theory is that the Speaker of the House acts as the temporary President; the law isn’t completely clear on when the outgoing President’s duties officially end–it’s always been presumed that they end the day before the new President takes the oath (i.e., Jan 19th). There’s only been ONE time since 1933 (when the 20th Amendment was ratified) that January 20th has fallen on a Sunday following a Presidential election–1985 (after Reagan had been re-elected); the next time we can expect that to happen in 2013 (if Obama should be re-elected, we’ll have dodged the Constitutional question again; if he’s defeated, we’ll get a new civics lesson).

David, who is filling a “Vacancy himself, Will have to run for election for the first time as Gov. of New York in 2010.

He will be on the ticket in 2010 with whomever he appoints to fill Hilary’s term even though it doesn’t expire until 2012

Chelsea on the Ticket in 2010 will be an asset to David, who has to run himself for the first time.

The Clinton’s are proven money raisers and “Stump Draws”.

Chelsea can bring out the “BIG GUNS” to help David Campaign in 2010—Bill and Hill!

Chelsea, like her Mother will have “Star power” for younger voters and Women.
