NSA, FISA and the Telecoms

First of all apologies for not posting much this week in Susan’s absence. I’ve been swamped at work, because the magazine where I work is going to press. So a lot of late nights all week.

Now, if you haven’t already, I recommend everyone read Murray Waas’s lengthy article about Gonzales and the NSA probes, posted at Huffington:

Senior federal law enforcement privately question the propriety of Gonzales receiving such sensitive information about subordinates being scrutinized in one inquiry when those same individuals were likely to be witnesses about alleged misconduct by Gonzales for the other investigations.

Meanwhile, the Senate has capitulated on FISA, granting the Telecoms immunity. The Democrats weren’t united, some of them were in the pocket of the telecoms [such as Rockefeller] and the GOP took advantage of that to get the bill passed.

Surprised? No wonder only 21% of the public approves of what the Democrats are doing in Congress.

Here’s what Senator Dodd had to say about it:

“While the President may think that it’s right to offer immunity to those who break the law and violate the right to privacy of thousands of law-abiding Americans, I want to assure him it is not a value we have in common and I hope the same can be said of my fellow Democrats in the Senate.”For too long we have failed to respect the rule of law and failed to protect our fundamental civil liberties. I will do what I can to see to it that no telecommunications giant that was complicit in this Administration’s assault on the Constitution is given a get-out-of-jail-free card.”

UPDATE II: Senator Pat Leahy excoriated his fellow Dems for brokering a deal with the White House.

UPDATE III: Senator Harry Reid, who also gets substantial contributions from telecoms, plans to push the bill forward in November. Reid is doing an end-run around Dodd, voters and the Constitution.

UPDATE IV: Salon’s Glenn Greenwald summarizes what’s happening:

Just think about what is really happening here. AT&T’s customers sued them for violating their privacy in violation of long-standing federal laws and for violating their Fourth Amendment rights. Even with the most expensive armies of lawyers possible, AT&T [one of Senator Reid's largest contributors] and other telecoms are losing in a court of law. The federal judge presiding over the case ruled against them — ruled that the law is so clear they could not possibly have believed that what they did was legal — and most observers, having heard the Oral Argument on appeal, predicted that they will lose in the Court of Appeals, too.

So AT&T and other telecoms went to Washington and — led by Bush 41 Attorney General (and now Verizon General Counsel) William Barr, and in cooperation with their former colleague, Mike McConnell — began paying former government officials such as Dan Coats and Jamie Gorelick to convince political officials to whom they give money, such as Jay Rockefeller, to pass a law declaring them the victors in these lawsuits and be relieved of all liability — all based on assertions that a court of law has already rejected. They are literally buying a judicial victory in Congress…

UPDATE IV: Who knew country singer Charlie Daniels was an expert on FISA? Daniels told Fox’s Cavuto, “we have to look at people’s email.”

    I am sorry to say that I think it comes down to a simple ‘tell the people what they want to hear’ argument. I am so disgusted with the immunity deal that is being set up to force on the people, as well as the blocking of the SCHIP funding, that I think I have about given up on all the people whom have either been elected or appointed. I became a dem some years ago, but no longer hold out hope for any of the liars and platitude makers that we see as representing us… I think I have pretty much decided to vote against and yes work against any dem who has voted with these thugs once again. They are all liars these days, throw them all out. Looks like just more of the same bullsheet coming out of these buzzards who call themselves our representatives.

    Dodd is the only one with any guts on this, at least out of the presidential candidates. He put a hold on the bill already, and not a secret one like Ted Stevens would do.

    I’ve been an Edwards supporter up to now, but am seriously considering switching to Dodd because of his move here. Since I’ve very little money I can’t give much to anyone’s campaign.

    I think this is even a ploy by Dodd. nore of the same. Just like Kucinich on the war, it doesn’t ever go anywhere. I doubt Dodd can take it on all by himself, and if he wants to be Prez, I think he should show leadership and get Pelosi and Reid on board. Otherwise, just more of the same. Actions, real actions, not just some mouthed words to capture the moment, may change my mind. The dems are just as bad as the others…

    Just read on Firedoglake that Reid has decided to push the bill thru anyway, going around Dodd’s hold. I don’t know how to buck up anymore… seems like I’ve been fighting these idiots for WAY too long, and am just about down for the count… I am tying another knot, for all the good it will do…

    Dodds has used some of the strongest words I have heard in a long time. There was no attempt at diplomacy. He sounded like a one really pissed off politician. Let’s see where this goes.

    In practicality it won’t make any difference. There is more than enough protection in place (ref: Watergate). Regards whistleblowers, well I think the playing field becomes more even. There is now zero doubt that any collusion with the NSAs will be in full view of the target.

    Perhaps there’s a case for a private sector NSA? In the spirit of “keeping the bastard’s honest”

    Leslie, if you read my posts of a few years back, I did suggest that the Dem’s might have been put in to demonstrate their incompetance. All in all they are doing a pretty good job, partly because they were in on it right from the start as Bush did not get where he got by accident.

    With all Michael Moore’s support of Gore, the toe rag is pushing a pup yet again. Directing a campaign of evolution change entirely at the wrong people continuing his mad hatter’s role as professionally resolutely as ever.

    I still absolutely believe that Hilary Clinton will be your next President. But a lot can happen between now and then. Oh, and I have changed my mind, I am beginning to like Carter the more I hear him talk. Age has promoted wisdom in his instance. Shame he couldn’t find the words throughout his presidency.

    Why can any GOP Senator put secret holds on legislation and Harry Reid honors this? It is time for new leadership for the Dem’s. It is obvious that Harry Reid is in the tank for the telecoms. If we want any meaningful change, then our push has got to be for Campaign Finance reform. What the American people are beginning to understand is that it would be far cheaper (therefore more conservative) than what it cost us in coporate welfare. Government hasn’t worked for the people for some time. We have to challenge every Democrat or Republican in primaries. They will only get the message when they are fired by the people they actually work for.

    The Multi-spectral Asymmetrical War that is being waged against us will be reversed ONLY when we as a nation of people understand and accept we are no longer a nation of laws. The only way any of these events of the last few years can make sense is if we look at through the lens of intentional chaos. One has to wonder why you would seek to expose and roll up an operation as important as the one in Iran regarding nuclear black markets and weapons transfers by outing a NOC. The war with Iraq was not the objective…. the shredding of the US Constitution was and is the goal.

    You are absolutely right TWK, collect a prize.

    But the Consititution was flawed from the outset. Firstly it presumed that there were classes of human beings, so it was unfair. Second it was designed to fulfil the pruitan religious ambitions of the Founding Fathers. Third, it empowered the protester while enabling the perpetrators, a freedom of speech is inaction.

    They talk of the US being a multi cultural society. Providing everyone follows its puritan laws, they can do as they will. In my book that makes everyone puritan.

    Of course, the sad fact of the matter is this. We all, each and everyone of us, die and we have an ultimate choice in the vocation we call our lives. That is to be selfish or selfless. Jesus pointed it out very clearly and successive religious administrations (starting with St Paul) have done everything in their power to undermine that message.

    Saddly, as I meantioned in the Ann Coulter thread, Puritanism is just another version of Judaism where your possessions are a measure of your Godilness and the selfless are the scourge of society who don’t deserve respect. There is a small conflict in that statement as Jesus still has enormous power, so there a lot of bet hedging going on. In one breath the good Samaritan is celebrated, while in the next he is presented as a conspirator.

    The problem is and always has been, TWK, that the Constitution was flawed and needed to be written from scratch.

    Having said that the current direction will present Hitler’s vision of a segregated World with anyone daring to dissent mercilessly disposed of.

      Thanks for the interesting response, Thinker. What prize would you recommend? I am curious as to why your response to my comment was to raise the subject of religion. The Constitution is flawed, in the sense that it relects the human condition. My ultimate point is that, collectivly as a nation, we are in a state of denial and won’t move forward until we relize how to respond when given “noquater”.
      What would a Constitution written from scratch look like to you?
